Shelly Ogata 1 133293 To Windward Planning Commissioners: Working from home and online learning have become more normalized during the COVID-19 pandemic. Unfortunately, it has also become apparent that many of us are at an extreme disadvantage caused by limited broadband internet access in our communities. I have become one of the disadvantaged. I live in a rural Puna community 13 miles outside of Hilo. I have limited high-speed internet access because I have only one satellite provider option and service is very expensive. Even though I could afford to pay for more service, the speed and bandwidth are limited so I have difficulty with any kind of video streaming. In addition, I only have one bar of service on my cellphone while I am in my home. As a population of minorities, we should be cognizant of a system of discrimination against us. We all know about where we stand with the social determinants of health and the multitude of negative consequences. Here is a blatant example of systemic discrimination where I am not allowed to have equal access to not only healthcare (tele-health), but also education, and resources in general (including the ability to work from home). Please reconsider how you are perpetuating these inequities, adding to our negative social determinants of health and, ultimately, discriminating against our minority populations by not allowing us to have equal access to reliable broadband Internet and cellphone coverage. Ellwood PO Box 57 Keaau, HI 96749 I'm writing to oppose the application for the monopole and facility. I have submitted two other written statements at the prior hearings which I hope you have carefully evaluated. As HUD defines cell towers as hazards, we are concerned about having one in our neighborhood. During this current housing shortage, we fear that all private development will stop in our neighborhood. Home values will drop. Will HUD allow any more Section 8 housing in our area? We are also shocked and appalled that this would be proposed next door to Hawaii's newest premiere school in the Kamehameha system.Are we willing to put generations of hawaiians at risk? Will the school be degraded, compromised and become undesirable? Clearly this mega pole is not a necessity, as other services already exist. And clearly this is not the only option for the location, as we were easily able to find other locations available. New information about the road that surrounds the camp. On or about 2000 a six 6 inch water line was installed by the county under the road. County regulation dictates that this road should have been paved and ownership should have been taken by the county. I believe this is outside all other protocol practiced by the county. WHY? Will you allow the massive construction and maintenance traffic to travel over our unprotected waterline? Who owns the road ? Currently Three 3 owners are listed on the website. But only TWO 2 are on the application. The third owner has not give permission to use her property.According to all real estate experts I have consulted, third party easements cannot be granted without consent of all owners. Can the planning department accept an application for the use of someones property without their permission? And , does the planning department accept applications involving properties with no permit illegal housing? Mr. Eddie Clark ALSO makes claim to ownership of the road. His purchase of the adjacent land in 2016 was offered including ownership of the road.At the closing ,he was the victim of a bait and switch scam, where the road was not included in the deal. This case is under the board of realtors review and a law suit is pending. Every home, in and surrounding the camp, has a legal prescriptive easement to this road. Why is the road important? It is the only way in or out. Water and power are on this narrow one lane road. No storm water drainage system exists in the camp or the road. ANY altercation to the road will back up water into the camp causing flooding to the 47 home lots in the camp. The proposed use of the road would be at the in the worst possible part of the road. The proposed mega tower would stand directly in the low spot where rains drain over the road from the camp forming a lake. WILL THIS FLOOD THE CAMP? Big business from out of town is behind this effort to profit from the degradation of our neighborhood. With no regard for local situation, the peoples welfare is ignored. Rules and regulation have not been complied with to date. Some home owners still have not been notified. The land is zoned for agriculture. All of the surrounding property owners were fully aware of this when they purchased their property, including the applicant. We respect the rights to land use, BUT this must be within the zoning, in order to respect the rights of others. The application is for Variance from zoning that is CLEARLY dominate in our area. This outrageous request for change brings all of the bad elements of industry into our neighborhood that many of us moved here to avoid. A 20 STORY STRUCTURE HAS NO PLACE IN THIS AREA, AND WILL CHANGE OUR NEIGHBORHOOD FOR THE WORSE FOREVER. The protection of zoning will be violated. The health of our crops and animals are at risk. With so many differing opinions on the effects of the cell towers, Why take chances with our lives? Options for other locations abound, yet are not explored. Although the FCC says health issues may not be considered, but this should be your main concern. If it is not you should resign today. Ask yourself why so much negative information is out there about cell towers?To simply accept a mandated premiss of safety is absurd, In Hawaii ,we put people first. People, ALL PEOPLE, must be first. In todays atmosphere people are upset that government is not listening to them, but instead favors big business profits. Do not let this happen in our HAWAII.
