HomeMy WebLinkAbout2021-06-03 Windward Planning Commission Minutes WINDWARD PLANNING COMMISSION COUNTY OF HAWAII MINUTES JUNE 3, 2021 The Windward Planning Commission met in regular session at 9:04 a.m., with Chairman John Replogle presiding. Based on the Governor's Nineteenth Proclamation Related to the COVID- 19 Emergency dated April 9, 2021, this meeting was held online, with live-streaming for the public to observe the meeting. VIRTUAL ATTENDANCE(COMMISSIONERS): Gilbert Aguinaldo, Dean Au, Joseph Clarkson, Michelle Galimba, Dennis Lin, John Replogle. ABSENT AND EXCUSED: Thomas Raffipiy. VIRTUAL ATTENDANCE(STAFF): Zendo Kern (Planning Director), Jeffrey Darrow (Deputy Planning Director), Malia Hall (Deputy Corporation Counsel for the Windward Planning Commission), Jean Campbell (Deputy Corporation Counsel for the Planning Department), Christian Kay (Planner), Tracie Lee Camero (Planner), Jessica Andrews (Planner), Maija Jackson (Temporary Assignment Program Manager), and Melissa Dacayanan-Salvador (Windward Planning Commission Secretary). Secretary's Notes: Throughout the meeting, there were some technical and/or internet difficulties which made the speaker inaudible. Please note that the notation "—"in these Minutes and the Exhibit Transcripts means that there were technical and/or internet difficulties which made the conversation inaudible. A quorum was present. Chairman Replogle called the meeting to order. He explained the procedure and protocol for this online meeting and live public testimony. He introduced the Commissioners and staff who were in virtual attendance. STATEMENTS FROM THE PUBLIC At 9:09 a.m. the Commission took up statements from the public. There was one (1) testifier registered and was not present when this item was taken who was in support of Agenda Item 1, AT&T MOBILITY (USE 21-000087). The meeting continued and as public testimony was still open and when the testifier was present after the Planning Department staff's presentation for Agenda Item 1, AT&T MOBILITY (USE 21-000087) his testimony was given and ended at 9:25 a.m. [SEE HEARING TRANSCRIPT EXHIBIT AJ It was moved by Commissioner Au and seconded by Commissioner Aguinaldo that public testimony be closed. APPLICANT: AT&T MOBILITY (USE 21-000087) Application for a Use Permit to allow the construction a non-manned telecommunication facility consisting of a 105-foot tall, stealth "monopine"tower with related equipment within a 616-square foot portion of a 6.875-acre property situated in the County's Agricultural-40 acre (A-40a) zoning district. The subject property, which is the site of Girl Scout's "Camp Kilohana", is situated approximately 122 feet south of the 44-mile marker on Saddle Road (Route 200) and directly adjacent to the north of Mauna Kea State Park, Por. Kaohe & P5'auhau, Hamakua, Hawaii, TMK: (3) 4-4-015: portion of 005. The Commission took this item up at 9:11 a.m. Action: It was moved by Commissioner Au and seconded by Commissioner Aguinaldo that the application for USE Permit No. 21-000087 be approved based on the Planning Director's recommendation, which shall be adopted. A roll call vote was taken, and the motion carried with six (6) ayes (Au, Aguinaldo, Clarkson, Galimba, Lin, Replogle) and no noes. APPLICANT: JOHN WAGNER & CHARLENE IBOSHI (REZ 21-000245) Application for a Change of Zone from a Single-Family Residential-10,000 square feet (RS-10) to a General Commercial-7,500 square feet(CG-7.5) zoning district for 19,295 square feet of land. The subject property is located at 1290 Kino`ole Street, at the Southwest(Puna-Mauka) corner of the Kino`ole and Lono Street intersection in Waiakea Houselots, Waiakea, South Hilo, Hawaii, TMK: (3) 2-2-024:022. The Commission took this item up at 9:51 a.m. Action: It was moved by Commissioner Lin seconded by Commissioner Au that a favorable recommendation be forwarded to the County Council on the application for Change of Zone Docket Number 21-000245 with the condition that Condition O be removed, based on the Planning Director's recommendation which shall be adopted. A roll call vote was taken, and the motion carried with six (6) ayes (Lin, Au, Aguinaldo, Clarkson, Galimba, Replogle) and no noes. This hearing item ended at 10:36 a.m. [SEE HEARING TRANSCRIPT EXHIBIT BJ At 10:36 a.m. the Chair called a recess and the hearing reconvened at 10:48 a.m. 3. APPLICANT: KRISTILEE & HENRY J. CORREA JR. TRUST (REZ 705) Application for a for a seven (7)-year time extension of Condition C (time to secure final subdivision approval) and Condition K (deadline for fair share payment) of Change of Zone Ordinance No. 13 98, which rezoned 6.0003 acres of land from an Agricultural 3-acre (A-3a) to a Single Family Residential 10,000-square feet(RS-10) zoning Page 2 of 4 Windward Planning Commission June 3,2021 Minutes district. The property is located along the north side of Kawailani Street, adjacent to and east of the Life Care Complex, Waiakea, South Hilo, Hawaii, TMK: (3) 2-4-003:021. The Commission took this item up at 10:48 a.m. Action: It was moved by Commissioner Galimba and seconded by Commissioner Aguinaldo that a favorable recommendation be forwarded to the County Council on the application to amend Change of Zone Ordinance No. 13-98, with the deletion of Condition C as amended by Commissioner Clarkson based on the Planning Director's recommendation, which shall be adopted. A roll call vote was taken, and the motion carried with six (6) ayes (Galimba, Aguinaldo, Au, Clarkson, Lin, Replogle) and no noes. INITIATOR: PLANNING DIRECTOR An ordinance amending Chapter 23, Article 4, Article 5, and Article 6 and Chapter 25, Article 2, Article 5, and Article 6 of the Hawaii County Code 1983 (2016 Edition, As Amended), relating to processing of subdivision and zoning applications in preparation for Energov launch and making clerical revisions to permitted uses in the Family Agricultural zoning district. The Commission took this item up at 11:22 a.m. Action: It was moved by Commissioner Au and seconded by Commissioner Lin that a favorable recommendation be forwarded to the County Council on the Planning Director's proposed amendments to the Hawaii County Code Chapter 23 and Chapter 25, based on the Planning Director's recommendation, which shall be adopted. A roll call vote was taken, and the motion carried with six (6) ayes (Au, Lin, Aguinaldo, Clarkson, Galimba, Replogle) and no noes. This hearing item ended at 11:48 a.m. [SEE HEARING TRANSCRIPT EXHIBIT DJ MINUTES Approval of Minutes of the May 6, 2021, Windward Planning Commission meeting At 11:48 a.m. it was moved by Commissioner Au and seconded by Commissioner Lin that the minutes of May 6, 2021, be approved. Chair Replogle stated it has been moved and seconded but he had something to add to the minutes if possible. Counsel Malia Hall replied as it has been moved and seconded and there is a motion now, the Commission is able to discuss or make an amendment to the motion. Chair Replogle asked a correction to be made at the bottom of page 3 where it says, "An example given was the Department of Hawaiian Homelands (DHHL) at Kalai where". He stated it's not Kalai (lai) and its Kalae (lae) which is a cape, headland point or promontory and the other lai is a fish. Commissioner Au accepted the correction by Chair Replogle since he had made the motion and Commissioner Aguinaldo seconded. A voice vote was taken, and the motion carried with the correction with all in favor and no noes. Page 3 of 4 Windward Planning Commission June 3,2021 Minutes ADMINISTRATIVE MATTERS 1. Discussion of recent Special Management Area(SMA) determinations, minor permits and enforcement action issued by the Planning Director. The Commission took this item up at 11:52 a.m. Ms. Jackson said the Special Management Area (SMA) Assessment log and the Short-Form log were provided and asked if the Commission had questions. There was no discussion or questions on the recent SMA logs. ANNOUNCEMENTS Chair Replogle stated the Windward Planning Commission's next monthly meeting is scheduled Thursday, July 1st by interactive video conference on zoom. Commissioner Clarkson asked when it is expected they will be going back, or will they be going back to in-person Commission meetings and what has to happen. Director Kern answered the emergency proclamations would need to allow that and currently there is a bill waiting for signature on the Governor's desk which will allow the continuance of virtual meetings. He mentioned they are looking at possibly a combination of both and asked if this needs to be on the agenda to further be discussed. Counsel Malia Hall suggested to wait for the bill to be signed or vetoed and then they will be able to have a bigger discussion around it. ADJOURNMENT There being no further business, it was moved by Commissioner Clarkson and seconded by Commissioner Aguinaldo that the meeting be adjourned. A voice vote on the motion to adjourn was taken, and the motion carried with none opposed.
