AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 4., OF THE HAWAII COUNTY CODE 1983 (2016 EDITION, AS AMENDED), BY ADDING A NEW SECTION RELATING TO FISCAL IMPACT STATEMENTS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Chapter 2, article 4, of the Hawaii County Code 1983 (2016 Edition, as amended), is amended by adding a new section to be appropriately designated and to read as follows: Section 2- . Fiscal impact statements. a) "Fiscal impact statement" means a concise assessment of the immediate and potential future effects a proposed ordinance may have on revenues, expenditures, taxes, and fiscal liabilities. b) A fiscal impact statement for a proposed ordinance that affects the revenues, expenditures, taxes, and fiscal liabilities ofthe County may be initiated by the director of finance at any time, or upon a council member's written request submitted to the director of finance no later than 4:30 p.m. on the date ofthe first required council reading of the proposed ordinance. The director of finance shall submit the fiscal impact statement to the council no later than noon on the business day prior to the second required council reading. Nothing in this section shall be construed to limit the ability of the council to act on a proposed ordinance in' the absence of a requested fiscal impact statement. c) This section shall not apply try proposed ordinance to amend the Hawaii County Charter or to establish the operating budget or capital budget for the following fiscal year." SECTION 2. New material is underscored. In printing this ordinance, the underscoring need not be included. SECTION 3. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable.
