Condition No. 2 of Special Permit No. 387 (enclosed) states in part, "All future expansions shall be directly related to the Humane Society's animal shelter use and shall also secure Final Plan Approval prior to being established. Through the Plan Approval process, the Director may impose reasonable conditions as necessary to mitigate any unanticipated impacts offuture expansions." Based on the preceding, the requested Special Permit amendment was unnecessary to allow the proposed expansion of the Humane Society facility. Please submit an application for Plan Approval to move forward with your project. Please note that any further development of the property will be subject to all applicable laws, rules, regulations and requirements of relevant State and County agencies. Specifically, should future development require the clearing of vegetation on the property, the applicant will be required to comply with guidance from the State Department of Land and Natural Resources Division of Forestry and Wildlife (DOFAW) for mitigation of impacts related to endangered wildlife (see DOFAW's June 16, 2021, letter enclosed). We will refund the $250.00 filing fee for the amendment under separate cover.
