The following persons were present: ROLL CALL Action Committee Members Present: Charles Young (Chair), Hiram Rivera, and Janice Palma-Glennie. Action Committee Members Absent -Excused: Shirley David (Vice -Chair), David Huerta, Franz Weber, Barbara DeFranco, Kari Kimura, and Shane Palacat-Nelsen. Councilmembers Present: Aaron Chung, Ashley Kierkiewicz, Herbert "Tim" Richards, Karen Eoff, Maile David, Matt Kaneali'i-Kleinfelder, Rebecca Villegas, Susan "Sue" Lee Loy, and Valerie Poindexter. Staff: Bethany Morrison, Heather Bartlett, Kamuela Plunkett, and Michael Yee. Chuck Flaherty, representing himself, testified in opposition to Bill 87, Kona CDP Amendments. He expressed feeling that the amendment package qualifies as a comprehensive review since the proposed amendments would lead to substantial changes in the plan. He shared that he was involved with the Community Development Plan from the beginning, including attending various public meetings and was involved in several special interest groups during the public input process. He also shared to have followed and read through all of the communications related to the amendment process which he believes undermines and dilutes the CDP. He requested the bill be tabled and a community charrette process on the bill be put in its place. 2. Shannon Rudolf, representing herself, spoke in opposition to Bill 87, Kona CDP Amendments. She expressed her concern that a plan without mandating language would sit and "collect dust" rather than being actively implemented. She shared her recollection of the drafting process of the CDP which involved numerous community events with hundreds of participants. She requested to postpone the amendment process in order host a public charrette to gauge community input. Hawai `i County is an Equal Opportunity Provider and Employer Page I 3. Janice Palma-Glennie, representing herself, testified on Bill 87, Kona CDP Amendments. She asked Councilmembers to muster the political will to implement the financing plan and generally contribute to the plans implementation through the budget. She asked that the amendments pertaining to landscaping be reassessed carefully. She generally sought for alignment between the Kona CDP and the County Code and better educational outreach on behalf of the County. She expressed concern for unplanned development and a hope that we do not allow for that to continue in the future for the Kona Community. 40 Dwight Vicente, representing the Hawaiian Kingdom, testified in opposition to Bill 87, Kona CDP Amendments. He expressed that lands referenced in the CDP still belong to the Hawaiian Kingdom and that the County has no jurisdiction. 4- Business: 1. County Council's Public Meeting Regarding Planning Director Initiated Amendments to the Kona Community Development Plan (KCDP). A complete video of this meeting is available to view on the County Council website: http://hawaiicounty.granicus.com/ViewPublisher.php?view id=1 This meeting was a concurrent County Council meeting and a Kona Community Development Plan Action Committee meeting to abide by the Sunshine Law (HRS Chapter 92) and enable the CDP Action Committee members to attend and provide comments to the County Council. The purpose was to determine passage of the Kona Community Development Plan Amendments on its first reading before County Council. Members of the Kona CDP Action Committee attended this meeting and were able to testify and answer questions from County Council Members. Councilmember Kierkiewicz moved to approve Bill 87 on its first reading. Second by Councilmember Richards. r Councilmember Kierkiewicz moved to amend Bill 87 with the contents of Communication Number 352.011. Second by Councilmember Eoff This additional amendment [AC Communication Number 2019-23] may be viewed and downloaded from the following website: http://records.hawaiicounty.gov/Weblink/1/doc/101407/Pagel.aspx Planner Plunkett explained that this proposed amendment to Policy LU -3.4 was intended to uphold the highest level of environmental protection in the plan while mitigating any possible legal conflicts. He explained that this policy would ensure that applications would still be subject to review based on the Clustered Rural Subdivision Guidelines and that it would not be only at the applicant's option. Councilmembers thanked planning staff for being diligent in checking for any issues or inconsistencies with the proposed amendments. Councilmember Richards asked for an example of what might have occurred if the amendment was not altered in this way. Planner Plunkett explained that the policy addresses everything which falls outside of what the plan designates as the Kona urban area. By making the policy at the applicant's option as was originally proposed, it would create the potential for applicants to disregard the clustered rural subdivision guidelines that the policy originally called for. This additional amendment would www. hip Ian n in, -dept. co m konana,hawaiicounty.zov Page 2 also provide the Planning Director some latitude to decide when and how the clustered rural subdivision guidelines would be most appropriate to implement, including providing stricter protections to lands with valuable natural and cultural resources. Councilmembers expressed their general support for this amendment emphasizing the importance of environmental protections. Upon the motion to amend Bill 87 Kona CDPAmendments with the contents of Communication 352.011 a vote was taken. The motion passed unanimously.
