HomeMy WebLinkAbout2019-07-11 Windward Planning Commission MinutesWINDWARD PLANNING COMMISSION COUNTY OF HAWAII MINUTES JULY 11, 2019 The Windward Planning Commission met in regular session at 9:00 a.m. in the County of Hawaii, Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawaii, with Chairman Joseph Clarkson presiding. COMMISSIONERS PRESENT: Gilbert Aguinaldo, Dean Au, Joseph Clarkson, John Replogle. ABSENT & EXCUSED: Donn Dela Cruz, Thomas Raffipiy. ALSO PRESENT: Michael Yee (Planning Director), Malia Hall (Deputy Corporation Counsel for the Windward Planning Commission), Jeff Darrow (Planning Program Manager), Christian Kay (Planner), Alex Roy (Planner), and Sarah Hata-Finley (Commission Secretary). A quorum was present. Chairman Clarkson introduced Windward Planning Commissioners and staff to members of the public and went over the procedures for public testimony. STATEMENTS FROM THE PUBLIC — No statements were presented under this section of the agenda. 1. APPLICANT: CHARLES UMEMOTO (REZ 19-000235) Application for a Change of Zone from an Agricultural -3 acres (A -3a) to a Single -Family Residential -10,000 square feet (RS -10) zoning district for 7.631 acres of land. The subject property is located at the end of Mailani Street, on the west side of Ho'omalu Street, Waiakea Homesteads, South Hilo District, Hawai'i, TMK: (3) 2-4-080:013. The Commission took this item up at 9:02 a.m. with 12 members of the public in attendance. (SEE EXHIBIT A) This item ended at 10:09 a.m. MINUTES — The Commission took this item up at 10:10 a.m. Approval of Minutes of the June 6, 2019 Meeting_— It was moved by Commissioner Replogle and seconded by Commissioner Aguinaldo, that the Minutes of June 6, 2019, be approved as circulated. Motion was unanimously carried by a voice vote of all Commissioners in attendance. ADMINISTRATIVE MATTERS 1. Discussion of recent Special Management Area (SMA) determinations, minor permits and enforcement action issued by the Planning Director. Page 1 of2 Windward Planning Commission July 11, 2019 Minutes At 10:11 a.m., Commissioner Au asked staff what the purpose of the SMA Report was since the Commission did not act upon the applications listed in the report. He noted that he previously served on the Planning Commission [2010-2012] and that this was a new procedure. Mr. Kay explained that when the SMA rule was amended a few years ago, staff was asked to provide monthly updates to the Commission on SMA assessments, minor permits, and exemptions. Director Yee added that the Commission gave him certain authority regarding the SMA, and the monthly report was a way to keep the Commission apprised of his decisions concerning the SMA. ANNOUNCEMENTS — At 10:13 a.m., Mr. Kay informed the Commission that their decision to deny the SMA Permit for Piilani Partners, LLC [SMA 18-070] was appealed to the Third Circuit Court and that staff was currently in the process of compiling the record for transmittal to the Court. ADJOURNMENT — There being no further business, it was moved by Commissioner Au and seconded by Commissioner Replogle that the meeting be adjourned. Motion was unanimously carried by a voice vote of all Commissioners in attendance.
