HomeMy WebLinkAbout2021-01-07 Windward Planning Commission Minutes WINDWARD PLANNING COMMISSION COUNTY OF HAWAII MINUTES JANUARY 7, 2021 The Windward Planning Commission met via live stream meeting at 9:05 a.m., with Chairman John Replogle presiding. VIRTUAL ATTENDANCE(COMMISSIONERS): Dean Au, Joseph Clarkson, Thomas Raffipiy, John Replogle, Gilbert Aguinaldo VIRTUAL ATTENDANCE(STAFF): Jeff Darrow (Deputy Planning Director), Malia Hall (Deputy Corporation Counsel for the Windward Planning Commission), John Mukai (Deputy Corporation Counsel for the Planning Department), Maija Jackson (Temporary Assignment Program Manager), Alex Roy (Planner), Tracie-Lee Camero (Planner), Rachelle Ley (Department Secretary), and Melissa Dacayanan-Salvador (Commission Secretary). Secretary's Notes: Throughout the meeting, there were some technical and/or internet difficulties which made the speaker inaudible. Please note that the notation "—"in these Minutes and the Exhibit Transcripts means that there were technical and/or internet difficulties which made the conversation inaudible. A quorum was present. Chairman Replogle stated that due to the Governor's Proclamation regarding COVID-19, the Commission meetings would be online until further notice to prevent the spread of COVID -19 and to maintain social distancing. He explained that the public was able to view and listen to the meeting, and a video link was available on the Planning Department website, www...lal i, g p awai:icou y..gov. He stated the background and recommendation reports are available on the County website. Chairman Replogle said that public was able to provide oral testimony at the meeting by joining online or calling into the WebEx meeting. Chairman Replogle asked the Commissioners to speak one at a time. He then introduced the Commissioners and staff who were in virtual attendance. STATEMENTS FROM THE PUBLIC At 9:10 a.m. the Commission took up statements from the public. There were four testifiers for Agenda Items 3, AT&T MOBILITY (USE 20-000084) and testimony ended at 9:40 a.m. [SEE HEARING TRANSCRIPT EXHIBIT AJ It was moved by Commissioner Au and seconded by Commissioner Raffipiy that public testimony be closed. APPLICANT: COUNTY OF HAWAII DEPARTMENT OF PARKS AND RECREATION (SMA 20-000077) Application for a Special Management Use Permit to conduct facilities upgrades and Americans with Disabilities Act(ADA) improvements at Kolekole Gulch Park on 5.5 acres of land situated within the Special Management Area. The subject property is located at the Kolekole Gulch Park, makai of Old Mamalahoa Highway and underneath and mauka of Hawaii Belt Road, South Hilo, Hawaii, TMK: (3) 2-8-015:015. The Commission took this item up at 9:40 a.m. Action: It was moved by Commissioner Au and seconded by Commissioner Raffipiy that the Special Management Area Use Permit application for County of Hawaii Department of Parks and Recreation, SMA 20-000077 be approved based on the Planning Director's recommendation with amendments, which shall be adopted. A roll call vote was taken, and the motion carried with five ayes (Replogle, Aguinaldo, Au, Clarkson, Raffipiy) and no noes. APPLICANT: KIRPAL MEDITATION AND ECOLOGICAL CENTER, LLC (SPP 20-000220) Application for a Special Permit to legitimize the operation of a meditation and ecological center and retreat on 10 acres of land situated within the State Land Use Agricultural District. The subject property is located at 13-260 Pohoiki Road, approximately 0.5 miles west, or mauka, of the intersection with Kalapana-Kapoho Beach Road, Pohoiki, Puna, Hawaii, TMK: (3) 1-3-008:005. The Commission took this item up at 10:22 a.m. Chairman Replogle stated this item was continued at the Applicant's request. 3. APPLICANT: AT&T MOBILITY (USE 20-000084) Application for a Use Permit to allow the construction a non-manned telecommunication facility consisting of a 100-foot tall monopole with related equipment within a 1,050- square foot portion of a 441-acre property situated in the County's Agricultural zoning district. The subject property is located at 13-3820 Pahoa-Kalapana Road (Highway 130) northwest(mauka) of the highway about 0.28 miles north of its intersection with Kam5'ili Road, Kam5'ili, Puna, Hawaii, TMK: (3) 1-3-001: portion of 007. The Commission took this item up at 10:22 a.m. Chairman Replogle called a recess at 10:25 a.m., and the meeting was reconvened at 10:38 a.m. Action: It was moved by Commissioner Clarkson and seconded by Commissioner Raffipiy that the Use Permit application for AT & T Mobility, USE 20-000084, be approved based on the Page 2 of 4 Windward Planning Commission January 7,2021 Minutes Planning Director's recommendation with amendments, which shall be adopted. This hearing item ended at 11:57 a.m. [SEE HEARING TRANSCRIPT- EXHIBIT Q MINUTES Approval of Minutes of the December 3, 2020 Windward Planning Commission meeting At 11;57 a.m. it was moved by Commissioner Au and seconded by Commissioner Aguinaldo that the Minutes of December 3, 2020, be approved as submitted. A voice vote was taken, and the motion carried with all in favor. ADMINISTRATIVE MATTERS 1. Discussion of recent Special Management Area(SMA) determinations, minor permits and enforcement action issued by the Planning Director. The Commission took this item up at 11:58 a.m. Ms. Jackson said the first item for administrative matters is the Special Management Area (SMA) log which was provided via email and there was no discussion or questions on the recent SMA log. This hearing item ended at 11:59 a.m. 2. Discussion of creation of a new Planning Commission rule of practice and procedure related to procedures for recusal of a Commissioner. Discussion of amending the County Code to add a clause to allow for consideration of the passage of time and change in conditions when considering whether a permit should be extended. The Commission took this item up at 12:17 p.m. This hearing item ended at 12:33 p.m. [SEE HEARING TRANSCRIPT- EXHIBIT EJ ANNOUNCEMENTS Ms. Jackson made an announcement there are two (2)potential new Commissioners that may come on board the Mayor just submitted a nomination for Michelle Galimba. A brief Page 3 of 4 Windward Planning Commission January 7,2021 Minutes background and experience were shared. She's been a resident of Hawaii for 45 years, lives in the Ka`u District, has experience ranching and is currently active on the Big Island Resource Conservation and Development Council, USDA Farm Service Agency Committee and Advisory Council . She previously held positions on the Ka`u CDP Steering Committee, the Charter Commission and the Hawaii State Board of Agriculture. There is no date for her confirmation at Council, but the Mayor just submitted her name to Council at the beginning of the year. She also mentioned the second nominee is Dennis Lin and he resides in the South Hilo District and grew up in South Hilo. He serves on multiple Boards and is a member of the Chamber of Commerce, a graduate of Waiakea High School and UH-Hilo. His experiences range from Office Management, Legal Assistant, Commercial Banking Analyst, Commercial Banking Officer, and currently employed by HPM Building Supply as the Program Manager for the Hale Plus Dynamic Home System. If both individuals are confirmed she mentioned there will be a full Commission. ADJOURNMENT There being no further business, it was moved by Commissioner Aguinaldo and seconded by Commissioner Au that the meeting be adjourned. The motion was unanimously carried by a voice vote of all Commissioners in attendance.
