MINUTES
OCTOBER 1, 2020
The Windward Planning Commission met in a regular session via live stream at 9:01 a.m., with
Chair Thomas Raffipiy presiding. Based on the Governor's Tenth Proclamation Related to the
COVID-19 regarding the COVID-19 Emergency, this meeting was held online, with live-
streaming for the public to observe the meeting.
VIRTUAL ATTENDANCE(COMMISSIONERS): Gilbert Aguinaldo, Dean Au, Joseph
Clarkson, Thomas Raffipiy, John Replogle.
VIRTUAL ATTENDANCE(STAFF) : Michael Yee (Planning Director), J. Yoshimoto
(Deputy Corporation Counsel for the Windward Planning Commission), John Mukai (Deputy
Corporation Counsel for the Planning Department), Jeff Darrow (Program Manager), Maija
Jackson (Planner), Tracie-Lee Camero (Planner), Rachelle Ley (Department Secretary), and
Melissa Dacayanan-Salvador (Temporary Assigned Commission Secretary).

A quorum was present. Chair Raffipy called the meeting to order. He explained the procedure
and the protocol at this online meeting, including live public testimony. He introduced the
Commissioners and staff who were in virtual attendance.
1. INITIATOR: PLANNING DIRECTOR
An ordinance amending Chapter 25 (Zoning Code), Article 2, Division 6 of the Hawaii County
Code 1983 (2016 Edition, as amended), to update the time and revocation requirements for the
Windward Planning Commission and Leeward Planning Commission to act on and revoke a Use
Permit to be consistent with the Planning Commission Rules of Practice and Procedure,
The Commission took this item up at 9:06 a.m. with approximately 18 members of the public
live streaming the meeting.
An oral testimony was given by Cory Harden. This item had been continued to the November
meeting at the request of the Planning Department.

2. INITIATOR: PLANNING DIRECTOR
An ordinance amending Chapter 25 (Zoning Code), Article 1, Article 2, Article 5 and
Article 7 of the Hawaii County Code 1983 (2016 Edition, as amended), relating to

definitions, use permit requirements, and zoning district regulations for medical clinics
and massage, acupuncture, chiropractic and other small-scale health service facilities.
This item had been continued to the November meeting at the request of the Planning
Department.
Chair Raffipiy called for a break at 9:10 a.m., and the meeting was reconvened at 9:33 a.m.
3. APPLICANT: NEW LINGULAR WIRELESS PCS, LLC DBA AT&T
MOBILITY (USE 19-000082)
Federal Court Remand to the Windward Planning Commission for further consideration
and action on Use Permit Application 19-000082 to allow the construction of a
non-manned telecommunication facility consisting of a 105-foot tall monopine with
related equipment within a 1,054 square feet portion of a 20-acre property situated in the
County's Open zoning district. The subject property is located northeast of the Maku`u
Drive— 17th Avenue intersection in the Hawaiian Paradise Park subdivision, Kea`au,
Puna, Hawaii, TMK: (3) 1-5-023:040. Remanded by Stipulation and Order Staying
Action to Allow Further Consideration by the Windward Planning Commission, County
of Hawaii.
Chair Raffipiy stated prior to the presentation of this agenda item, oral public testimony will be
conducted with nine (9)people had registered to testify in person. It was moved by
Commissioner Au and seconded by Commissioner Aguinaldo to close public hearing. A voice
vote was taken, and the motion carried with all in favor. At 10:12 a.m. public testimony was
closed.

Action: It was moved by Commission Replogle and seconded by Commission Clarkson that the
USE 19-000082) be approved as recommended by the Planning Director with a revision of the
location of the tower about 10-13 feet to the northeast of the original location shall be adopted. A
roll call vote was taken, and the motion carried with five ayes (Aguinaldo, Au, Clarkson,
Raffipiy, Replogle) and no noes.
This item ended at 10:58 a.m.
MINUTES —The Commission took this item up at 10:59 a.m.
Approval of Minutes of the August 12, 2020 Meeting_—It was moved by Commissioner Au and
seconded by Commissioner Aguinaldo, that the Minutes of August 12, 2020, be approved as
circulated. Motion was unanimously carried by a voice vote of all Commissioners in attendance.

ANNOUNCEMENTS —None
Commissioner Au inquired on an update on the General Plan. Planning Director Michael Yee
indicated hoping for draft out at the end of the year but most likely at the first part of next year.
Commissioner Au also indicated for the past couple meetings haven't received the SMA Report
which he feels as a Commissioner it is very helpful and to see what is going on and would like to
continue to receive those reports prior again. Director Yee indicated will try to get the report
back out as it is just part of the chaos focusing on making the meetings happen,juggling different
priorities as they have changed but the intention is certainly to get it back to them. There were
no questions on the SMA Report from the Commission.
ADJOURNMENT—There being no further business, it was moved by Commissioner Au and
seconded by Commissioner Clarkson that the meeting be adjourned. Motion was unanimously
carried by a voice vote of all Commissioners in attendance. Chairman Raffipiy adjourned the
meeting at 11:02 a.m.
