AGENDA
NOTICE IS HEREBY GIVEN of the following matters to be considered by the Windward
Planning Commission of the County of Hawaii in accordance with the provisions of Chapters 91
and 92, Hawaii Revised Statutes, Section 6-7.5(a) of the Charter of the County of Hawaii; and
Planning Commission Rules of Practice and Procedure.
NOTE: Pursuant to Act 220, Session Laws of Hawaii 2021,which amended the Sunshine Law
to allow meetings to be remotely conducted online, effective January 1, 2022, Windward
Planning Commission meetings will be held online, and the location listed below is open to the
public to provide testimony. The Windward Planning Commission meeting can be viewed live
online or at location listed below. Minutes of the Windward Planning Commission meeting will
be transcribed and posted on the Planning Department's website. Pursuant to the Governor's
Emergency Proclamation Related to Sunshine Law In-Person Meetings dated December 29,
2021, the requirement to have at least one in-person meeting location has been suspended
through February 28, 2022. No in-person meeting location will be provided during this time
period, unless the suspension is earlier terminated or superseded by a separate proclamation.

1. INITIATOR: PLANNING DIRECTOR(ELLIS JACOB HESTER TRUST)
(REZ 1052/PL-PDI-2021-000002)
The Planning Director has initiated the repeal of Change of Zone Ordinance No. 04 120 and
amendment to Section 25-8-28 (Ka`u District Zone Map), Chapter 25, Article 8, of the
Hawaii County Code 1983 (2016 edition, as amended),by reverting the current zoning of
the subject properties from Agricultural Project District(APD)to their original Agricultural
20-acres (A20-a) zoning district for 171.782 acres of land. The rezone area consisting of two
(2)parcels is located at 96-3090 Meyer Road, approximately 1.5 miles northwest(mauka) of
Hawaii Belt Road, Palima&Pa`auau, Ka`u, Hawaii, TMKs: (3) 9-6-005:108 & (3) 9-6-
006:004.
2. APPLICANT: GARVIN & LAURA GOODE (PL-REZ-2021-000003)
Application for a Change of Zone from an Agricultural-20 acres (A-20a)to a Family
Agricultural-2 acres (FA-2a) zoning district for approximately 9.581 acres of land. The
subject property is located at 27-2365 Hawaii Belt Road, 300 feet west(mauka) of its
intersection with Kalaoa Camp Road, Portions of Aleamai & Kalaoa, South Hilo, Hawaii,
TMK: (3) 2-7-008:130.

Consideration and Adoption of Proposed Findings of Fact, Conclusions of Law and Decision
and Order for the denial of Special Permit No. PL-SPP-2021-000005 for the operation of a
self-storage and mailing service facility and related improvements on an approximately 1.64-
acre property in the State Land Use Agricultural District. The subject property is located at
16-308 `Ainaloa Boulevard in the Orchid Land Estates Subdivision, approximately 1 mile
southwest of its intersection with Kea`au-Pahoa Road, or Highway 130, directly across from
the `Ainaloa Longhouse complex, Orchidland Estates Subdivision, Kea`au, Hawaii, TMK:

March 3,by interactive video conference via Zoom and at the Aupuni Center Conference
Room.

Submitting Testimony Pursuant to Hawai`i County Planning Commission Rules of
Practice and Procedure (PC), Rule 1, General Rules, a person desiring to submit written
testimony shall indicate her/his name; address; and whether the testimony is on her/his behalf or
as a representative of an organization or individual. If testimony is being submitted on behalf of
an organization, documentation showing membership ratification should accompany the
testimony. Public testimony can be submitted by mail or email. Those submitting written
testimony by mail should provide one copy for distribution. Public testimony submitted by mail,
should be mailed to the Windward Planning Commission at the Planning Department office
addresses in Hilo and Kona listed below under Board Packet. Mailed testimony should be
provided at least one week prior to the hearing date to allow for mailing and thorough
Commission review. Public testimony that is submitted by email to
WPCtestimony@hawaiicounty.gov, should be submitted before 4:30 p.m. two (2)business days
prior to the Commission meeting. Additionally,pursuant to Rule 1, the Chairperson may limit
testimony that is irrelevant or unduly repetitious.
Notice to Lobbyists: If you are a lobbyist, you must register with the Hawaii County
Clerk within five days of becoming a lobbyist {Article 15, Section 2-91.3(b), Hawaii County
Code}. A lobbyist means "any individual engaged for pay or other consideration who spends
more than five hours in any month or$275 in any six-month period for the purpose of attempting

to influence legislative or administrative action by communicating or urging others to
communicate with public officials." {Article 15, Section 2-91.3(a)(6), Hawaii County Code}
Registration forms and expenditure report documents are available at the Office of the County
Clerk, 25 Aupuni Street, Room 1402, Hilo, Hawaii 96720.
Board Packet. Pursuant to Hawaii Revised Statutes Section 92-7.5, the board packet
provided to members of this board for this meeting is available for public inspection during
regular business hours at the Hilo office of the Planning Department, Aupuni Center, 101 Pauahi
Street, Suite 3, Hilo, Hawaii and at the Kona office of the Planning Department, West Hawaii
Civic Center, 74-5044 Ane Keohokalole Highway, Building E, 2nd Floor, Kailua-Kona,
Hawai`i.
Anyone who requires an auxiliary aid or service, other reasonable modification, or language

as possible, but no later than five working days prior to the meeting date, to arrange for
