Prior to issuance of Final Subdivision Approval, the Applicant shall designate, in writing, which lot within the proposed subdivision will be assigned each of the existing service meters and construct necessary water improvements, which shall include but not be limited to [' ] relocation and adjustment of the Department of Water Supply's affected water system facilities, should they be necessary. The Applicant shall implement any improvements required by the Fire Department and/or Department of Water Suply to ensure that fire protection requirements are met. H. [ t4e stibjeet pr-epet4y, a qualified bieiegist shall stwvey t4e area te eiisttr-e iie Hawaiian Hawk rests are r,-oso„* ] To protect any Hawaiian hawks (`Io) in the vicinity of the property, clearing, grubbing and construction activities shall not occur in the rezone area during hawk breeding season of March 1 to September 30 without first having a qualified biologist conduct surveys for hawk nests in the project footprint and surrounding areas reas and coordinating with US Fish and Wildlife Service if nests are found. Additionally, no clearing or construction activities shall occur within 1,600 feet of any active Hawaiian hawk nest during the breeding season until the young have fledged. Finally, regardless of the time of year, no trimming or cutting of trees containing a hawk nest shall occur, as nests may be re-used during consecutive breeding seasons. I. To protect Blackburn's Sphinx Moth(BSM) contact DLNR, Division of Forestry and Wildlife (DOFAW)to determine whether a vegetation survey should be conducted. To avoid harm to the BSM, if tree tobacco plants are to be removed, remove plants less than one meter in height or during the dry time of the year. If removing tree tobacco plants or disturbing the ground around these plants,they must be checked thoroughly for the presence of eggs and larvae. -2-
