HomeMy WebLinkAboutORD 1991-140 1988-1992COUNTY OF HAWAII STATE OF HAWAII BILL NO. szo Draft 2) ORDINANCE NO. 91 140 AN ORDINANCE AMENDING CHAPTER 14, ARTICLE 10, OF THE HAWAII COUNTY CODE, AS AMENDED, RELATING TO EXCEPTIONAL TREES. BE IT ORDAINED BY THE COUNCIL OF HAWAII: SECTION 1. Findings and Purpose. The Council finds that many discrepencies in Section 14-65 of Article 10, Chapter 14, differ from the original ordinance which was adopted in 1983. By amending this section to add nine trees to the existing list of 17 exceptional trees and to add the tax map key or locations to some of the trees, the Council would like at the same time to clean up the ordinance. The Council feels that repealing this section and adding a new section in its correct form would simplify the process and lessen the confusion. The Council is aware of the controversy concerning the Wi tree on the Greenwell Ethnobotanical Garden site in Kona and feels that the Wi tree should also at this time be deleted from the Exceptional Tree List in Section 14-65. SECTION 2. Chapter 14, Article 10, Section 14-65, of the Hawaii County Code, 1983, relating to designated exceptional trees is repealed and a new Section 14-65 is added to Article 10, Chapter 14 of the Hawaii County Code (1983) to read as follows: SECTION 14-65. In printing this ordinance, all scientific names of the designated exceptional trees shall be printed in italics. SECTION 4. In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. 3- SECTION 5. This ordinance shall take effect upon its approval.
