HEARING TRANSCRIPT
FEBRUARY 1, 2008
A regularly advertised hearing on the PLANNING DIRECTOR’S AMENDMENT TO
CHAPTER 2, ARTICLE 7, HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED)
REGARDING COMMUNITY DEVELOPMENT PLAN OR AMENDMENT THEREOF was
called to order at 9:47 a.m. in the County of Hawaii, Aupuni Center Conference Room, 101
Pauahi Street, Hilo, Hawaii, with Chairman Rodney Watanabe presiding.

INITIATOR: PLANNING DIRECTOR
Amendment to Chapter 2, Article 7, Hawaii County Code 1983 (2005 Edition, as amended)
relating to the Planning Commission’s review of a draft community development plan or
amendment thereof. The purpose of the amendment is to provide a time frame for the Planning
Commission’s review and recommendation to the County Council on a draft Community
Development Plan or amendment.
WATANABE: Item 3 is initiated by the Planning Director, Amendment to Chapter 2,
Article 7, Hawaii County Code 1983 (2005 Edition, as amended). And I guess we would call
upon the Director to provide the explanation to that. Or are you going to provide it?
DARROW: Not No. 3.
WATANABE: By the way, this is the first reading so we’re not going to take action on
this. Am I correct?
YUEN: Agenda Item No. 3 is an amendment to, actually it’s to Chapter 2 of the
County Code which contains some general procedural rules. And the purpose of this is to set a

timeframe for the Planning Commission’s review of a community development plan. We have a
number of community development plans in the works. They are being, there are at different
stages. But what happens with them is they’ll be, the draft plan will be reviewed and has to be
approved by the community development plan steering committee. Then it comes up to the
Planning Commission for its review; and then it goes to the County Council. And either way it
will come out of the Planning Commission with a favorable or unfavorable recommendation
from the Commission. The County Council has the final say on it. As you know from other
actions, all of the things that you review where you have a recommendation have timetables on
that. So a change of zone you’re supposed to act within a certain period of time. A General Plan
Amendment you’re supposed to act within a certain period of time.
There was never anything for the Community Development Plan. So it wasn’t clear what
happens if it comes to your agenda and say there’s a 4-4 vote. Does it get deferred to another
meeting, does it keep getting deferred if we don’t have a full enough membership to come to a
majority of the full membership on the community development plan? So in order to look ahead
and set a timeframe, we basically followed the timeframe that the Commission has for a General
Plan Amendment or, and being that that’s also a fairly serious matter. And so the idea behind
this is to set a timeframe. And if the Commission is unable to garner five votes, favorable or
unfavorable, on the Community Development Plan, then it would still go up to the Council at the
end of that time period.
WATANABE: Thank you, Mr. Director. Do we have any questions for the Director on
this? This is the first reading so we will be hearing this again in West Hawaii?
YUEN: Yes. We’ll take this to the next meeting in Kona and then ask you to take
a vote on it. But we’re here for any kind of questions, discussions, public testimony on this.
WATANABE: Okay. At this point I have no one signed up to testify. Is there anyone in
the audience who would like to testify on this issue? So then I guess we -. Do we take a vote to
continue this?
TORIGOE: You can take a vote on this or doing a consensus -.
WATANABE: Okay, shall we then by consensus elect to continue this to the next West
Hawaii meeting? Mr. Alameda, yes -?
ALAMEDA: I just, I like it. I think it’s thinking ahead. And if I need to make a motion
to defer it to the next meeting I’ll do so. But if you want to call consensus that’s fine, too?
WATANABE: Okay, by consensus is fine. Okay, all those in favor?
COMMISSIONERS: Aye.
WATANABE: Any opposed? Okay, then the matter is continued to our next West
Hawaii meeting.
