DRAFT Meeting Report
CALL TO ORDER BY THE COUNTY COUNCIL
Vice -Chair Eoff called the County Council meeting to order at 9:10 am in the West Hawai'i Civic Center
Council Chambers.
The following persons were present:

Action Committee Members Present: Shirley David (Vice -Chair).
Action Committee Members Absent -Excused: Charles Young (Chair), Barbara DeFranco, David Huerta,
Franz Weber, Hiram Rivera, Janice Palma-Glennie, Kari Kimura, and Shane Palacat-Nelsen.
Councilmembers Present: Aaron Chung, Ashley Kierkiewicz, Herbert "Tim" Richards, Karen Eoff, Maile
David, Matt Kaneali'i-Kleinfelder, and Susan "Sue" Lee Loy.
Councilmembers Absent -Excused: Valerie Poindexter, and Rebecca Villegas.
Staff: Bethany Morrison, Heather Bartlett, and Kamuela Plunkett.

PUBLIC TESTIMONY AT COUNTY COUNCIL MEETING:
1. Dwight Vicente, representing the Hawaiian Kingdom, testified on Bill 87, Kona CDP
Amendments. Mr. Vicente testified on various bills and resolutions on the agenda, he stated
that the area within the Kona district was not ceded in 1898 and therefore not under County
jurisdiction.
2. Ken Melrose, representing himself, testified in support of Bill 87, Kona CDP Amendments. He
introduced himself as an active participant in the Kona CDP since its inception. He asked the
Council or their support in passing the second and final reading of the amendment package
stating it will allow them to more successfully implement the plan.
3. Shirley David, representing herself, testified in support of Bill 87, Kona CDP Amendments. Ms.
David introduced herself as the vice -chair of the Action Committee and a previous member of
the CDP Amendments Subcommittee. She expressed her support for the amendments as
drafted.

4. Michael Matsukawa, representing himself, testified in opposition to Bill 87, Kona CDP
Amendments. Mr. Matsukawa stated that he has participated in the Kona CDP since its
inception and that he has submitted testimony to the Action Committee, the Leeward Planning
Commission, and the County Council previously. He expressed that the amendments to policy
ENV -1.5 have the potential to create inconsistencies with the County Charter section 13-29
since the language in the CDP would not have the same legal strength.
4- Business:
1. County Council's Public Meeting Regarding Planning Director Initiated Amendments to the Kona
Community Development Plan (KCDP).

This meeting was a concurrent County Council meeting and a Kona Community Development Plan
Action Committee meeting to abide by the Sunshine Law (HRS Chapter 92) and enable the CDP Action
Committee members to attend and provide comments to the County Council. The purpose was to
determine approval of the Kona Community Development Plan Amendments on its second reading
before County Council. Members of the Kona CDP Action Committee attended this meeting and were
able to testify and answer questions from County Council Members.
Councilmember Kierkiewicz moved to adopt Bill 87 draft 2. Second by Councilmember Lee Loy
Councilmember David moved to amend Bill 87 with the contents of communication 352.16.
Second by Councilmember Matt Kan eali'i-Kleinfelder.

Ms. David expressed the importance of keeping the original language "shall strive to' in order
to maintain both the original intent of the policy and consistency with the County Charter. She
requested a postponement to allow the other Councilmembers time to consider the
amendment.
Councilmember David moved to postpone Bill 87 to the September 0, 2019 Council meeting.
Second by Councilmember Matt Kan eali'i-Kleinfelder.
Ms. David clarified that she would like to table her original motion to amend Bill 87 with the
contents of communication 352.16 until the next hearing.
The Council discussed whether or not voting on the new proposed amendment at the next
meeting would warrant an additional follow-up meeting to adopt the bill. Clerk Hendricks
explained that the motion to amend on September 4th would require an additional hearing in
September to adopt unless they agree to suspend their rules.
Councilmembers discussed some concern about having mandatory language in the plan that
could open up unintended consequences, as well as some concerns about how this language
translates to Planning Department processes.
Upon the motion to postpone the discussion on Bill 87 Draft 2, Kona CDP amendments a vote was
taken. The motion passed unanimously [Councilmembers Poindexter and Villegas were not present.]

ADJOURNMENT: The Bill 87 agenda item ended at approximately 10:20 am.
