The Planning Commission at its duly hold public hearing on
February 12, 1989, anted to approve your application, Use Permit
No. 66, to alloy tate estz!liMent of a medical office on 15,161
square feet of lana within the .Single Fancily Residential WS -10)
zoned district at uolualoa, North Kona, Hawaii.
Approval_ of t°t in request is subject to the followinq
conditions:
1. The applicant shall comply with all of the stated
conditions of approval.
2. Final Plan Approval shall he secured from the Planning
Department within one year from the effective gate of
this permit. To assure adequate tine for plan approval
review and in accordance with Chapter 25-2.44 (Zoning
Code), plane shall he submitted a minimum of forty-five �
days prior to the date by which plan approval must be �
secured. plans shall identify detailed landscaping,
driveway, and parking. The landscaping Mian shall
include landscaping buffers in the form of trees and
shrubbery within the perimeter of the property lines.
Parking shall comply with the requirement09' Chapter 25
(Zoning Code). No parking variance from the Code shall
he applied for or granted.

3. Construction shall commence within one year from the
date of receipt of Final elan Approval and be completed
within two years thereafter.

4. The Wical office shall he restricted to a maximum of
two Physicians and their staff.
5. The hours of operation shall by limited to between
8:00 O.W. to 5:00 P.M. fromMonday through Friday and
between 8:00 a.m. to 1:00 P.M. on Saturday. his
provision shall not prohibit after hours meAcal service
in the CaSe of CMergenCy.

cOmPlied with. This condition shall remain in effect
until all of the conditions of approval have been
complied and the Planning Director acknowledgea: that
further reports are not required.

Director upon the following circumstances: a) the
non-performance is the result of conditions that could
not have been foreseen or are beyond the control of the
applicant, successors or aSSigDS, and that are not the
result of their fault or negligence; 0) granting of the
time extension would not be contrary to the general plan
or zoning code; W granting of the time extension would
not be contrary to the original reasons for the granting
of the permit; and A the time extension granted shall
be for a peri& not to exceed the period originally
granted for performance (i.e., a condition to be
performed within one year may be extended for up to one
aOditional year). Further, should any of the conditions
not be met or substantially complied with in a timely
fashion, the Director may initiate procedures to nullify
the permit.
