Re: Nomination of Exceptional Tree
Valencia Orange (Vancouver) (Citrus sinensis)
TMK• 8-1-009001 Council District 7 (South Kona)
Pursuant to Section 14-60 of the Hawaii County Code ("HCC"), the Arborist Advisory
Committee recommends the above-mentioned tree be designated as an exceptional tree and
added to the county's list of exceptional trees in HCC Section 14-65.
This Valencia Orange (Vancouver) is located in Kaawaloa, South Kona on the same pazcel as
Exceptional Tree No. 2 - Pili Nut (Canarium sp). It is one of the seedlings that Capt. Vancouver
gifted to Napoopoo Chieftess Kapiolani in 1791. Although the tree was cut back, a new trunk
came up. The fruits have been used over the years by Punahou alumni for fundraisers on Oahu.
On behalf of the owner, the Arborist Advisory Committee requests the August 14, 2007 Council
committee hearing be waived and this bill be set on the agenda for the County Council meeting
in Kona on August 15, 2007. This will allow the Kona property owner and/or community the
opportunity to appear at the Kona Council meeting to support the exceptional tree nomination.

ACCEPTANCE FORM FOR EXCEPTIONAL TREE STATUS
BY REAL PROPERTY OWNER
I, the undersigned, am the fee simple owner of real property on which grows a tree, stand,
or grove of trees that has been nominated as an Exceptional Tree, under the criteria of
Exceptional Trees set forth in Chapter 14, Article 10, Section 14-57 of the Hawai"i County Code.

I agree to allow the tree/stand/grove to be designated as an Exceptional Tree and placed on
the list of Exceptional Trees of the County ofHawaii in Hawaii County Code Section 14-65 and
an official map prepared and filed with the Planning Department. I understand designation as an
Exceptional Tree is subject to the Arborist Advisory Committee' study and recommendation, a
duly held public hearing, and acceptance by the County Council.
I further understand the tree must not be substantially damaged, removed or destroyed, and
that any such violation shall be fined not more than $1,000 per tree or incident, per Section 14-63
of the Hawaii County Code.
I understand that the County of Hawai i assumes no liability with reference to this tree and
will not be responsible for its care and maintenance. However, if I need advice regarding the
preservation and enhancement ofthe Exceptional Tree, I may contact the Arborist Advisory
Committee, per Section 15-59(b) of the Hawaii County Code.

maintenance of an Exceptional Tree, as set forth in Section 235-]9 of the Hawaii Revised Statutes

RE: Communication No. 540, Bill 134: An Ordinance Amending Chapter 14, Article 10, of
the Hawaii County Code 1983 (2005 Edition), Relating to Exceptional Trees
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Planning to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter placed onto the next Council agenda for review. However, in the event this request is
denied, for whatever reason, I understand the matter shall be referred to the Committee on
Planning for placement on its future agenda.
