AGENDA
NOTICE IS HEREBY GIVEN of the following matters to be considered by the Windward
Planning Commission of the County of Hawai‘i in accordance with the provisions of Chapters 91
and 92, Hawai‘i Revised Statutes, Section 6-7.5(a) of the Charter of the County of Hawai‘i, and
the Planning Commission’s Rules of Practice and Procedure.
Based on the Governor’s Thirteenth Proclamation Related to the COVID-19 Emergency dated
September 22, 2020, this meeting will be online until further notice. This is to pre vent the spread
of COVID-19 and to maintain physical distancing.
DATE: Thurs day, November 5, 2020
TIME: 9:00 a.m.
PLACE: This meeting will be held by interactive video conference through
WebEx. The public may provide oral testimony at the meeting by
joining online or calling into the WebEx meeting. To register for

1. APPLICANT: MOANIALA HOLDINGS, LLC (AMEND REZ 738)
Application to delete Condition E of Ordinance No. 15 50, which required the applicant
to secure and dedicate land area for the future extension of Kū kū au Street from the
Sunrise Estates Subdivision to the Puainako Street Extension. Ordinance No. 15 50
amended Ordinan ce No. 08 115, which amended Ordinanc e No. 93 36, which rezoned
lands from Agricultural-20 acres (A-20a), Agricultural-10 acres (A-10a), and
Agricultural-3 acr es (A-3a) to a Residential and Agricultural-1 acre (RA-1a) zoning
district. Th e subject property is located south of the Puainako Street Extension, west of

Komohana Street at Hilo Hillside Estates Subdivision at Kū kū au 1, South Hilo, Ha waiʻ i,
TMK: 2-4-082:001-056, 058-061 (formerly 2-4-008: portions of 014 and 026).
2. APPLICANT: IKAIKA OHANA (FORMERLY GIAMPAOLO “PAUL”
BOSCHETTI) (AMEND REZ 2009-000103)
Application for a five (5)-year time extension to complete construction and deletion of
additional parking requirements in Condition E (Time to Complete Construction), a one
(1) year time extension to Condition G (Time to Dedicate Road Widening Strip), deletion
of Condition J (Requirement to Install Streetlights and Traffic Control Devices), deletion
of Condition P (Fair Share Requirements), and deletion of Condition R (Impact Fees) of
Ordinance No. 10 32, which reclassified 5.05 acres of land from a Single-Family
Residential – 7,500 square feet (RS-7.5) and Multiple-Family Resi dential – 1,000 square
feet (RM-1) to a Multiple-Family Residential – 1,500 square feet (RM-1.5) zoned
district. The subject properties are located south of Kūkūau Street, on the west side
(mauka) of Kapi‘olani Street above the County Polic e Department Headquarters building,
Kūkūau 1st, South Hilo, Hawai‘i, TMK: 2-4-025:048, 053, and 080.

3. INITIATOR: PLANNING DIRECTOR
An ordinance amending Chapter 25 (Zoning Code), Article 2, Division 6 of the Hawaiʻ i
County Code 1983 (2016 Edi tion, as amended), to update the time and revocation
requirements for the Windward Planning Commission a nd Leeward Planning
Commission to act on and revoke a Use Permit to be consistent with the Planning
Commission Rules of Practice and Proc edure.
4. INITIATOR: PLANNING DIRECTOR
An ordinance amending Chapter 25 (Zoning Code), Article 1, Article 2, Article 4, Article
5 and Article 7 of the Hawaiʻ i County Code 1983 (2016 Edition, as amended), relating to
definitions, use permit requirements, off-street parking requirements, and zoning district
regulations for medical clinics and massage, acupuncture, chiropractic and other similar
health service f acilities.

Consideration and Adoptio n of Amended Findings of Fact, Conclusions of Law and
Decision and Order for approval of a Use Permit to allow the construction of a non-
manned telecommunication facility cons isting of a 105-foot tall monopine with related
equipment within a 1,054-square fe et portion of a 20-acre property situated in the
County’s Open zoning district. The subject propert y is located northeast of the Mak uʻu
Drive-17th Avenue intersection in the Hawaiian Paradi se Park Subdivision, Kea‘au,
Puna, Hawai‘i, TMK: (3) 1-5-023:040.

Submitting Written Testimony: According to Rule 1 (General Rules) of th e Planning
Commission, a per so n desiring to submit written testimony shall indicate her/his name; address;
and whether the testimony is on her/his behalf or as a represe ntative of an organization or
individual. If testimony is being submitted on beha lf of an organization, documentati on showing
membership ratification s hould accompany the testimony. Public testimony can be subm itted by
mail or email. Those submitting written testimony by mail should provide fifteen (15) copies for
distribution. Publi c testimony submitte d by mail, sh ould be mailed to the Windward Planning
Commission at the Planning Department office addresses i n Hilo and Kona listed below. Mailed
testimony should be provided at least one week prior to the hearing date to allow for mai ling and
thorough Commission revi ew. Public testimony that is submitted by email to
planning@hawaiicounty.gov, should be submitted before 4:30 p.m. two business days (excluding
holidays) prior to the Commission meeting. Testimony that is irrelevant or undu ly repetitious
may be limited by the Chairperson purs uant to Rul e 1.
Notice to Lobbyists: If you are a lobbyist, you must register with the Hawai‘i County
Clerk within five days of becoming a lobbyist {Article 15, Section 2-91.3(b), Hawai‘i County
Code}. A lobbyist means “any individu al engaged for pay or other consideration who spends
more than five hours in any month or $275 in any six-month period for the purpose of attempting
to influence legislative or administrative action by communicating or urgi ng ot hers to
communicate with public officials.” {Art icle 15, Se ction 2-91.3(a)(6), Hawai‘i County Code}
