Darrow Deputy Director Chair Young called the Kona Community Development Plan (KCDP) Action Committee (AC) to order at 4:06 p.m. Due to restrictions related to the Covid-19 pandemic, this meeting was held via the Zoom interactive video platform. ROLL CALL Action Committee Members Present: Maris Bankston, Shirley David, David Huerta, Kari Kimura, Roselyn Molina, Janice Palma-Glennie, Charles Young, Franz Weber, Action Committee Members Absent -Excused: Shane Palacat-Nelson County Staff: Planners - Rob Leasure, Keiko Mercado, Kamuela Plunkett, Planning Director Zendo Zern; Corporation Counsel —Jean Campbell Members of the public: Members of the public observed the meeting via the YouTube Livestream. The livestream is available at Kona CDP AC Meeting - March 2021 - YouTube. ADDITIONS TO THE AGENDA: Mr. Plunkett recommended that the business items be re -sequenced: 1) Review of AC Community Network Maps; 2) Alii Parkway Investigatory Subcommittee; 3) Election of AC Officers. In addition, Mr. Plunkett indicated that Lamaku Mikahala Roy had requested to provide testimony on the Ali'i Parkway matter and the approval of minutes from the October 15, 2019, meeting, which he suggested should be given during the Ali'i Parkway topic. Vice -Chair David made the motion to follow the recommendation, Committee Member Weber seconded, and the motion passed with 8 votes aye and 0 votes nay. ANNOUNCEMENTS: 1. Chair Young expressed his appreciation for Committee Members Barbara DeFranco and Hiram Rivera, who have vacated their positions on the Action Committee since the last AC meeting. 2. Committee Members Bankston and Molina shared introductory comments about themselves with the other committee members. a. Committee Member Bankston shared that they grew up in Hawai'i and California, and that she is eager to begin working with the AC, utilizing the professional skills that she has developed. Committee Member Molina shared that she is a life-long resident of Hawai'i and is working as a business agent for the International Longshore and Warehouse Union. She is interested in the AC to ensure that Hawai'i remains a place where her children may return and be a part of the community, and to be more involved with the planning aspects of the County. 3. Planning Director Zendo Kern shared his background as a life-long resident with extensive experience in real estate, planning consultancy and public service. Director Kern acknowledged and expressed appreciation for the commitment and effort that volunteer members of the community provide to forums such as the AC. In addition, he addressed the recent article regarding the future of CDP ACs in the county and confirmed that the Planning Department continues to support the work of the ACs and the need to focus on community-based actions to further CDP objectives and goals. Director Kern then opened the floor for questions. a. Chair Young commented about Planning Department staffing reductions and asked that it be addressed to meet AC goals regarding the Kona Open Space Network (KOSN) and the traffic issues that the Ali'i Parkway initiative is intended to remedy. b. Committee Member Palma-Glennie raised a concern about the continued need to define open space and greenbelt concepts and emphasized the history of the CDP as a response to a top-down approach to planning. Ms. Palma-Glennie further noted that how the AC conducts its business should be a grassroots activity and suggested that the Planning Department should come to the ACs for their input regarding significant changes in the work of the AC. She also noted that it has been difficult to get traction on desired actions within the department and the county government. i. Director Kern commented that the work of the ACs remains a priority and expressed regret that the article indicated a possible reduction in support for the ACs, which is not the department's intention. The department continues to support the ACs but will need to find a way to do more with the staffing and budget constraints as they are. In addition, he welcomed AC members to continue to share their ideas and concerns with the planning staff and he shared his interest in furthering his involvement with these forums. c. Committee Member Palma-Glennie questioned the status of the KOSN and Director Kern responded that he is in the process of delving into the these types of open issues, so it is premature to speak to the direction that will be taken. However, he expressed his understanding as to the importance of the KOSN to the community. Mr. Plunkett further noted that staffing changes between the two mayoral administrations has occurred and that the KOSN issue has now been moved back to the Long -Range Division's responsibilities from the Mayor's office, but dedicated staff to the effort is pending. PUBLIC COMMENT ON AGENDA ITEMS: One (1) member of the public signed up to provided verbal testimony. As noted during the Additions to the Agenda section, this verbal testimony will be provided during the relevant Business item below. In addition, the following two written testimonies were httys.llwww.ylanninQ.hawaiicounty.Qov/ kona(a�hawahcountuQov Page 2 provided to Planning Staff just prior to the meeting and are attached to these minutes for distribution to the AC Members: 1. Simmy McMichael's written testimony states her concern that the minutes from the October 15, 2020, meeting do not reflect her main point regarding the restriction of additional development on Ali'i Drive in light of threats from tsunami(s) and to historical burial sites in the area. See attached COR -21-140777 for Ms. McMichael's written testimony. 2. Lamaku Mikahala Roy's written testimony requests that the written testimony provided during the October 15, 2019, meeting and a communication to the State of Hawai'i's 31" Legislature (2021) be shared with the Action Committee members and entered into record. See attached COR -21-140778 for Lamaku Mikahala Roy's written testimony. BUSINESS: 1. Review Action Committee Member Community Network Maps: Mr. Leasure presented a visual portrait of the AC members' network of community groups and projects with which they are involved. This network image was created on the on-line Kumu software and shows the type of community groups and specific projects linked to each AC member. See attached Communication Number 2021-01. Mr. Leasure noted further that the categorization of the types of community groups is a proposal to be reconciled with other CDP ACs so that they may be combined for an island -wide view, and he stated that the planning staff would like the committee members' suggestions on other information to include and ways to organize the data that would be useful to them in their effort to prioritize and implement CDP -related implementation actions Ms. Mercado connected this mapping exercise to the December All -Island CDP AC meeting where planning staff presented an approach to focus the ACs on community-based implementation actions and intends for this mapping to define AC and planner roles more clearly and to build on collective action. Committee Member Palma-Glennie stated the concern that taking the approach of asking once again for community participation in implementation actions may result in community frustration given the lack of fulfilling the critical Kona Open Space (KOSN) objectives. Vice -Chair David indicated that this mapping will be useful for identifying the community connections of interest to the new AC members and inform them of potential implementation actions. Chair Young commented on his concern of engaging community interest in implementation actions under the reduced -meeting format but endorsed the mapping as a useful communication tool. Ms. Mercado stated that in addition to the AC members navigating their networks, the planning staff must do the same within the County to engage fully with the different departments in support of implementing CDP actions, and to rebuild relationships and trust with the ACs. Committee Member Palma-Glennie noted that KOSN was a top priority on CIP funding and received Council support, yet the initiative remains in the planning stage. Mr. Plunkett clarified that the funding has been secured but staff capacity for project management of the consultant contract has not yet been made available. Committee Member Kimura commented that planning staff support for the ACs was reduced to support the General Plan update and asked if it is winding down so that planning staff may be re -committed to the ACs. Ms. Kimura further stated that if this is not so, then AC members may consider appealing to the Director, Mayor and County Council to resurrect support. httys.llwww.ylanninQ.hawaiicounty.Qov/ kona(a�hawahcountuQov Page 3 Chair Young questioned how to go forward with subcommittees to achieve goals between the quarterly meetings. Mr. Plunkett noted that once a planning staff member is assigned to the KOSN item, then the KOSN subcommittee is in place to work with this staff member outside of the formal AC meeting structure. 2. Ali'i Parkway Investigatory Subcommittee: Mr. Plunkett confirmed that the scope defined at the time of the subcommittee's establishment did not include the capturing of public testimony that might be given during the presentation of the subcommittee's final report (Final Report was presented at the October 15, 2019, Action Committee meeting), but he noted that the meeting minutes may be attached to the final report for reference. Mr. Plunkett then re -iterated the request to give public testimony by Lamaku Mikahala Roy on this subcommittee topic and on the portion of the October 15, 2019, minutes regarding the same. Chair Young then recognized Lamaku Mikahala Roy to speak on both topics within a total six (6) minute time allocation. Committee Member Weber motioned to discuss the subcommittee report, Vice -Choir David seconded, and passed with 8 votes aye, 0 votes nay. Lamaku Mikahala Roy began her oral testimony by stating her expectation for pono regarding the inclusion of her testimony from the October 15, 2020, meeting in the subcommittee's final report. Ms. Roy then questioned the participation of a Pittsburgh consultancy for the drafting of the Kona CDP and stated her lack of support for the County's flawed planning system, including the insufficient space for public testimony under the Zoom meeting platform, and asked for County staff response. Chair Young asked Ms. Roy to present her comments on the minutes and the subcommittee that she believes will be of benefit to the committee. Lamaku Mikahala Roy stated that the written testimony that she submitted was not reflected in the October 15, 2019, minutes and that her verbal testimony was also not sufficiently captured. Ms. Roy then questioned the AC members if they received a copy of the written testimony from October 15, 2019, which she sent just prior to this meeting. Upon confirmation that they have not, Mr. Leasure noted that they were received approximately twenty (20) minutes prior to the meeting start but would make it available subsequent to the meeting. Lamaku Mikahala Roy then addressed the Ali'i Parkway issue by noting her responsibility as Kahu of Ahu'ena Heiau and her work within the organization Kulana Huli Honua and alongside other community volunteers to protect Kahakai La'a o Kona, the sacred shore of Kona. Ms. Roy further stated that the Ali'i Parkway project is contrary to the history, quality and essence of the spiritual lands of Hawai'i and that the lands of 'Giwi must be protected. Chair Young clarified that the subcommittee's goal was to capture input from families within the area of the proposed project in addition to their input captured by the burial councils, and that it is the County's decision whether or not to renew the project. In addition, Chair Young clarified what he believed were the possible next actions — accept the report; extend the subcommittee to look further, or just close the subcommittee. Chair Young asked Lamaku Mikahala Roy if she had read the report and she replied that she had not and that she sincerely requests that the AC members read and receive her written testimony as they are important and are making history and that the AC members are responsible once they receive her words. Ms. Roy continued with a summary of the historical signifcance from the time of Kamehameha the Great to the present, closing her remarks by noting the vitality of the lands to the 'Giwi (first people of Hawaii) and that the Light of Akua must guide how we malama Hawai'i. httys.llwww.ylanninQ.hawaiicounty.Qov/ kona(a�hawahcountuQov Page 4 Choir Young concluded discussion and called for the question. The final report was approved, and the subcommittee was closed, by 7 votes aye, 0 votes nay. Mr. Plunkett thanked Lamaku Mikahala Roy for her testimony and deep mana'o and stated that the testimony limit of three (3) minutes is insufficient to capture the full expression of that type of sharing. As a general statement for future consideration, Mr. Plunkett hypothesized that, that kind of sharing should be discussed with the Chair and Planning Staff to be agenized in a way that connects to the CDP and Land Use issues so that more time can be allotted. Chair Young acknowledged that getting the full essence of public testimony is not easy in three (3) minutes, but we should respect these voices and the process that we follow, which is a difficult balance to achieve. Committee Member Palma-Glennie agreed that this limit should be re -considered because the value of Lamaku Mikahala Roy's words could not be brought forward by AC members in place of her participation in the meeting. Vice -Chair David questioned what the next step is for the subcommittee report and whether or not a motion is required to forward. Vice -Choir David motioned to amend the earlier motion to close the subcommittee and accept the final report to also include the recommendation to forward the final report to the Planning Director. Seconded by Committee Member Kimura. The amended motion passed with 8 votes aye, 0 votes nay. Election of Action Committee Officers: Mr.Plunkett stated that the AC should nominate a Chair and Vice -Chair for 2021. Committee Member Palma-Glennie questioned if the AC leadership should remain as is given the potential changes in the AC membership that is under review by the new Mayoral administration. Committee Member Kimura concurred and asked the current Chair and Vice -Chair to consider continuing until the administration clarifies the direction forward. Mr. Plunkett noted that the floor should be opened to other AC members to indicate if they would like to be nominated to the Chair/Vice Chair roles. Each member confirmed that maintaining the current Chair and Vice -Chair is preferable. Mr. Plunkett clarified that when the administration determines the next steps, which may include replacing holdover members, then a new election may be required. Ms. Mercado then highlighted the termination dates and holdover status of most members in response to Chair Young's enquiry on this matter. Committee Member Weber moved to keep the current leadership until the AC decides to make o change. Committee Member Huerto seconded. The motion passed with 8 votes aye, 0 votes nay. PROPOSED AGENDA ITEMS FOR NEXT MEETING: 1. Follow-up with KOSN — What is status of launching consultant work? What is the understanding of the need and the support of the initiative by the Mayor, Planning Director, and County Council? 2. Planning Director Update 3. Status of General Plan Update APPROVAL OF MINUTES: Vice -Choir David moved to approve the minutes of the October 15, 2019, minutes. Ms. Mercado suggested that the written testimony may be attached to the minutes. Mr. Plunkett further noted that discrepancies between the oral testimony and the written testimony may not be identified if the written testimony is attached without review. Choir Young called for the question and the motion to approve the minutes os submitted passed with 8 votes aye, 0 votes nay. Vice -Chair David moved to approve the minutes of the December 16, 2020, minutes. Seconded by Committee Member Weber. The motion passed with 8 votes aye, 0 votes nay. This eliminated my main point regards to development on Alii Drive. I testified heavy concerns about the emergency in case of a Tsunami. The last evacuation went to a dead stop. If the Tsunami occurred we would have all died. The police chief wrote a letter in an EIS, No more developments on Alii Drive if Alii drive is the only access, until Alii Highway is open to traffic. We cannot have another Bottleneck situation. I'm also heavily concerned of all the Burials! And especially in Historic Districts. Please vote to close this investigatory committee. I wish I was up to speed on this meeting and the way it is notified and handled because of Covid19 is somewhat overwhelming to say the least Perhaps the public should be made aware sooner. In 2007, the state of Hawaii caused the closing of doors of the 501-C3 non-profit organization named KGlana Huli Honua, Foundation of the Search For Wisdom. Here was the first organization formed in Hawai'i to uphold the work of ' the Kahu of Ahu'ena Heiau and to advocate for all sacred sites beginning with Ahu'ena Heiau throughout all of Hawaii. The business flourished for more than a decade engaging especially Kona's community in the work to uphold the tremendous value in the lands of the first Capital of the Kingdom of Hawaii unified by Kamehameha the Great. The story of the lands of the Capital involve the stories of all lands throughout ka pae 'aina (the Hawaiian Islands). I've begun the renewed KGlana Huli Honua in the business Keaulama LLC dba KGlana Huli Honua. If Kamakahonu was chosen the Capital of the Kingdom of Hawaii by Kamehameha the Great, what does this tell us about the lands neighboring the Capital? North and South of Ahu'ena Heiau are lands of inestimable value. Here are lands that are VITAL to 'Oiwi, the first people of Hawai'i and the Pacific and to all who truly love the Divine Creator of all mankind. In the 1970's my father Kahu David Keli'ihelemauna Roy, Jr. led the first restoration of a Sacred Temple in all of the Hawaiian Islands by the guidance of Akua in the Ancestors of 'Oiwi. The Temple is Ahu'ena Heiau at Kamakahonu. Ahu'ena means Burning Altar referring to the Great Light there. It was Kahuna La 'au Lapa'au Morrnah Simeona who said the 70's were times of great spiritual advancement for'Oiwi. H6kGle'a traveled to Kahiki, Ho'oponopono was implemented at the Geneva Convention and introduced to the world and Ahu'ena Heiau at Kamakahonu was restored by'Oiwi. In 2010, messages from the Great Pacific Ancestors of the Light of Akua began to come to Kamakahonu. What was 2010 but the 200th anniversary of the unification of the Hawaiian Islands by Kamehameha the Great. They were these Pacific Ancestors whom Kamehameha II King Liholiho praised and acknowledged in his famous words that became the proverb, "Na wai ho'I ka 'ole o ke akamai he alahele I ma'a i ka hele'ia a o'u mau Makua? Who would not be wise upon a path so well -traveled by my Ancestors? This was his response to the praise of his wisdom. Over time, the Great Ancestors have been teaching me and they wish me to teach what I've learned. I lift to you here photos of Ali'i Kahu David Kahelemauna Roy, Jr. and Ali'i Naluahine Ka'6pua, the Konohiki of Kamakahonu for the Kingdom of Hawai'I united by Kamehameha the Great. I sat on his lap; the lap of my Kuku Naluahine at my'Aha'aina Piha Makahiki - First Birthday Feast and Celebration. Kulana Huli Honua - 1 led the people in the strong effort AGAINST the earlier proposal for Alii Parkway. We gathered with participants from ALL walks of life — professors and their students, residents and visitors who gave volunteered effort and then some to help protect Kahakai La'a o Kona, "the Sacred Shore of Kona." Kulana Huli Honua 2 is here tonight with the empowered and enlightened testimony and cause to say AGAIN not only is this project contrary to all laws that protect the sublime history, quality and essence of the spiritual lands of Hawai'I, we're here to ever more greatly give the reasons WHY these lands are VITAL to 'Oiwi and to all mankind on the planet. Not only do my words stand in truth of all words assembled by the County Department of Public Works and the State Department of Transportation when the first project was presented, they are words that re-emerge now empowered and guided by the Ancestors of'Oiwi that uphold the Highest Light of Akua at Kamakahonu, the First and Abiding Capital of the Kingdom of Hawaii by Kamehameha the Great. Their words defend the Sacredness and VITAL importance of the lands of the Kona Coast that this project seeks to destroy. Ahu'ena Heiau is the first restored Temple of worship in the Hawaiian Islands, in the Pacific and in the world. The restoration of Ahu'ena Heiau (translated as Burning Altar referring to the Great Light there) was guided by Akua in the Kahu and in the hearts of the men who came from all islands with the main working crew coming from Kona. There was no Office of Hawaiian Affairs, no presence of a state historic preservation department, only dedicated and faithful individuals with pride for the heritage of'Oiwi, pride in their bloodlines and respect for the First Capital of the Kingdom of Hawai'i unified by Kamehameha- the-Great. I'm instructed by the Ancestors that all members of the steady crew that restored Ahu'ena Heiau are to be acknowledged as Ali'i. Kahuna La'au Lapa'au Morrnah N. Simeona said that the Seventies were a time of great spiritual growth for Hawaii and her First People.
