COMMISSIONERS IN ATTENDANCE: Dean Au, Gilbert Aguinaldo, Joseph Clarkson, Michelle Galimba, Dennis Lin, Thomas Raffipiy and John Replogle. ALSO IN ATTENDANCE: Malia Hall, Esq. (Counsel for the Commission), Jeff Darrow (Deputy Planning Director), Jean Campbell, Esq. (Counsel for the Planning Director), Christian Kay (Planner), Maija Jackson (Temporary Assignment Program Manager), and Melissa Dacayanan- Salvador (Windward Planning Commission Secretary). APPLICANT: JP AUTOMOTIVE LLC (Formerly Conrad & Joanne Dakujaku) (AMEND REZ 09-000097) Application for a five (5)year time extension to Condition D (Time to Complete Construction) of Change of Zone Ordinance No. 09 138, which rezoned approximately 22,300 square feet of land from a Single-Family Residential-10,000 square feet(RS-10)to an Industrial-Commercial Mixed-20,000 square feet(MCX-20) zoning district. The property is located at 513 Kalanikoa Street, along the east side of Kalanikoa Street approximately 100 feet north of its intersection with Hualani Street, Waiakea Houselots 1st series, Waiakea, South Hilo, Hawaii, TMK: 2-2- 035:034. The Applicant JP Automotive LLC formerly Conrad and Joanne Dakujaku, Amend REZ zero nine dash zero zero zero zero nine seven (09-000097). Application for a five (5)year time extension on Condition D, time to complete construction of Change of Zone Ordinance Number zero nine one three eight (09-138), which rezoned approximately twenty-two thousand three hundred(22,300) square feet of land from Single-Family Residential —ten thousand (10,000) square feet RS-ten (RS-10)) to Industrial -Commercial Mixed-20,000 square feet MCX-twenty (MCX-20) zoning district. The property is located at five thirteen (513) Kalanikoa Street, along the east side of Kalanikoa Street approximately a hundred(100) feet north of its intersection with Hualani Street, Waiakea Homestead Lots, First(1st) Series, Waiakea, South Hilo, Hawaii, Tax Map Key (TMK)two dash two zero three five zero three four(2-2-035:034) and staff for our presentation. At 10:37 a.m. the Chair called a recess and the hearing reconvened at 10:43 a.m. REPLOGLE: Okay Houston we have liftoff. Is everybody back? KAY: No problems here Houston. REPLOGLE: Okay (chuckle), so, Christian Kay will you continue with your presentation please. Thank you. KAY: Thank you Mr. Chair. As you stated the application, we have in front of us today is an amendment to an existing Change of Zone Ordinance Number 09 138. The subject parcel is located in the South Hilo District of Hawaii Island more specifically in the Hilo area located between Hualani Street and Pi`ilani Street on the east side of Kalanikoa Street and it's situated this area outlined by red. The applicant is requesting a 5-year time extension to Condition D (Time to Complete Construction) of Change of Ordinance Number 09 138. Which reclassified 2 EXHIBIT C approximately 22,300 square feet of land from a Single-Family Residential-10,000 square feet to an Industrial-Commercial Mixed-20,000 square feet zoning district. The applicant proposes to construct an automotive repair facility consisting of an approximately three-thousand seven hundred-fifty (33,750) square foot steel building with four(4) repair bays, three (3)bathrooms and a coffee break room. Additionally, the applicant will provide 4 paved parking stalls including one (1) Americans with Disabilities Act(ADA) compliant stall, landscaping, and other related improvements. Since purchasing the property in twenty-fifteen (2015), the applicant has made considerable progress in developing the property to move his existing automotive repair business to the subject property. Including clearing and grading the property, water service installations, securing plan approval and a securing a building permit. Despite the applicant's best efforts to complete construction within the required timeframe, he has been unable to do so due to circumstances beyond his control, including design and development delays, family illness and deaths in the family. Based on the preceding, the applicant is requesting an additional 5 years to complete construction. What you see in front of you is the zoning map for the subject property and surrounding areas. Again, for reference we've got Kalanikoa Street running generally north south through the slide, the subject property in this case is outlined in black. Other zoning in the area is Single-Family Residential but as well you can see that the area has been shifting over time to more of a Commercial Limited Industrial or Mixed-Use Industrial type of a neighborhood. The State Land Use Designation for the subject property and all of the surrounding area is Urban. The General Plan Land Use Pattern Allocation Guide Map (LUPAG) designates the subject property as Industrial so, the MCX zoning is consistent with that LUPAG designation. We've got two (2) aerial views of the subject property here outlined on the upper left in blue again Kalanikoa Street running generally north south through the slide and you can see there are some single-family residences in the area but also several commercial and limited-industrial type structures and uses in the area. Then the bottom right photo shows the subject property a little more zoomed in currently vacant of any improvements and overgrown with vegetation but prepared to be developed after being cleared and graded. The subject submitted the site plan that you see your screen again showing Kalanikoa Street running on the left-hand side of the slide and again showing the proposed building within the parcel, designated parking areas and the like and improvements to the curb gutter sidewalk as requested by the Department of Public Works and other improvements that are being proposed. Here's a view of the property from across Kalanikoa Street looking into the property again vacant of any structures but cleared and still overgrown with vegetation and some views of Kalanikoa Street upper left is looking south and then the lower right is looking north again you can see there are existing other type of commercial and limited industrial mixed use industrial type uses in the area. The Deputy Director is recommending to forward a favorable recommendation to the County Council for amendments to rezone ordinance number 09 138. REPLOGLE: And can you tell us whether you agree with the recommendation and you may give us your presentation. Please proceed. PIPAN: Yes, we agree with the Planning Director's recommendation and appreciate the efficient and professional meeting that we are having today, thank you Chair, thank you Commissioners for your service, thanks to the Planning Department staff for their tireless work on this project and many countless others. This application we have before you today is fairly straightforward 4 EXHIBIT C it's a request for a time extension for a project that Mr. Pilor's been working diligently on for the past several years since he bought the property in 2015. All the applicable elements with respect to County General Plan and Land Use Designation have been gone over by Mr. Kay very well. Thank you for that. We would just humbly ask for your support in forwarding a favorable recommendation to the County Council and we are here for any questions you might have. Thank you. REPLOGLE: Thank you.
