Permit Transfer Guidelines
Purpose: Following the issuance of a permit, a homeowner may either cease to employ the owner-
builder exemption and engage a contractor for the balance of the work, or there is a change in the
designation of any contractor for any phase of work, the permit holder shall file a written request to the
authority having jurisdiction for approval of these changes.The request shall include:the change in
designation; a revised declaration form for each contractor or subcontractor engaged to do electrical or
plumbing work upon the building, structure, or project; and a non-refundable fee of$100.

Scope:This procedure applies to all permit transfers including Owner-builder, building, plumbing and
electrical contractors, and change of ownership. See below for change of design professional.
g Do I Need to Transfer a Permit?
A: 1) Should an owner wish to change from the declared "Owner-Builder" exemption
of the Hawaii Contractor statute, then this form must be completed and approved prior
to completion of the project.
2) Occasionally the contractor or subcontractor(plumbing, electrical) will need to
be changed or updated so a transfer is required to do so.
3) Should ownership of a property occur with an open building permit, it is required
that the new owner transfer the permit to their name to continue the work. If work had
not begun from 180 days off the permit issued date, the transfer would be denied and
permit voided.
g Can I transfer a permit?
A: Only the property owner may transfer permits.
g Who can transfer a permit?
A: Only the property owner may transfer permits. Owner-Builder and Contractor transfers
also require the signed acknowledgement of the Hawaii licensed design professional.

g How much does it cost to transfer a permit?
A: Each transfer application must be accompanied with cash or a check for One Hundred
Dollars ($100.00) made to the "County Director of Finance" at the Building Division
office prior to 3:00 pm.
g What is the process to change or replace the architect or engineer of record?
A: Should the Owner need or wish to change or replace the architect or engineer(A/E) of
record the Permit Transfer form is not required but a letter from the owner to the
Director of Public Works would be provided with the Tax Map Key, Permit number, and
change of A/E. The new A/E would sign and acknowledge or provide a separate letter
indicating his/her scope of work. This may be for changes/revisions or"construction
observation" as required by State Statute 464. All documents prepared by the A/E must
have the license holder's stamp and "wet" signature.
The ownership of a property must be the same as listed on the Hawaii County Real
Property website, corporation authority, deed, short form, trust, LLC or partnership
documents provided for authorization of the signature. Often a notary is required to
verify the signer has authority to sign in behalf of the above if not clearly noted in
supporting documents.
