HEARING TRANSCRIPT
FEBRUARY 6, 2020
A regularly advertised hearing on the application of VLADIMIR AND NADEZHDA ZOSIM
(SPP 19-000208) was called to order at 5:16 p.m. in the County of Hawaii Aupuni Center
Conference Room, 101 Pauahi Street, Hilo, Hawaii with Chairman Thomas Raffipiy presiding.
COMMISSIONERS PRESENT: Dean Au, Joseph Clarkson, Thomas Raffipiy, John Replogle.
ABSENT & EXCUSED: Gilbert Aguinaldo, Donn Dela Cruz.
ALSO PRESENT: Michael Yee (Planning Director), Malia Hall (Deputy Corporation Counsel
for the Windward Planning Commission), Jeff Darrow (Planning Program Manager), Maija
Jackson (Planner), Christian Kay (Planner), Jessica Andrews (Planner), and Sarah Hata-Finley
(Commission Secretary).
And 3 members from the public in attendance.
APPLICANT: VLADIMIR AND NADEZHDA ZOSIM (SPP 19-000208)
Application for a Special Permit to allow the construction and operation of an adult day care
facility on 1.001 acres of land in the State Land Use Agricultural District. The subject property is
located on Lotus Blossom Lane in Hawaiian Ocean View Estates, approximately 200 yards from
the intersection with Mamalahoa Highway, Ocean View, Ka`u, Hawaii, TMK: (3) 9-2-084:048.
RAFFIPIY: Okay, let's move on with the last item. But before we do that, I just wanna thank
everybody. Thank all the public, the owners, representatives, applicants that are here sitting
through this whole day. I know you folks probably from South Kona area, Ka`u. Thank you very
much for your patience. We really do appreciate it. It's been a long day and we realize that you
come from far, so thank you. We'll go ahead and move into the next one. Application for Special
Permit to allow the construction and operation of an adult, adult daycare facility on a 1.001 acre
of land in the State Land Use Agricultural District. And, go ahead and make the presentation
please.
ANDREWS: Yes, this is for Vladimir and Nadezhda Zosim, Special Permit 19-208, Special
Permit Application. Location is in Ka`u District. The subject property is here in red. This is
Mamalahoa Highway. It's on Lotus Blossom Lane. The Applicants are requesting a Special
Permit to allow construction and operation of an adult daycare facility for six seniors, to establish
a senior care facility to provide residential services for three seniors. The senior care facility
does not require a Special Permit since it is a permitted use for up to eight people, plus staff. The
owners who will reside on nearby parcel will manage the adult daycare and senior care facility,
and plan to employ three to four full-time caregivers from the local community.

Zoning map shows that the property outlined in red there is A-1 a, one acre. Across the highway
is A -3a, and commercial zoning here. The State Land Use boundary, State Land Use shows that
it's Agricultural and there's two Urban sites nearby. The LUPAG map shows that it's Rural.
There's Urban Expansion and Extensive Agricultural across the highway.
This is the Applicant's proposed site plan. You can see the, the proposed structure in the center
there, proposed parking, driveway, water catchment, the turn -around, and Lotus Blossom Lane
on the left. Aerial photographs show the proximity to the highway and to the existing
commercial retail spaces there. It's on Lotus Blossom Lane so the access drive would be right
from here. Property outlined in blue. This is the, the view of the subject property from Lotus
Blossom Lane, so that's the subject property looking up on the left and on the right, kind of an
alternate view. And, this is looking southeast on Lotus Blossom Lane looking northwest on
Lotus Blossom Lane. Planning Director's recommendation is approval with conditions.
RAFFIPIY: Thank you, Jessica. Do we have any questions from the Commission for the staff?
CLARKSON: I hate to ask this question in the interest of time, but I'm just curious. Quickly,
why a residential senior care facility does not require any permit but having seniors during the
day does?
ANDREWS: So, the daycare is not a permitted use, and so that requires a Special Use Permit
whereas the other is a permitted use, as I said on the slide up to eight people, yeah.
RAFFIPIY: Thank you. Any other questions? Thank you, staff. Will the Applicant or
representative please come forward? Please raise your right hand. Do you swear or affirm to tell
the truth on this matter now before the Planning Commission?
MIKKELSON: I do.
RAFFIPIY: Thank you very much. You can go ahead ma'am. State your name, where you

MIKKELSON: My name is Lori Mikkelson. I live in Papa`aloa, Hawaii, and this is my friend
and client, Nadia, for simplicity, and she's been working with senior citizens for twenty years, so
that's the background, and her interests. I did work with the State to find out about the
permitting, and it's a dual permit. If, if they go on beyond the, in the future

MIKKELSON: Sorry. If they go on beyond the future, if they, if it becomes successful enough
that they need to add, then they will need to amend their Special Permit. Other than that, it's, its
right. So in, in Ocean View, there's a lot of people who work in Kona, and there's a lot of older
people that live down there, some with their families and some on their own, and they have no
place to go during the day. So, this offers an opportunity for somebody to have a safe spot to be.
And that's our story.
RAFFIPIY: Thank you. Go ahead ma'am.
N. ZOSIM: I'm Nadia and I just, in my previous life I have an adult family home with six that is
in two adult family home for twelve years in State of Washington, in Vancouver, Washington.
And here, I'm ten years working in a private caregiver and I see the needs especially in Ocean
View, where is a lot elder people and the need to place to be in. That's why we decide to turn
our property for daycare, and I hope it help the community and just—
RAFFIPIY: Thank you very much. Did you receive the Planning Director's Background and
Recommendation reports?
MIKKELSON: Yes.
RAFFIPIY: Do you agree with the Director's recommendation and its conditions for approval?
MIKKELSON: Yes, we do. Yes.
RAFFIPIY: Do you have any further comments about that?
MIKKELSON: Not me, thank you. Do you? [To Ms. Zosim who shook her head "no. ']
RAFFIPIY: Do we have any questions from the Commission for the Applicant? Thank you
very much. As far as public testimony, there is none. Sign off for public testimony so
CLARKSON: I move that public testimony be closed.
REPLOGLE: Second.
RAFFIPIY: Okay, it's moved and second that we close public testimony. All those in favor say
aye.
COMMISSIONERS: Aye.
RAFFIPIY: Nay? None. Thank you. Now I need a motion for action.
REPLOGLE: On the Applicant Vladimir and Nadezhda Zosim Special Permit 19-000208, I
move that the application for the Special Permit docket number be approved based on the
Planning Commission, Director's recommendation which shall be adopted.
