I. Call To Order
The meeting was called to order by Chair Onizuka at 10:01 A.M., via WebEx
(tele/video conferencing).
The following were present and constituted a quorum:

Onizuka: I'd like to call this meeting of the Hawaii County Department of Liquor
Control, Liquor Commission meeting to order. The time now is 10:01 A.M. My name
is Claude Onizuka. I am the Chairman of the Commission. For everyone participating,
please set your device microphones to mute. We are conducting this meeting virtually via
WebEx. Some of you have both audio and video. Some of you only have audio.
We are recording this meeting so please remember a couple of things: 1) speak one
at a time so that the recording remains clear; 2) if you want to speak, unmute your
microphone, state your name, proceed with your statement/question, and when done
speaking, mute your microphone.
We will now do a roll call to determine who is present for this meeting. Please say present

Corporation Counsel.

II. Approval of Minutes (10:05 A.M.)

via email/mail on November 20, 2020.

Onizuka: Due to the COVID-19 pandemic and the Governor's orders to stay at home
and practice social distancing, the public was informed that public testimony may
be submitted in writing by email or fax by noon of Wednesday, December 2, 2020. All
written testimony, regardless of time of receipt, will be made a part of the permanent
record for each application. Do any members of the public wish to make any statements

Hurt: I'm going to have a retail beer and wine store. Pretty straight forward, wine, beer,
seltzers, things like that. I want to eventually have a growler fill station for draft beer;
but, I have a little hiccup on that with the health department. So for now, just the bottled
product.

Takase: Mr. Chairman, the applicant mailed 11 out of 11 notices within 100 feet, and
62 out of 63 notices within 500 feet. There were 57 properties entitled to protest and
we received no protests to this application.

application?
Fuentes: I believe we brought this up last time, but I want to make sure that the closing
time is stated as 2:00 A.M.

Fuentes: It's going to be a casual dining restaurant on the water with the primary focus
on hamburgers, pizza, and tacos.
Onizuka: Thank you. Mr. Director, any report of protests?
Takase: Mr. Chairman, the applicant mailed 291 out of 294 notices within 100 feet and
443 out of 447 notices within 500 feet, and 3 notices to condominium or cooperative
apartment managers. There were 300 properties entitled to protest and we received
no protests to this application.
Onizuka: Thank you. Do we have any public testimony on this application at this time?
There was no public testimony.
Onizuka: Hearing none, Commissioners, questions, or discussion?
Takase: Mr. Chairman, I have a question for Jose. Where do you plan to have your
entertainment? Is it in the bar area or is it outside on the lanai?
Fuentes: It's going to be on the back lanai. If you were to walk into the restaurant, it's
the one that's farthest away from the street. It's a little lanai where the bar would be, but
again, furthest from the street.
Takase: So it would play back into the restaurant?
Fuentes: Yes, sir.
Takase: Okay, thank you.
Fuentes: Yes, sir.
Onizuka: One question, what time does your entertainment stop?
Fuentes: Entertainment would stop at 2:00 A.M. at the latest; but typically, it would
probably stop at 10:00 P.M. For permit purposes, we'd like to have it until 2:00 A.M.
Onizuka: We received a lot of complaints in that area if you go past 10:00.
Fuentes: Yes, we have Huggo's as well, so we're well aware. We have decibel
readers fully prepared. I think (if we run) that late, it'd obviously be a special occasion,
and typically, wouldn't go very late.

area.

D. Pannell: Yes. It's a full-service restaurant and bar.

Takase: Mr. Chairman, the applicant mailed 1 out of 1 notices within 100 feet and
14 out of 14 notices within 500 feet. There were 14 properties entitled to protest this
application and there were no protests to the application.
Onizuka: Thank you. Do we have any public testimony on this application at this time?
There was no public testimony.
Onizuka: Hearing none, Commissioners, questions, or discussion?
Greenwell: Chairman Onizuka, I'd like to ask Director Takase a question.
Onizuka: Go ahead.
Greenwell: Gerald, we have about three different things going on, on the agenda for
this applicant. Can you iron out exactly what's happening?
Takase: Okay, yes. The first action that needs to be taken is a sale and transfer
to Kail-oki's. Since it's a sale and transfer, it has to come across "as is," a Dispenser
General. In the application process, and I believe the Pannells said they're open now,
they wanted to do several things. That's the other two actions. The second action
is approving an outdoor seating area, which is in front of their shop. The third action
would be entertainment. We've temporarily allowed them to do live entertainment
outside until 9:00 P.M., but they are requesting permanent entertainment to be added
to their license, as well.
Greenwell: Does New Business Item 10 overrule Item 9?
Takase: A couple of weeks ago, they had asked if they could have entertainment
on Saturday nights from 6:00 to 9:00, or 3:00...
D. Pannell: Four to nine.
Takase: ...or 4:00 to 9:00. We had approved that, but they came back and asked
if they can get it until midnight. I said I'd let it come before the Commission to make
a decision on that. Not that we had anything against it, but since it was coming up for
a hearing, I felt it would be better to be brought before the Commission. That is why
there are three actions.
Greenwell: So, as I said, doesn't Item 10 nullify Item 9?
Takase: Yes, sort of. If you go to midnight, then we don't need the 9:00 one. Nine
o'clock is just a ratification of what was already done. It doesn't nullify it because you're
just ratifying what I had already approved earlier. But, they're asking for it to be allowed
permanently, after this. So, (Item) 9 was for past actions, and (Item) 10 is for future action.

D. Pannell: Full-service restaurant and bar.
Onizuka: Thank you. Do we have any public testimony at this time on this application?
There was no public testimony.
Onizuka: Hearing none, Commissioners, any questions or discussion?
Hughes: Just so I'm clear on this application, we would be approving or denying the
outdoor area where they're serving liquor?
Onizuka: Right.
Takase: Yes, that's correct. The reason is, when they came in on the original, they
didn't request the outside area, but as they operated, they found that they needed the
extra area. They have full control over that area, so I don't see it as a big problem. It's
just a timing problem because their notices had gone out by the time they figured out
that they wanted to do this. That's why we have this bifurcated licensing process.
Hughes: So this would be beyond a COVID-19 allowance?
Takase: Yes.
Hughes: Okay.
D. Pannell: If I'm not mistaken, I think February 3rd is when that final decision will be made?
Takase: February 4t". It'll probably still be on WebEx as we're doing now.
Onizuka: Any other discussion?

it until February 4th, until their next hearing?
Takase: You can. It falls in the middle of the week, so January 30th would be the last
Saturday before the next hearing. That's why we had January 31.

on November 21, 2020, to January 31, 2021, (Saturdays only) by changing the end time
from 9:00 P.M. to midnight.
Takase: Mr. Chairman, I will say that, though I haven't been out there for a while,
looking at the maps, there's not too much right around them. I don't know how much the
noise carries, but we will work with them if we receive noise complaints. Hopefully,
it won't be a problem, and they'll be well aware of that, as well.
D. Pannell: We have the music facing down toward the highway, too, so that kind of helps
for anything behind it.
Takase: Yes.

should be full notice to any other resident. There are not that many within the nearby
area. But, David, let me ask you this question. You already had entertainment a couple
of times, right?

Takase: Mr. Chairman, well, for those of you in Kona, you'll see that they've made quite
substantial progress. They're hoping to open within the month, but they've had some
delays in getting materials and things because of the current nature of business. It's just
a short increase in time. I met with the new owners last month and they're excited to get
it going soon. They've been doing test batches, and hope to come online...they were
hoping for Christmas, but it may be a little later. It's in this time frame.
Thomas: I have a question.

Thomas: Gerald, just in terms of the need for an extension, is the six months just
a minimal time period, or is it a fixed time period that you have to ask for? It's not like

months but they're requesting six months.

Hughes: Could the representative explain the process and what they're planning to do?
Ichikawa: Good morning, Commissioners, Chairman, and Gerald Takase. Robert Ichikawa,
representing Safeway, also Anthony Parker, Store Manager for Hilo. What it is, is a curbside
pick up concept. Because of the pandemic and safety concerns, it's become something
that's in demand. People can drive up, park in a designated stall, and pick up their
groceries. The transaction occurs online initially. It's directly between the customer and
Safeway on Safeway's system. The order is placed, then the Sales Associate who's
trained on this process will deliver the groceries to the car in the designated stall. Once
he approaches the customer, there is protocol that is set forth and they will go through
to properly identify the driver who is picking it up, to make sure that is indeed the customer
who made the order. They will also ID the individual, if liquor is being sold, request that
their mask be lowered so they could further identify the individual with the ID, and make
sure the purchase is being properly done by the customer.
Everything is checked on, somewhat similar to purchasing the liquor in the store, but it's
just outside by their vehicle. They will follow the same protocols. If everything is approved,
the Sales Associate will complete the transaction and put the groceries into the trunk.
That's generally the process they've been doing on the mainland and they would like
to do on the Big Island. Hilo first, and then Kona will open up on December 16th, so that
would be the next store. Anthony, you're free to add anything else that you'd like to tell the
Commission.
Parker: This is Anthony representing the Hilo Safeway store. I'd like to add that the
employee that will be approaching the customer will also be walking out there with a log
sheet. For every customer that they approach, the license will be logged as well, to help
track.
Ichikawa: I will add one other thing. In the event the sale cannot go through, whether
there's faulty identification or something that just doesn't sit right with the Associate,
there is a process to then take the groceries back, cancel out the sale of the liquor, and
complete the transaction with just the groceries, as well.

Onizuka: 13. COVID-19 Updates and Action. Mr. Director?
Takase: Mr. Chair, I'm happy to report that we are seeing most of the businesses
starting to open up again. I believe all of our hotels are online except for Four Seasons
which is looking at a January 1St reopening. They are all hopeful and we are hopeful
with them. For the past license years, we have collected all of our license fees and
my staff did a good job of seeing that everybody paid. We've had several closures
during the year, but as you can see, there are almost as many new licensees coming
in to take their place. We are doing pretty well. Hopefully, we weathered the worst

of it and we will make it through. We had about a ten percent reduction in sales through
the period that ended June 30th, and we'll probably see a similar reduction for at least
the first half of this year. It's a lot worse than we had been planning for. We're doing
a lot better than the other islands. Honolulu keeps calling and asking how we're doing.
You can see how they're doing on the news. Weekly, they keep going in and out of being
opened and closed. They are having a lot of problems.
Maui has also selected a new director who's Lane Silva. I don't believe I've met him
before, but he is the son of the retired director Frank Silva (two directors ago).
We haven't had the opportunity to meet him yet. Kauai is going through their selection
process as we speak and I don't know what they are going to do as of yet. That's all
I have on that subject. Are there any questions?

Vice Chairperson for the Liquor Commission for the year 2021. We'd like to take
nominations or volunteers if anybody would like. If not, the Chair would like to nominate
Mike Hughes as Chairperson for 2021, and Dawn Raymond as Vice Chairperson for
2021, unless someone else is interested.
Ibarra: I move to adopt the Chair's nominations.

Takase: Congratulations to both of you. We also have one other piece of business.
Although they are not going to be leaving us today, this is the last meeting for Claude
and David. They are not going to be leaving as yet, because we have no replacements
for them, so they can serve out until March. I wanted to thank both of them for their
time and efforts. They've done a great job for us, especially through these trying times.
I'm sorry we couldn't meet and at least say farewell to them properly, but, we'll get to see
you sometime. On Monday, the new Mayor will be sworn in. I had asked Mayor Kim's
administration to fill our vacancies since we have one on the Commission, currently; and,
one on the Board. They declined saying they were not going to do it, but leave it to the
next administration.
The next administration will have three slots to fill on the Commission: Claude's, which
is South Kona; Dave is Waimea; and also Shelby's position remains open from Hamakua.
On the Adjudication Board's side, we will have two openings: Geri Giffin's slot, which
is still open from last year; and Riley Smith's term will be ending at the end of the year,
as well. Hopefully, I will get to meet with the Mayor sometime in the next couple of weeks
and apprise him of our situation, and ask for their help in moving to fill those slots
so we don't get left shorthanded.
