A RESOLUTION ACCEPTING THE DEDICATION OF LOT 2, HOKULI`A PHASE 3
EAST, PART B LARGE LOT SUBDIVISION, IDENTIFIED AS TMK NO. (3) 8-1-
036:002, SITUATED ALONG THE SOUTHERLY SIDE OF HALEKI`I AND KE`EKE`E
1ST, DISTRICT OF SOUTH KONA, ISLAND AND COUNTY OF HAWAII, STATE OF
HAWAII, FROM 1250 OCEANSIDE, LLC,A DELAWARE LIMITED LIABILITY
COMPANY.
WHEREAS, 1250 Oceanside, LLC, a Delaware limited liability company("1250
Oceanside"), is the owner of Lot 2, Hokuli`a Phase 3 East, Part B Large Lot Subdivision,
containing an area of 2.273 acres, identified as Tax Map Key(3) 8-1-036:002, situated along the
southerly side of Haleki i Street at Haleki i and Ke eke e 1st, District of South Kona, Island and
County of Hawai`i, State of Hawai`i,more particularly described in Exhibit A attached hereto
and as shown on the map attached hereto as Exhibit B ("Lot 2"); and
WHEREAS, Condition N of Ordinance 96-08 requires that 1250 Oceanside provide two
acres of land abutting the north side of Kona Scenic Park for public purposes prior to Final
Subdivision Approval of the subject property; and
WHEREAS, 1250 Oceanside is desirous of dedicating Lot 2, including all improvements
thereon, to the County of Hawai'i for park purposes; and
WHEREAS, Pursuant to Hawai`i County Code Section 2-162.1, the County of Hawai`i
Planning Department, Department of Public Works, Department of Parks and Recreation,
Department of Water Supply and the Department of Environmental Management have been
consulted, performed necessary inspections, and recommend approval and acceptance of this
dedication; and
WHEREAS, Article XIII, Section 13-12 of the Hawai`i County Charter, provides that
the council, on behalf of the county, may accept gifts of donations ofmoney, securities, or other
personal property or of real estate or any interest in real estate; now therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that it
finds that it is in the public interest to accept this dedication of land as described herein.
BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII, in accordance with Article XIII, Section 13-12 of the Hawai`i County Charter, and
Section 2-162.1 of the Hawai`i County Code, that the County of Hawai`i accept the dedication of
Lot 2, identified as Tax Map Key: (3) 8-1-036-002, delineated on Exhibit A and Exhibit B
attached hereto, including all improvements thereon, for public purposes.
BE IT FINALLY RESOLVED that a copy of this resolution be forwarded to:
1) Mayor Harry Kim; (2) the Department of Parks and Recreation; (3) the Department of Public
Works; (4) the Planning Department; (5) the Department of Water Supply; (6) the Department of
Environmental Management; (7) J Yoshimoto, Deputy Corporation Counsel, Office of the
Corporation Counsel; and (8) Carlsmith, Ball, LLP, Attn: Jason K. Knable, P.O. Box 686, Hilo,
Hawaii 96720.

Being portions of:

OHAU" being 1,912.61 feet North and 8,234.61 feet East and running by azimuths measured
clockwise from True South:
