CALL TO ORDER

A quorum was present. Chairman Roth called the meeting to order. Chairman Roth stated that
based on the Mayor's proclamation regarding COVID-19, these meetings will be on line until
further notice. This is to prevent the spread of COVID-19 and to also maintain social distancing.
Normally commissioners introduce themselves, however since the meeting was online Chairman
Roth read the names as they appeared from a list of those present on the Cisco Webex monitor.
APPROVAL OF MINUTES
Chairman Roth—Minutes November 24, 2020 were distributed and the Chairman Roth asked if
there were any corrections. No corrections offered, and the minutes were approved as circulated.
STATEMENTS FROM THE PUBLIC ON AGENDA ITEMS
Chairman Roth asked if there were any Public Testimony to be presented and Rosalind Newlon
(Staff) answered none. No statements from the Public.
NEW BUSINESS
1. The applicant Anna White of Papa Kona Coffee and Events LLC,is proposing non-
structural repairs and modifications to the interior and exterior of the Papa Kona
restaurant located at Waterfront Row on Alii Drive. The exterior changes for
design review include, 1) removing the existing wood casing (cladding) and exposing
existing structure and glass, and replacing the bi-fold doors with double swing
doors, that face the outside seating area on the main floor, and; 2)painting the
gypsum board between the brace members on the counter portion of the wall of the
facing bar seating area on the second floor.

Ms. Newlon (Staff) commenced her Power point presentation starting with applicant
Papa Kona Coffee and Events LLC (previously Chart House), who proposed to do non-
structural repairs and modifications to the interior and exterior of the Papa Kona
Restaurant located in the Waterfront Row of Alii Drive. The applicant did need to do an
SMA assessment, because they are a shoreline parcel and also required to do a Kailua
Village Design review. There were no changes to the second level. Ms. Newlon shared
photos provided by the applicant of the existing brace covered by plywood sheathing and
another photo of what the exposed glass looks like. There was a Plan Approval done in
2017 and a Variance Application. After the presentation Commissioner Smith asked if
the project had already been completed. Commissioner Hetherington mentioned that he
was asked to do some work on the project previously and believed that most of the work
had been done. The applicant Anna White responded to the question raised by
Commissioner Smith and confirmed that the work was completed, they opened the
restaurant on October 15, 2020 and advised by a DPW inspector that they could move
forward with their project using their Alteration Permit. Commissioner Ikeuchi
commented that the exposed beam and glass looks really classy and thought that it was
really nice that the applicant thought of bringing back its original integrity.
A motion was made by Commissioner Ikeuchi to approve the application as submitted
and Commissioner Werchick seconded the motion. There were no discussions on the
motion, and a roll call vote was taken. The motion was carried with eight ayes:
(Commissioner's Ching, Crusat, Hetherington, Kern, Smith, Sullenberger, Ikeuchi and
Werchick).
Chairman Roth—Motion adopted.
2. The applicants, Roger and Linda Clark, are proposing a sign permit/variance for
a 2 square foot real estate sign with maximum 1.65-inch lettering, to be located on
an entry wall consisting of a rock wall with chain link fence atop it,located at the
front of their condominium complex, the Kona West. The applicants are requesting
a sign/permit variance to extend the period of time permitted by the Sign Code,
Chapter 3, Section 3-8 (a)(1)(B): "any small unlighted sign not exceeding two square
feet in area, displayed once in a calendar year for a period of time not to exceed 30
consecutive days."

Applicants Roger and Linda Clark proposed a sign permit/variance for a 2 square foot
real estate non-illuminating sign with maximum 1.65 inch lettering, and proposed to
place the sign on an entry rock wall with chain link fence, located at the front of their
condominium complex of the Kona West located off of Kuakini Hwy. Commissioner
Sullenberger wanted to make clear that the applicants were selling their condo. Ms.
Newlon (staff) confirmed that the applicants were selling their Condo and want to place
their sign outside of their entry wall. Commissioner Smith asked if dimensions of the
sign were provided. Chairman Roth responded and pointed out that the dimensions were
provided on attachment BC, by the chain link fence indicating that the dimensions were 1
foot by 2 feet. Commissioner Smith mentioned that he noticed there were
correspondences about the unit owners having difficulty getting in touch with land owner
and asked if there is a requirement that the landowner sign the application. Ms. Newlon
responded saying that even though it is a requirement that the land owner sign the
application, the applicant has been working with the DPW Building and their sign
variance requirements. Commissioner Werchick mentioned this issue is a good example
of something that should not be addressed at the Kailua Village Design Commission. He
suggested that the rule should be amended and should not be subject to a 30 day rule,
because the probability of properties selling within the 30 day rule is minimal and will
bring much expense and difficulty to property owners in this situation. Chairman Roth
agreed with Commissioner Werchick and suggested that in this case it should be
interpreted under the 6 month paragraph and not the 30 day paragraph.
Commissioner Werchick made a motion to approve the extension and Commissioner
Crusat seconded the motion. Commissioner Smith asked Commissioners if the motion
should be that the Building Division confirm the application to be valid, because it lacks
the land owner's signature. Commissioner Werchick responded by saying that it
shouldn't be a KVDC decision.
Ms. Newlon began a roll call vote. Commissioner Werchick made the motion to approve
the application as submitted and Commissioner Crusat, seconded the motion. Voting
began with Commissioner's Ching (Aye), Hetherington (Aye), Ikeuchi (Aye), Kern
(Aye), Smith(Aye), Sullenberger(Aye) and Werchick (Maker of motion). It was a
unanimous vote, the motion was approved.
Chairman Roth—The motion is adopted.
3. The applicant, Raymond S. Pieri, Project Manager of the Kona Reef
Condominium,is requesting design review of their proposed shoreline area erosion
abatement and property protection project. The project consists of a proposed CRM
wall that would be built entirely along Kona Reef's property in a northwesterly
direction for approximately 220-feet, to be located within 1-foot inland of the State
Certified shoreline. The applicant has applied for a Shoreline Setback Variance and
a Special Management Area Use Permit for this project.

Ms. Newlon proceeded with presentation and shared photos and additional documents
provided by applicant Raymond S. Pieri. A few photos showed the location of work to
be done near the shoreline. It also included a CRM existing wall and 220 feet shoreline
abatement boundary line. Other photos show parts of the Kona Reef Hotel's existing rock
wall, lawn, shoreline and a line that represents where the shoreline protection wall will
go. A setback variance was proposed to the Planning Commission previously by
applicant. After the presentation was done, applicant Ray S. Pieri wanted to make it clear
that the walls will be completely subterranean and palm trees and grass will remain in
place. The outside wall is the certified survey and trench digging will be done to build
wall inside and fill will be placed on both sides. The applicant assures Commissioners
that there will be very little erosion.
Commissioner Werchick moved to accept the application as presented and Commissioner
Sullenberger seconded the motion.
A roll call vote was made by Ms. Newlon. A Motion to approve the application as
presented was made by Commissioner Werchick and seconded by Commisoner
Sullenberger. Votes were made by Commissioners Ching (Aye), Crusat(Aye),
Hetherington (Aye), Ikeuchi (Aye), Kern (Aye), Smith (Aye), Sullenberger(Seconded
motion) and Werchick (maker of motion) (Aye). Unanimous vote and the motion was
approved.
Chairman Roth—Motion is adopted.
ADMINISTRATIVE MATTERS
The Calendar for next year was distributed by email. Tentative meeting scheduled
for January 12, 2021.

No further announcements.
ADJOURNMENT
There were no further business, Chairman Roth adjourned the meeting at 6:25pm.
