Command Deputy Managing Director AT VAIUUN lafPafuavi ftfirr of f4�4ffnpr 25 Aupuni Street, Suite 2603 a Hilo, Hawai'i 96720 • (808) 961-8211 • Fax (808) 961-6553 KONA: 74-5044 Ane Keohokalole Hwy., Bldg C • Kailua-Kona, Hawaii 96740 (808) 323-4444 9 Fax (808) 323-4440 THIRTEENTH SUPPLEMENTARY EMERGENCY PROCLAMATION WHEREAS, Chapter 127A Hawaii Revised Statutes, provides for the establishment of emergency management and disaster relief, including the Mayor having direct responsibility and authority over emergency management within the County; and WHEREAS, Chapter 127A Hawaii Revised Statutes and Chapter 7, Articles 1 and 2 of the Hawaii County Code, establishes a Civil Defense Agency within the County of Hawaii and prescribes its powers, duties, and responsibilities, and Section 13-23 of the Hawaii County Charter empowers the Mayor of the County to declare emergencies; and WHEREAS, on February 28, 2020, the Mayor of the County of Hawaii issued an Emergency Proclamation declaring a state of emergency due to the outbreak of COVID-19 being recognized as a public health emergency of international concern and a public health emergency for the United States; and WHEREAS, on March 4, 2020, the Governor of the State of Hawaii issued a Proclamation declaring a state of emergency based upon the actions and directives of the President of the United States, the World Health Organization, the United States Centers for Disease Control and Prevention, and current conditions warranting preemptive and protective actions related to the outbreak of COVID-19; and WHEREAS, since March 4, 2020, the Governor of the State of Hawaii has issued multiple Emergency Proclamations related to COVID-19; and WHEREAS, since November 30, 2021, the Mayor of the County of Hawaii :has issued twelve Emergency Proclamations, and as of January 26, 2022, he has also issued twenty Emergency Rules, eleven Amendments and three extensions to those Rules related to COVID- 19; and WHEREAS, COVID-19 continues to endanger the health, safety, and welfare of the people of the County of Hawaii and a response requires the serious attention, effort and sacrifice of all people in the County of Hawaii to avert unmanageable strains on our healthcare system and other catastrophic impacts to the County of Hawaii; and WHEREAS, since its identification in November 2021, the Omicron variant of COVID- 19 has caused a significant increase in the number of cases worldwide. As of January 24, 2022, County of Hawaii is an Equal Opportunity Provider and Employer. the seven-day average of COVID-19 cases on Hawaii Island is 434 and the community spread of COVID-19 has resulted in increased hospitalization and strained health care resources, including utilization of the limited number of ICU hospital beds on island. Without immediate action, the County of Hawaii is unable to meet urgent health care needs of our island community. As a result, it is necessary to continue restrictions in order to reduce the threat of spread of COVID-19 and enable our health care resources to meet urgent health care needs attributable to COVID-19; and WHEREAS, due to the possibility of imminent emergency or disaster due to bodily injury to residents of the County of Hawaii, and the need for government agencies and representatives from the private sector to mobilize and provide financial and other immediate services to our island residents, a state of emergency is authorized pursuant to Chapter 127A Hawaii Revised Statutes, and Chapter 7, Hawai`i County Code. NOW, THEREFORE, I, MITCHELL D. ROTH, Mayor of the County of Hawaii, do hereby proclaim and declare that a state of emergency continues to exist due to the imminent danger or threat of emergency on Hawaii Island from the COVID-19 pandemic. This Thirteenth Supplementary Emergency Proclamation shall be effective January 26, 2022, continuing thereon until March 26, 2022, unless terminated or superseded by a. separate proclamation, whichever shall occur first.
