RESOLUTION NO. 657 20
A RESOLUTION ACCEPTING THE GRANT OF EASEMENTS 9-1B FOR ROAD AND
UTILITY PURPOSES,AND 9-1H FOR BUS STOP AND SHELTER PURPOSES, BOTH
AFFECTING TMK: (3) 1-5-007:069 (POR.), SITUATED AT KEONEPOKO-IKI,
DISTRICT OF PUNA, ISLAND AND COUNTY OF HAWAII, STATE OF HAWAII,
FROM WILLOW PLAZA, L.L.C., A MISSOURI LIMITED LIABILITY COMPANY.
WHEREAS, Willow Plaza, L.L.C., a Missouri limited liability company (hereinafter,
Willow Plaza), is the fee owner of real property situate at Keonepoko-Iki, District of Puna, Island
and County of Hawai`i, State of Hawai`i, identified as TMK: (3) 1-5-007:069 (por.); and
WHEREAS, Willow Plaza, agrees, at no cost to the County, to grant Easement 9-1B for
road and utility purposes, and Easement 9-1H for bus stop and shelter purposes, both easements
affecting TMK: (3) 1-5-007:069 (por.), as described in Exhibit "A" and delineated on Exhibit
B", which are attached hereto and made a part hereof; and
WHEREAS, Article XIII, Section 13-12 of the Hawai`i County Charter provides that the
Council may accept gifts, including real estate or any interest in real estate, on behalf of the
County of Hawai`i; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in
accordance with Article XIII, Section 13-12 of the Hawai`i County Charter, the County of
Hawai`i accepts the easements described in Exhibit "A" and delineated on Exhibit "B" attached
hereto, for road and utility, and bus stop and shelter purposes, from Willow Plaza.
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this
resolution to: (1) the Honorable Harry Kim, Mayor of the County of Hawai`i; (2) the
Department of Public Works: (3) Deputy Corporation Counsel Danny Patel; and (4) Carlsmith
Ball LLP, Attn: Kathy Garson, 121 Waianuenue Avenue, Hilo, Hawaii 96720.

EASEMENT 9-18
For Road and Utility Purposes
Affecting Lot 9-1
Being a Portion ofGrant 4953 to Henry J.Lyman ofKeonepoko Homestead Lots
Situated at Keonepoko-Iki,Puna,Island ofHawaii,Hawaii
Beginning at the northwest corner ofthis easement parcel,also being the northwest corner of Lot
9-1,the coordinates of said point ofbeginning referred to Government Survey Triangulation
Station"PAHOA"being 280.79 feet North and 371.49 feet West and running by azimuths
measured clockwise from True South:
1. 250° 34' 811.13 feet along a Government Road Reserve;
2. 338° 34' 6.15 feet along Lot 9-2;
3. Thence along curve to the left having a radius of21.00 feet,the chord azimuth and
distance being:
80° 05' 29.5" 6.95 feet;
4. 70° 34' 803.46 feet;
5. 148° 50' 5,11 feet along Government Land to the point of beginning and
containing an area of0.093 acre.

Situated at Keonepoko-lki.Puna, Island of Hawaii,Hawaii
Beginning at the south corner of this easement parcel,the true azimuth traverse from the
southeast corner of Lot 9-1 being 158° 34' 420.47 feet to the said point of beginning,
the coordinates ofsaid point ofbeginning referred to Government Survey Triangulation Station
PAHOA"being 388.03 feet North and 471.73 feet East and running by azimuths measured
clockwise from True South:
