PURPOSE AND AUTHORITY 1.1.The purpose of these regulations is to establish a fair and uniform method of assigning parking at the County Building, Aupuni Center, and other county facilities, to maximize efficient utilization of available parking stalls in accordance with the provisions of Chapter 24 of the Hawai'i County Code. 1.2. Pursuant to the provisions of Chapter 24, Division 5, of the Hawai'i County Code, the Director of Public Works shall assign and reassign parking stalls and be responsible for regulating parking at the County building and other county facilities. 2. DEFINITIONS "Accommodation Resource Manager" (ARM) means the departmental designate who provides assistance, information, and support to decision makers and employees regarding reasonable accommodation, including processing requests for additional medical information when needed. "Applicant" means an eligible employee or servicing agent who applies for parking in the manner prescribed by the provisions of these regulations. "County" means the County of Hawai'i. "Council member" means an elected person from one of the nine council districts who has legislative authority in the county government. "County vehicle parking" means a designated area for county owned vehicles to park. County owned vehicles shall park only in such designated area. If the facility does not have such a parking area, county vehicles may then park in the public parking area. "Electric Vehicle" (EV) means all-electric vehicles that burn almost zero petroleum. "Eligible employee" means an officer or employee of the county government who is employed on a full-time basis in one of the facilities identified in these regulations where parking is applied for. 3of16 "Government agency" means a county department or agency, and any of the boards, or commissions of such department/agency. "Individual with a disability who is qualified" means an individual with an impairment that substantially limits a major life activity related to mobility who either possesses a valid disability parking permit and identification card issued to the individual or is an employee who can justify a need for a reasonable accommodation with respect to parking as provided in the Procedures for Providing Reasonable Accommodation to Individuals with Disabilities. "Mayoral appointee" means an individual appointed by the Mayor to a position in a government agency. "Metered stall" means a public parking stall regulated by a parking meter with fees as determined by the Finance Director. See Schedule A for the rate schedule. "Motor vehicle" means a mode of transportation that shall include but not be limited to automobiles, trucks, vans, and motorcycles. "Multi-function program manager" means a division head in a government agency: a) who manages more than one (1) program function and has supervisory responsibilities over three or more employees; b) manages a program function that affects all government agencies; or c) is rated EM-05 or higher. "Parking control officer" means the employee(s) or independent contractor designated by the Director of Public Works to enforce the provisions of these regulations. "Parking designations": a) "Designated parking" means a specifically marked parking space which is assigned to an eligible employee who is a department head, deputy department head, secretary to a department head, other mayoral appointee, or multi-function program manager. b) "Floating parking" means a specific area of the parking facility that is unassigned, but designated for use by an employee of a government agency. c) "Loading Zone parking" means an area of space in a parking facility that is used for a short period to park vehicles to load or unload, or for maintenance vehicles of the county. d) "Reserved parking" means a specifically marked parking space, which is assigned to an eligible employee. 4of16 "Parking facility" means a lot, garage, building, or structure, or combination or portion thereof, in which motor vehicles are temporarily parked. "Parking stall" means an area of space in a parking facility that is used for parking one motor vehicle at any time. "Permit" means a bumper decal, window decal or window placard. "Permittee" means a person who has been granted a permit pursuant to these regulations. "Public parking" means a short-term parking space in a parking facility that is used for the general public, including visitors to the government agency, servicing agents, or county employees whose work site is not within the facility. "Servicing agent" means an employee of a servicing agency or independent contractor or consultant contracted by the County to perform work or services for a government agency. "Short-term parking" means an area in a parking facility that is used for parking for a limited period of time, usually less than 2 hours. See Schedule A for time limits. "Unmetered stall" means a public parking stall without a fee and restricted with a designated time limit. 3. GENERAL PUBLIC PARKING 3.1. Metered stalls and other designated public parking stalls under the jurisdiction of the county are designed to meet the parking needs of: • The general public to conduct official business with a government agency; • Individuals attending special meetings, conferences, seminars, and/or training sessions held in a County of Hawaii facility; • Servicing agents, • County employees whose work site is not within the facility and are using personal vehicles; a) County employees from other facilities using personal vehicles are eligible to park only in spaces designated in a parking area with their appropriate permit. b) An employee who is not in the parking system without a permit and wishes to park their personal vehicle in public parking must pay for parking at the prevailing rate and/or observe the time limitation set for the parking (usual limit 2-hours). However, if visiting employee is using a county owned vehicle, parking shall be in the designated parking area for county owned vehicles. c) If the facility does not have such a parking area, only then public parking area may be used. • Individuals with authorized permits. 5of16 Schedule A Short—term parking2: 2-hour time limit— unmetered 2-hour time limit— metered twenty-five cents per half-hour* 8-hour time limit— metered stall twenty-five cents per two-hours* Hours of operation: Monday— Friday (excluding holidays) — 7:00 a.m. — 5:00 p.m. or as otherwise specified per facility East Hawaii 1. West Hawai'i Civic Center—2 hour time limit stalls *Subject to County Council Approval 2(Under HRS§291-55 and Section 24—244 of Chapter 24, Hawai'i County Code, Parking Privileges:A vehicle displaying special license plates, a removable windshield placard or a temporary removable windshield placard may park (1) Without payment of any parking meter fees in a public metered parking space reserved for persons with disabilities (2) Without payment of parking meter fees for the first two and a half hours or the maximum time the meter allows,whichever is longer, in a public metered parking space. 3.2. Unless otherwise specified, all visitors shall comply with the fees and/or time limits established for the individual parking facilities. 3.3. Accessible parking spaces have been identified and designated for individuals with disabilities who are qualified as stated in Section 24-244 of the Hawai'i County Code. The vehicle shall display the individual with disabilities' parking placard or special license plates. 6of16 4. CHARGING STATIONS FOR PLUG-IN ELECTRIC VEHICLES 4.1.The County of Hawaii has supported the development of electric vehicles and the stations required to re-charge their batteries. This is a program to promote the use of EVs, Plug-in EVs and using alternative energy. 4.2.Charging stations are available on a first-come, first-served basis. 4.3.Hours of Operation: 7:45 a.m. —4:30 p.m., Monday through Friday. 4.4. Upon completion of charge or at the County's request, a vehicle using the charging station must be moved out of the charging stall or as directed. 4.5.The use of County charging stations is at the users own risk. The County will not be liable for any theft, property damage, or injury arising from the use, misuse, or suspected misuse of County charging stations. 4.6. Violations will be addressed on a case by case basis. Continued abuse may lead to citations. 4.7.The procedures regarding access and use of the County parking lot for County employees remain unchanged. Employee's vehicle must be moved out of the charging stall as soon as charge is complete (refer to item 4.4 above). 4.8.Refer to this regulations booklet. EMPLOYEE PARKING 5.1.Application procedures 5.1.1. An eligible employee seeking a parking permit shall obtain an Application Form from the parking control officer or the Administration office of the Department of Public Works. Each applicant shall fully and accurately complete the form and shall provide all information requested by the county, including, but not limited to: 1. Name, telephone number, work place address, and government agency; 2. Registered owner(s) of motor vehicle(s); 3. Year, make and license number of primary motor vehicle, if applicable; 4. Year, make and license number of secondary motor vehicle, if applicable; 5. Facility working in; and 6. Type of parking requested. 5.1.2. Employees who are an individual with a disability who is qualified and wish to request accessible parking spaces shall submit their requests to their departments/agencies as outlined in Procedures for Providing Reasonable Accommodation, Requesting Accommodations, 3. Employees b. with Application Form. • The employee and his/her supervisor, manager or other employee responsible for deciding whether a request for accommodation is reasonable shall engage in the interactive process, as necessary, to determine the what type of parking space will best meet the employee's need. • The departmental Accommodation Resource Manager shall inform the Administration Office, Public Works Department of the employee's need for accessible parking and submit the completed Application Form. 8of16 5.1.3. In the event that the applicant or permittee has any change in any of the information required in Section 5.1.1, notification must be given to the parking control officer (via DPW Administration) by submitting a Notification of Change form. It is the applicant or permittee's responsibility to give immediate notification to avoid possible citation or vehicle removal as provided in the General Rules, Section 6 of these regulations. 5.1.4. Employees or permitees who are no longer in need of an accessible parking space shall notify their department's Accommodation Resource Manager who will inform the Administration Office. 5.1.5. In the event that there is no vacant stall available at the parking facility the eligible employee is working in, the eligible employee shall be placed on a waiting list for that facility. The list shall be maintained by the Administration of the Department of Public Works. The date the eligible employee is placed on the waiting list shall be indicated on the list itself. The list shall be maintained by chronological order, by the dates the eligible employees are placed on the list (earliest to latest). The employees who are waiting for a stall assignment may park on the street, or park at the Aupuni Center metered stalls and feed the meters (8 hour time limit fronting Kilauea Avenue). 5.2. Assignment of Parking 5.2.1. Specifically marked parking stalls may be assigned to vehicles or positions required to carry out an agencies' program functions. 5.2.2. Specifically marked parking stalls may be assigned to department heads, deputy department heads, secretaries to department heads, multi-functional program managers, and other mayoral appointees. 5.2.3. The Department of Public Works may designate specific stalls to be used for accessible parking or reserved for reasonable accommodation purposes. These stalls may be temporarily assigned to employees or individuals who do not require them as reasonable accommodations. In the event it is necessary to assign the stall for reasonable accommodation purposes, the employee will be assigned another parking stall. 5.2.4. A stall shall be assigned to an employee who works in the facility of the assigned stall. 9of16 5.2.5. If the permittee is absent from work (with or without pay) for a period of more than ninety (90) days, the stall assignment shall be forfeited and reassigned unless the Director is notified and a retention of the stall is granted in accordance with Section 5.2.6 below. Exceptions shall be considered and may be granted at the discretion of the Director of Public Works. 5.2.6. When a stall becomes vacant, the selection process for that vacancy shall be as follows: • Announcement of vacancy and request for applicants (eligible employees who currently have reserved stalls at the facility who wish to transfer to the vacant stall). • Eligible applicant with the greatest length of service in the facility shall be awarded the vacant stall. Should there be a tie for service date, then the tiebreaker will be the applicant with the greatest length of service in the county. (Thereafter, ties shall be broken by random draw.) • Process shall be repeated until no requests for transfer are received. • Remaining vacancy shall be assigned to the eligible employee at the top of the waiting list. 5.2.7. A permanent employee who accepts a temporary or appointed position and is entitled to a designated stall shall be allowed to retain his/her assigned stall for the duration of the appointment, but may have his/her assigned stall temporarily assigned to another employee at the discretion of the Director of Public Works. However, until the stall is temporarily assigned to another employee who will assume the monthly fee payments, payment of the monthly fees must continue to in order to retain the stall assignment. 5.2.8. An eligible employee who will be absent from his/her county position due to any leave beyond ninety (90) days or military leave (with or without pay) shall be allowed to retain his/her reserved stall for the duration of the leave but may have it temporarily assigned to another employee, at the discretion of the Director of Public Works. The eligible employee is responsible to notify the Administration of the Department of Public Works immediately in writing upon confirmation of the anticipated absence. If the absence is confirmed by means other than notification by the eligible employee, the forfeiture or assignment of the parking stall shall be left to the discretion of the Director of Public Works. 10 of 16 5.3. Parking Stall Fees 5.4.1. Fee rates are set by the Director of Finance. See Schedule B for the current rates. 5.4.2. Parking stall fees shall be payable in advance through payroll deduction. The Assignment of Salary form shall be signed during the initial application. Parking Permit Cards 5.5.1. Permittee shall place the parking permit card provided by the County of Hawaii on the rear view mirror of their vehicle. If there is no rear view mirror, the parking permit card shall be conspicuously displayed on the interior windshield or dashboard area. 5.5.2. Permittee is responsible for transferring this card from one registered vehicle to another that is listed on the parking Application Form. 5.5.3. During the normal working hours, a parking permit card issued for a specific assigned parking area cannot be used in another parking area while the permittee is on duty unless the vehicle is parking under a temporary permit authorization. 5.6. Temporary Parking Permits 5.6.1. A parking stall assignment is not transferable; however, the stall may be loaned by the permittee to another county employee during short periods of absences such as sick leave or vacation. The permittee is responsible for transferring the permit to the temporary permittee. 5.6.2. Whenever the permittee's vehicle is temporarily replaced by a service loaner or by another vehicle due to emergency conditions, the permittee is responsible for transferring the permit to the loaner or other vehicle. 5.6.3. If an employee sustain an injury or illness and needs an accessible space on a temporary basis, the employee should shall notify their department's Accommodation Resource Manager who will inform the Administration Office to arrange such temporary accommodations. 5.7. Termination of Parking Stall Assignment 5.7.1. To terminate a parking stall assignment, the permittee shall submit a Notice of Termination form at least two weeks prior to the termination date. The form is available at the Department of Public Works or your department representative. 12 of 16 5.7.2. Termination shall be effective only on the last day of each month. A termination request submitted after the due date shall forfeit any refund that may be due, except for clerical error, computer error or conditions beyond the control of the permittee. 5.7.3. All parking cards and permits must be turned in by the original permittee. The termination form must be submitted in advance, but the permit may be turned in on the last day of the month. A vehicle found parked with a cancelled and/or invalid parking permit card or permit shall be cited and/or towed away at the owner's expense. 6. GENERAL RULES 6.1. All official signs and pavement markings shall be observed. All signs and pavement markings posted on county lands designated to be under the jurisdiction of the county shall be official signs. 6.2. Parking shall be permitted only in areas marked and specified for parking. Every permittee shall display a valid parking decal, permit, or placard while occupying a stall in any parking area as regulated under these rules. 6.3. No permittee shall sublet, subrent, transfer or assign a parking stall, assignment or permit to any person without the consent of the Director of Public Works. 6.4. A parking decal, permit or placard issued to a permittee shall be valid only in the designated lot or area. 6.5. The county shall not be responsible or liable for fire, theft, or damage to motor vehicles or contents therein when the motor vehicles are parked or operated in the parking facilities under the county's jurisdiction. 6.6. Any motor vehicle may be removed at the expense of the registered owner or permittee if it is parked in violation of these regulations. 6.7. In any proceeding involving the violation of these regulations, the license number attached to a motor vehicle involved in a violation shall constitute prima facie evidence of the motor vehicle's owner. It shall be assumed that the registered owner of the motor vehicle was the person who parked the motor vehicle at the point where, and during the time when, the violation occurred. 13 of 16 6.8. Every person who is provided a parking permit pursuant to these regulations shall: a) Maintain a valid driver's license during the life of the permit; b) Possess a current certificate of registration for all motor vehicles covered by the permit; and c) Maintain no-fault Insurance for all motor vehicles covered by the permit. 6.9. Violations of the conditions under which the permit is issued, falsification of requested information, the cancellation or the expiration of licensing, registration and insurance requirements, or nonpayment of the required parking fee for more than 30 days shall result in the cancellation of the permit. 6.10. Nothing in these regulations shall be construed to supercede or supplant existing state and county laws regarding the operation of motor vehicles. All applicable state and county laws may be enforced by the appropriate law enforcement agency. 7. ENFORCEMENT These regulations shall be enforced by employee(s) of the Department of Public Works who are duly deputized, pursuant to Chapter 24-202.2 and 24- 202.3 of the Hawaii County Code. Hours of enforcement shall be during the hours of operation for the facility, or as designated by the Director of Public Works. 8. VIOLATIONS AND PENALTIES 8.1. A vehicle parked in an expired metered stall or a vehicle parked in excess of the specified time limit shall receive citation(s) and fine(s) as stated in the provisions of Chapter 24 of the Hawaii County Code. In addition, a vehicle in violation of the above ordinances may be subject to removal as provided in the General Rules, Section 6 of these regulations. 8.2. A vehicle parked in a prohibited or unauthorized parking area, or without proper decals, permits, or placards shall receive citation(s) and fine(s) as stated in the provisions of Chapter 24 of the Hawaii County Code. In addition, a vehicle in violation of the above may be subject to removal as provided in the General Rules, Section 6 of these regulations. 8.3. Persons committing violations of this section other than as specified in subsections 8.1 and 8.2 may be fined for each violation. In addition, the 14 of 16 Parking Control Officer may suspend or revoke the parking assignment and permit of any permittee or permanently remove the name of any applicant from any waiting list for violating these regulations. Failure to pay fines or delinquent payments of parking fines may also result in the revocation of a parking permit. 8.4. Appeals Any person whose parking assignment has been suspended or revoked, or whose name has been removed, may appeal that decision to the Director of Public Works within ten days after receiving notice of such decision. 9. OTHER RESTRICTIONS 9.1.Any vehicle parked in an unmarked area or unauthorized stall shall be cited or towed away at the owner's expense. Fines for each parking violation shall be in accordance with Chapter 291 C-167 of the Hawai'i Revised Statues, Summons or Citations of Illegally Parked Vehicles. 9.2. Specially marked parking stalls may be assigned to council members and as such, shall be considered designated parking. Every council member shall follow all applicable rules and regulations of the designated parking and be responsible for the corresponding fees. 9.3. Parking privileges may be permanently revoked for violation of these regulations. 9.4. All issues not addressed by these regulations shall be the responsibility of, and shall be resolved by, the Director of Public Works. 10. EXCEPTIONS An exception to items listed in these regulations shall be requested in writing. An exception may be granted only with the written approval of the Director of Public Works. An exception shall be valid only for the duration of the term of the Director who granted the exception.
