Agenda Item 7-2-c Pahala LCC Closure Project

Aloha Chair Adams and Commissioners,
According to Page 4 of the current Ka’u LCC Closure Semi-Annual Compliance Report
(attached), the County has made major changes to the Pahala project plans – from a
technology with open lagoons to “mechanized treatment alternatives” with “subsurface
drip irrigation.”
This major change requires the Mayor to consider whether a Supplemental
Environmental Assessment is needed and to publish notice of the decision in TEN. I
attached HAR Section 11-200-26 et seq. and the sample notice required by this major
change so you can see for yourselves what I am talking about.
Please ensure that the County follows these environmental rules because EMC is the
only group that can provide this guidance and oversight on behalf of the public!
