ELEVENTH SUPPLEMENTARY EMERGENCY PROCLAMATION
WHEREAS, Chapter 127A Hawaii Revised Statutes, provides for the establishment of
emergency management and disaster relief, including the Mayor having direct responsibility and
authority over emergency management within the County; and
WHEREAS, Chapter 127A Hawaii Revised Statutes and Chapter 7, Articles 1 and 2 of
the Hawaii County Code, establishes a Civil Defense Agency within the County of Hawaii and
prescribes its powers, duties, and responsibilities, and Section 13-23 of the Hawaii County
Charter empowers the Mayor of the County to declare emergencies; and
WHEREAS, on February 28, 2020, the Mayor of the County of Hawaii issued an
Emergency Proclamation declaring a state of emergency due to the outbreak of COVID-19 being
recognized as a public health emergency of international concern and a public health emergency
for the United States; and
WHEREAS, on March 4, 2020, the Governor of the State of Hawaii issued a
Proclamation declaring a state of emergency based upon the actions and directives of the
President of the United States, the World Health Organization, the United States Centers for
Disease Control and Prevention, and current conditions warranting preemptive and protective
actions related to the outbreak of COVID-19; and
WHEREAS, the Governor of the State of Hawaii has issued twenty-four Emergency
Proclamations related to the COVID-19 Emergency as of October 1, 2021, and
WHEREAS, since February,28, 2020, the Mayor of the County of Hawaii has issued ten
Emergency Proclamations, eighteen Emergency Rules, eight Amendments and three extensions
to those Rules related to COVID-19 as of October 1, 2021; and
WHEREAS, COVID-19 continues to endanger the health, safety, and welfare of the
people of the County of Hawaii and a response requires the serious attention, effort and sacrifice
of all people in the County of Hawaii to avert unmanageable strains on our healthcare system
and other catastrophic impacts to the County of Hawaii; and
WHEREAS, since, there has been an alarming increase in the spread of COVID-19
which is primarily.related to the DELTA variant of COVID-19. The dramatic increase: in
community spread of COVID-19 has resulted in increased hospitalization and strained

health care resources, including utilization of all ICU hospital beds on island. Without
immediate action, the County of Hawaii is unable to meet urgent health care needs of our
island community. As a result, it has become necessary to re -implement more stringent
restrictions in order to reduce the threat of spread and enable our health care resources to
meet urgent health care needs attributable to the spread of COVID-19; and
WHEREAS, due to the possibility of imminent emergency or disaster due to bodily
injury to residents of the County of Hawai'i, and the need for government agencies and
representatives from the private sector to mobilize and provide financial and other immediate
services to our island residents, a state of emergency is authorized pursuant to Chapter 127A
Hawaii Revised Statutes, and Chapter 7, Hawai'i County Code.
NOW, THEREFORE, I, MITCHELL D. ROTH, Mayor of the County of Hawati'i, do
hereby proclaim and declare that a state of emergency continues to exists due to the imminent
danger or threat of emergency on Hawaii Island from the COVID-19 pandemic.
This Eleventh Supplementary Emergency Proclamation shall be effective October 4,
2021, continuing thereon until December 3, 2021, unless terminated or superseded by a separate
proclamation, whichever shall occur first.
IN WITNESS WHEREOF, I have hereunto set my hand and caused the Seal of the
County of Hawaii to be affixed. Done this 30`h day of September, 2021 in Hilo, Hawaii.
