HomeMy WebLinkAbout2020-09-08 BOR MinutesTAX BOARD OF REVIEW MEETING MINUTES Appeal Hearings Tuesday, September 8, 2020 Aupuni Center Conference Room 101 Pauahi St., Hilo, Hawaii CALL TO ORDER Chairperson Michael Hughes called the meeting to order at 9:00 a.m. Present were: Board Members Michael Hughes, Grace Reinhard, Michael Okumoto and Nelson Harano; Deputy Corporation Counsel J Yoshimoto; Real Property Tax Asst. Administrator Keita Jo, Real Property Appraisal Supervisor Dionne Costa and Real Property Appeals Board Clerk Sherlyn Aronce. STATEMENTS FROM THE PUBLIC There were no statements from the public. TAX APPEAL CASE HEARINGS Note: Prior to the start of the case hearings, Deputy Corporation Counsel J. Yoshimoto announced the general procedures of the appeal hearing and advised all Appellants and the Department of the procedure the Board would be following for the rendering of their decision and the Appellants' further right to appeal to the Tax Appeal Court located in Honolulu within 30 days from the date of the decision letter that the appellant will be receiving via certified mail. For each appeal case, the appraiser submitted a packet of information to the Board, unless there had been a prior settlement with the Appellant or withdrawal. If the Appellant was not present, any information sent in by the Appellant was presented to the Board along with the appraisers' packet. Mr. Yoshimoto read an email from board member, Diane Blancett-Maddock explaining the reason of her absence from today and tomorrow's scheduled appeal hearings. APPROVAL OF MEETING MINUTES The minutes of the appeal hearings on July 7, 8, 14, and 15, 2020 were provided to the Board for approval. No corrections were noted. A call for questions was made. Ms. Reinhard moved to approve all the minutes provided for review. Seconded by Mr. Okumoto. A call for questions was made. Motion passes by a vote of 4:0. CASE #39085 — CERMELJ, ALOHALANI HOPE TM K 1-2-028-066-0000 Present was appellant, Alohalani Cermelj. Present for the County was Appraisal Supervisor, Dionne Costa. County informed the Board the absence of a signed authorization from the property owner designating the appellant as an authorized representative for the property in question. The appellant was aware and fully understood that the Board would hear her case however would not be able to render a decision given that she is not the property owner or authorized representative. Property is located in the Pacific Paradise Oceanfront Estate Subdivision located in Kalapana. The land value is under appeal. Appellant presented their case. Ms. Reinhard moved to dismiss this case. Seconded by Mr. Okumoto. Motion passed by a vote of 4:0. Mr. Yoshimoto informed the Board that dismissed cases acts in favor of the County. WITHDRAWN CASES County presented to the Board appellants' requests to withdraw their appeals for the following cases: CASE NO. TAX MAP KEY APPELLANT 39554 2-4-077-020-0000 HARADA, PERRY HARUO 39494 2-7-011-004-0000 OFFICE OF THE MASTER VISIONERY A call for questions was made. Mr. Okumoto moved to accept the withdrawal. Seconded by Ms. Reinhard. A call for discussion was made. Motion passed by a vote of 4:0. SETTLEMENTS — 9:00 AM APPEALS AGENDA County presented to the Board a 4 -page Appeals Agenda containing information on 18 cases that had reached settlement agreements (copies provided to the Board) between the County and the respective appellants. A copy of the agenda is attached hereto as Exhibit A. Mr. Okumoto questioned the building value for Case No. 39225. Appraisal Supervisor, Dionne Costa responded for the county. Mr. Okumoto questioned the building value for Case No. 39312. Appraisal Supervisor, Dionne Costa responded for the county. Mr. Okumoto questioned the land and building values for Case No. 39861. Appraisal Supervisor, Dionne Costa responded for the county. Ms. Reinhard questioned the building status for Case No. 39861. County appraiser, Sally Kaaiakamanu responded. Mr. Hughes questioned the building value for Case No. 39551. County appraiser Shannon Arquitola responded. Mr. Okumoto questioned the building and land values for Case No. 39558. County appraiser, Brett Hosaka responded. Mr. Okumoto questioned the building value for Case No. 39411. County appraiser, Kaleb Meno responded. A call for questions was made. Ms. Reinhard moved to accept the settlements as presented. Seconded by Mr. Okumoto. A call for discussion was made. Motion passed by a vote of 4:0. Recessed: 9:37 a.m. Reconvened: 1:30 p.m. Deputy Corporation Counsel J. Property is located in the Green Sands neighborhood, near Na'alehu Town. The land and building values are under appeal Appellant presented their case. County presented their case and recommended sustaining both the land and building values based on the comparable sales. Mr. Okumoto moved to sustain the County's recommendation for land and home value based on already receiving a discount and its comparable sales. Seconded by Ms. Reinhard. A call for discussion was made. Motion passed by a vote of 4:0. CASE #39512, #395139 #395149 #395159 #39516 — HA H N E, CLARK H TM K 9-4-016-044-00009 9-4-016-064-00009 9-4-018-040-0009 9-4-020-031-00009 9-4-023-055-0000 Appellant was not present. Present for the County was appraiser, Kaleb Meno. Property is located in the Discovery Harbour neighborhood. Appeal is on land value. County presented their case together with any and all information provided by the appellant. County recommended sustaining the land value for all five (5) parcels. A call for questions was made. County appraiser Matthew Radmilovic responded. Ms. Reinhard questioned the land and location for Case No. 39235 and 39236. County appraiser Matthew Radmilovic responded.
