NOTE: Pursuant to Act 220, Session Laws of Hawaii 2021, effective January 1, 2022, Windward Planning Commission meetings will be held online, and the location listed below is open to the public to provide testimony. Thus,the Windward Planning Commission meeting can be viewed live online or at the location listed below. Minutes of the Windward Planning Commission meeting will be transcribed and posted on the Planning Department's website. DATE: Thursday,April 7,2022 TIME: 9:00 a.m. LOCATION: County of Hawaii Aupuni Center Conference Room 101 Pauahi Street,Hilo,HI 96720 INTERACTIVE CONFERENCE TECHNOLOGY (ICT): This meeting will be held by interactive conference technology (ICT) through Zoom. The public may provide oral testimony at the meeting by joining online or calling into the Zoom meeting. CALL TO ORDER APPROVAL OF MINUTES Review and Approval of the March 3, 2022 Windward Planning Commission Minutes. STATEMENTS FROM THE PUBLIC ON AGENDA ITEMS NEW BUSINESS 1. APPLICANT: HOLCOMB FAMILY TRUST (PL-SMA-2021-000007) Application for a Special Management Area (SMA)Use Permit to construct a single- story, 3,018-square foot, 3-bedroom, 3.5-bath single-family residence and related improvements which include a swimming pool, garage, lanai, and a utilities room on 6.485 acres of land situated within the SMA. The subject property is located at 28-3426 Hawai`i Belt Road(Highway 19), on the makai side of the highway approximately 0.5 miles south of its intersection with Honomu Road,por. of Kaakepa-Malamalama W, South Hilo, Hawaii, TMK: (3) 2-8-012:028. AGENDA ITEMS FOR NEXT MEETING ANNOUNCEMENTS The Windward Planning Commission's next monthly meeting is scheduled for Thursday, May 5, 2022 by interactive video conference via Zoom and at the Aupuni Center Conference Room. ADJOURNMENT Submitting Testimony The public may provide written testimony via email at WPCtestimony@hawaiicounty.gov or submit by mail or in person at the Hilo Planning office at 101 Pauahi Street, Suite 3, Hilo, Hawaii 96720 or at the Kona Planning office at West Hawaii Civic Center, 74-5044 Ane Keohokalole Highway, Building E, 2nd Floor, Kailua-Kona, Hawaii up to two business days prior to the hearing by 4:30 p.m. Pursuant to Hawaii County Planning Commission Rules of Practice and Procedure (PC), Rule 1, General Rules, a person desiring to submit written testimony shall indicate her/his name; address; and whether the testimony is on her/his behalf or as a representative of an organization or individual. If testimony is being submitted on behalf of an organization, documentation showing membership ratification should accompany the testimony. Public testimony can be submitted by mail or email. Those 2 submitting written testimony by mail should provide one copy for distribution. Mailed testimony should be provided at least one week prior to the hearing date to allow for mailing and thorough Commission review. Additionally,pursuant to Rule 1, the Chairperson may limit testimony that is irrelevant or unduly repetitious. Contested Case Procedure: Pursuant to Rule 4, Contested Case Procedure, of the County of Hawaii Planning Commission Rules of Practice and Procedure, any person seeking to intervene as a party to a contested case hearing on Agenda Item No. 1 above is required to file a written request which must be received in the office of the Planning Department no later than seven (7) calendar days prior to the Planning Commission's first public meeting on the matter. Such written request shall be in conformity with Rule 4, in a form as provided by the Planning Department entitled"Petition for Standing in a Contested Case Hearing." The written petition/request shall be filed with the Planning Commission at Aupuni Center, 101 Pauahi Street, Suite 3, Hilo, Hawaii 96720, and accompanied by a filing fee of$200 payable to the Director of Finance. Any party may retain counsel if that person so desires. Rule 4 may be inspected or purchased ($2.50) at the above-cited location. Rule 4 may also be viewed at the County of Hawaii Planning Department website under Resources and References (http://www.planning.hawaiicounty.gov). Notice to Lobbyists: If you are a lobbyist,you must register with the Hawaii County Clerk within five days of becoming a lobbyist {Article 15, Section 2-91.3(b), Hawaii County Code}. A lobbyist means "any individual engaged for pay or other consideration who spends more than five hours in any month or$275 in any six-month period for the purpose of attempting to influence legislative or administrative action by communicating or urging others to communicate with public officials." (Article 15, Section 2-91.3(a)(6), Hawaii County Code} Registration forms and expenditure report documents are available at the Office of the County Clerk, 25 Aupuni Street, Room 1402, Hilo, Hawaii 96720.
