MINUTES
OCTOBER 3, 2019
The Windward Planning Commission met in regular session at 9:00 a.m. in the County of
Hawaii, Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawaii, with Chairman
Joseph Clarkson presiding.
COMMISSIONERS PRESENT: Gilbert Aguinaldo, Dean Au, Joseph Clarkson, Donn Dela
Cruz, Thomas Raffipiy, John Replogle.
ALSO PRESENT: Michael Yee (Planning Director), Malia Hall (Deputy Corporation Counsel
for the Windward Planning Commission), Jeff Darrow (Planning Program Manager), Alex Roy
(Planner), and Sarah Hata-Finley (Commission Secretary).
A quorum was present. Chairman Clarkson introduced Windward Planning Commissioners and
staff to members of the public and went over the procedures for public testimony.
STATEMENTS FROM THE PUBLIC — No statements were presented under this section of the
agenda.
1. APPLICANT: DR. TREVOR RODRIGUES (AMEND REZ 09-000090)
Application for a time extension for Condition D (Time to Complete Construction) and
Condition F (Dedicate Future Road -Widening Setback) of Ordinance No. 09-090A,
which reclassified approximately 45,800 square feet of land from a Single Family
Residential -10,000 square feet (RS -10) to an Industrial -Commercial Mixed -20,000
square feet (MCX-20) zoning district in 2009. The subject property is located along the
north side of East Kawili Street at the corner of Laukapu Street and across the street from
Central Supply, Waiakea Houselots, Waiakea, South Hilo, Hawaii,
TMK: (3) 2-2-050:043.
The Commission took this item up at 9:01 a.m. with 4 members of the public in attendance.

MINUTES — The Commission took this item up at 9:33 a.m.
Approval of Minutes of the August 1, 2019 Meeting_— It was moved by Commissioner Au and
seconded by Commissioner Dela Cruz, that the Minutes of August 1, 2019, be approved as
circulated. Motion was unanimously carried by a voice vote of all Commissioners in attendance.

ADMINISTRATIVE MATTERS
1. Discussion of recent Special Management Area (SMA) determinations, minor permits
and enforcement action issued by the Planning Director.
At 9:33 a.m., upon a status inquiry by Commissioner Au, Mr. Darrow clarified that the
Special Management Area Assessment Application for W.H. Shipman, Ltd [SAA 19-
001694] was completed on September 23, 2019.
ANNOUNCEMENTS — At 9:34 a.m., Ms. Hall updated the Commission regarding the Piilani
Partners appeal [Civil No. 19-1-0163/SMA 18-000070] and stated that she had submitted the
Answering Brief to the Third Circuit Court.
Commissioner Au asked Mr. Darrow to explain the process of the General Plan (GP) update.
Mr. Darrow stated that the Planning Department's Long Range Division and the Planning
Director were conducting multiple "Speak Out" meetings island wide to get feedback and
community input on the draft GP. Mr. Darrow confirmed that a copy of the draft was sent to the
Planning Commissioners and asked them to start reviewing it. He encouraged the
Commissioners to also attend the "Speak Outs" in their individual capacity. Mr. Darrow said
that he anticipated that the draft GP will go before both Planning Commissions sometime in
March/April of 2020 and before the County Council in mid -2020.
Chairman Clarkson stated that he noticed that the draft GP and the Community Development
Plans (CDP) were sometimes in conflict and requested staff to make a graphic that showed those
inconsistencies before the draft GP went before the Planning Commissions for consideration.
Mr. Darrow responded yes, and reiterated that the Commissioners could also attend these
community meetings as individuals to submit their personal comments and testimony. He added
that the Long Range Division had also been actively meeting with large landowners for input.
Mr. Darrow stated that comments relating to the CDPs and the draft GP have already come in
and that even though the CDPs may propose specific land use designations, that could be
changed based on certain economic factors.
Director Yee stated that at the current time, it might be more efficient for the Commissioners to
inform individual staff about certain conflict between the GP and CDPs. Director Yee said that
there was some criticism received that the GP being a visionary document was prescriptive. He
clarified that the current draft addressed the policies that were being suggested and did not
contain the narrative portion of the GP.

ADJOURNMENT — There being no further business, it was moved by Commissioner Dela
Cruz and seconded by Commissioner Aguinaldo that the meeting be adjourned. Motion was
unanimously carried by a voice vote of all Commissioners in attendance. Chairman Clarkson
adjourned the meeting at 9:41 a.m.
