FIRST SUPPLEMENTAL EMERGENCY PROCLAMATION
AND MANDATORY EVACUATION ORDER
WHEREAS, Chapter 127A, Hawaii Revised Statutes, as amended, provides for the
establishment of County organizations for disaster relief with a director in charge of each
political subdivision; and
WHEREAS, the Mayor of the County of Hawaii has been appointed as the Director of
Civil Defense of the County of Hawaii; and
WHEREAS, Chapter 7, Articles 1 and 2 of the Hawaii County Code, establishes a Civil
Defense Agency within the County of Hawaii and prescribes its powers, duties, and
responsibilities, and Section 127A-14, Hawai'i Revised Statutes and Section 13-23 of the
Hawaii County Charter empowers the Mayor of the County to declare emergencies; and
WHEREAS, due to a brush fire in area of Pu'u Kapu Hawaiian Homestead and Waikii
Ranch that has caused heavy smoke and low visibility, the Hawaii Fire Department has issued a
mandatory evacuation to all residents of Pu'u Kapu Hawaiian Homestead and Waikii Ranch at
6:00 p.m., Hawai'i standard time on July 31, 2021; and
WHEREAS, the brush fire has expanded and has crossed Highway 190 near the 9 mile
area and is near the Waikoloa Village area; and
WHEREAS, due to the possibility of imminent disaster due to property damage and/or
bodily injury to residents of Hawaii Island, and the need for government agencies and
representatives from the private sector to mobilize and provide immediate services to our island
residents, a Civil Defense state of emergency is authorized pursuant to Chapters 127A, Hawaii
Revised Statutes, as amended, and Chapter 7, Hawaii County Code; and
WHEREAS, the danger of disaster is of such magnitude to warrant protective action in
order to provide for the health, safety, welfare and protection of the people and pursuant to
Section 127A -13(b)(4) Hawai'i Revised Statutes, the Mayor finds it necessary to appropriate
actions to direct and control the mandatory evacuation of the civilian population.
NOW, THEREFORE, I, MITCHELL D. ROTH, Mayor of the County of Hawaii, do
hereby proclaim and declare that a state of emergency exists due to the threat of imminent
disaster on Hawaii Island, effective August 1, 2021, 12:00 p.m. Hawaii standard time and I
County of Hawaii is an Equal Opportunity Provider and Employer.
hereby issue a First Supplemental Emergency Proclamation and Mandatory Evacuation Order
and I hereby ORDER the mandatory evacuation of all civilians and businesses from the
Waikoloa Village area as shown in the attached Exhibit "A". All of the provisions of my
Emergency Proclamation and Mandatory Evacuation Order on July 31, 2021 shall remain in full
force and effect and are hereby included in the provisions of this First Supplemental Emergency
Proclamation and Evacuation Order.
This ORDER is effective at 12:00 p.m., this 1 st day of August, 2021 and shall continue in
full force and effect until further act by this office. All persons must evacuate the Waikoloa
Village area as shown in the attached Exhibit "A" immediately from the effective date and time
of this ORDER.
IN WITNESS WHEREOF, I have hereunto set my hand and caused the Seal of the
County of Hawaii to be affixed. Done this 1st day of August, 2021 in Hilo, Hawaii.
