HomeMy WebLinkAbout2019-05-17 Police Commission Regular MinutesHAWAII POLICE COMMISSION REGULAR SESSION MINUTES MAY 17, 2019 WEST HAWAII CIVIC CENTER, BUILDING G CONFERENCE ROOM 74-5044 ANE KEOHOKALOLE HWY, KAILUA-KONA, HAWAII CALL TO ORDER Vice Chair Pasco called the meeting to order at 9:15 a.m. ROLL CALL Present: Colleen Pasco, Vice Chair John Bertsch, Commissioner Thomas Brown, Commissioner Jude Mattos, Commissioner Denby Toci, Commissioner Absent: Wayne De Luz, Chair Jak Hu, Commissioner Joan Obra, Commissioner Paul Paiva, Commissioner A quorum was present. Also present: Paul Ferreira, Police Chief Kenneth Bugado, Deputy Chief James O'Connor, Assistant Chief Mitchell Kanehailua, Assistant Chief Samuel Thomas, Assistant Chief Burt Shimabukuro, Captain Malia Hall, Deputy Corporation Counsel Josie Pelayo, Secretary STATEMENTS FROM THE PUBLIC ON AGENDA ITEMS (None.) APPROVAL OF MINUTES Commissioner Mattos motioned to approve the minutes of April 12, 2019, regular and executive session minutes. Commissioner Toci seconded, and it carried unanimously. POLICE CHIEF'S REPORT ON DEPARTMENT ACTIVITIES Items from the written reports were highlighted: Crime Report: AC Kanehailua reported that up through April 30, there were 6,644 serious crimes. The Criminal Investigation Units investigated 724 of those cases. For the month of April, they received 8,289 calls for services. No crime trends were reported for the month of April. Hawaii Police Commission Regular Session Minutes May 17, 2019 Page 2 • Traffic Report: AC O'Connor reported that year-to-date, they had 7 traffic fatalities. For the month of April, 5,527 citations were issued for: moving/regulatory 4,034, seatbelt 373, child restraint 40, and speeding 1,080. In May, they had 27 DUI arrests; 6 involved auto accidents. • Personnel Report: Assistant Chief Thomas reported having 22 sworn vacancies. By the end of May they will have additional vacancies. They are doing background checks for the 91 st recruit class. They recently hired 4 new dispatchers. • Finance Report: Assistant Chief Thomas reported that they are over their budget for overtime. The Mayor gave them two more positions. Commissioner Bertsch stated that their personnel numbers have gone up, but their supplies budget hasn't gone up. AC Thomas stated that they move funds around and live with what they have. • Commendations of Sworn and Civilian Employees: Chief Ferreira reported receiving 8 commendations involving 16 personnel since the last commission meeting. • Other Department Activities: Deputy Chief Bugado reported that they had CALEA mock assessments April 15-18. Assessors toured every district station and conducted interviews. They received a positive report from the assessors who made recommendations. They pointed out that they have an incredible amount of vehicles in storage. Many of the vehicles are being held for the Prosecutor. They have taken steps to get more space in their warehouse. Sometimes they have up to 60 vehicles. Deputy Chief Bugado stated that some have been sitting there for 20 years. Chief Ferreira stated that the cases have to be adjudicated in court. Commissioner Bertsch requested a presentation on CALEA. Chief Ferreira reported that with regards to their training budget, the instructors are the same no matter how many recruits they have. They always look at grants and other areas of funding for training. Training is also done via computer. They have a training coalition throughout the state that they share and piggy back with the other counties. Their budget hearing with the County Council will be on May 22. They always welcome the commission's support at the hearings. Police week ceremonies were held the past week. He thanked Commissioner Bertsch for attending both ceremonies in Hilo and Kona. Commissioners are welcome to attend all ceremonies and commanders' meetings. UNFINISHED BUSINESS • Program of Work for the Police Commission: No report. • Program of Work for the Police Chief: No report. CHAIR'S REPORT ON MATTERS OF INTEREST TO THE COMMISSION (None.) Hawaii Police Commission Regular Session Minutes May 17, 2019 Page 3 EXECUTIVE SESSION (CLOSED SESSION) Commissioner Mattos motioned to meet in executive session to consider charges against officers or employees of the Hawaii Police Department where matters affecting privacy will be involved, to consider sensitive matters relating to public safety, and may consult with Corporation Counsel on questions and issues pertaining to the commission's powers, duties, privileges, immunities, and liabilities pursuant to HRS 92- 5 (a) (2) (4) (6) and the Hawaii County Charter Section 13-20 (b). Commissioner Toci seconded, and it carried unanimously. Executive session convened at 9:50 a.m. Regular session reconvened at 11:07 a.m. ACTION ON EXECUTIVE SESSION MATTERS • Correspondence 19-02: Request for representation by Corporation Counsel in Civil No. 19-1-099K. Commissioner Mattos motioned to approve representation by Corporation Counsel. Commissioner Toci seconded, and it carried unanimously. • Investigation of Complaints ✓ HPC 19-01: Complainant alleged that his rights were violated and a search warrant was invalid when officers raided his home. Commissioner Mattos motioned that there was insufficient evidence to prove the allegations of misconduct. Commissioner Toci seconded, and it carried unanimously. ✓ HPC 19-04: Complainant alleged that an officer took his Hawaiian Kingdom motor vehicle operator's certificate during a traffic stop. Commissioner Brown motioned that there was insufficient evidence to prove the allegations of misconduct. Commissioner Mattos seconded, and it carried unanimously. ✓ HPC 19-05: Complainant alleged that while doing work at the police station, an officer yelled and used profanity at him. The complaint was continued to the next meeting in order to hear from the complainant. ANNOUNCEMENTS Vice Chair Pasco announced that the next monthly meeting is scheduled for June 21, 2019, 9:00 a.m., Aupuni Center Conference Room, 101 Pauahi St., Hilo, Hawaii.
