was called to order at 9:50 a.m. in the King Kamehameha's Kona Beach
Hotel, Kamakahonu Ballroom, 75-5660 Palani Road, Kailua-Kona, Hawai‘i, with Chairman Fred
Galdones presiding.

APPLICANT: KIMI COOK WALLS AND ROBERT WALLS (REZ-04-032)
Application for a Change of Zone for 7.74 acres from an Agricultural 5-acre (A-5a) to a Family
Agricultural 3-acre (FA-3a) district. The property is located along the north side of Ala Kahua
Drive, approximately 2,000 feet from the Ala Kahua Drive – Akoni Pule Highway (Highway
st
270) intersection, Kohala Estates Subdivision, Kahua 1, North Kohala, Hawaii, Tax Map Key:
5-9-6:5
GALDONES:Commissioners, we received some communications this morning. You
should have it in a packet. There were about 3 different documents that was in- passed out to us.
Does the Commissioners need some time to review those documents so they can give their
proper attention, or are we ready to proceed?
SMITH:Ready to proceed.
GALDONES:Okay, seeing that the Commissioners are ready to proceed,
Commissioners, we are on agenda item number 1 under New Business. Applicants are Kimi
Cook Walls and Robert Walls (REZ 04-032). This is an application for a change of zone for
7.74 acres from an Agriculture 5-acre (A-5a) to a Family Agriculture 3 acre (FA-3a) district.

DARROW:Thank you, Mr. Chairman. If I may direct your attention to the location
map. The area of this application is within the North Kohala district of Hawai`i. This white line
running across the bottom of the map is the Akoni Pule Highway running in a north-south
direction. This way towards north Kohala and this way towards Kawaihae. The area more
specifically of this application is within the Kohala Estates Subdivision. The actual property is
identified with the right red dot located at this point. You would travel on- north on Akoni Pule
Highway, you would take a right onto Ala Kahua Drive and proceed approximately a half a mile,
and the property is located on the left side of the road almost directly across from the Pua Mau
Botanical Gardens that’s also located in the area.
The applicants in this case, Kimi Cook Walls and Robert Walls, are requesting a change of zone
for their property of 7.74 acres of land from an Agricultural-5 acre to a Family
Agricultural-3 acre zoned district. More specifically on the site plan if you were travelling from
the highway up you would come across the property on the left side of the road. On the property
there is a single family dwelling that’s located approximately in this area. The applicants are
going to be requesting to sub-, further subdivide this property if approved, be able to retain one
portion and sell the other with the property that has the single family dwelling. The Planning
Director is recommending that the Planning Commission send a favorable recommendation for
this application to the County Council. Are there any questions?
GALDONES:Commissioners, any questions of Mr. Darrow? Commissioner Springer?
SPRINGER:Thank you. Is the language that we’re working off of now from the newly
approved General Plan?
DARROW:At this point when we were working on this application we were working
actually from the previous General Plan.
SPRINGER:And the LUPAG maps also?
DARROW:Correct.
SPRINGER:Thank you.
GALDONES:Seeing no further questions from the Commissioners, will the applicant or
his representative please step forward. Good morning, Mr. Fuke. Could you please raise your
right hand? Do you swear or affirm to tell the truth on this matter now before the Hawai`i
County Planning Commission?
FUKE:I do.
GALDONES:If you could state your name and address please and you may proceed
with your testimony.
FUKE:Sure. Good morning, Mr. Chairman, members of the Commission. My
name is Sidney Fuke, I’m a planning consultant. I’m here assisting the applicants. The
applicants Mr. and Mrs. Walls are- are in the audience today. My business address is 100 Pauahi

Street, Hilo, Hawai`i. The applicants have had a chance to review the staff’s background report
and the proposed conditions and recommendations by the Planning Director and found them to
be acceptable. Relative to the specific question that Commissioner Springer raised- it’s my
understanding in reviewing the current general plan on the LUPAG Map, not necessarily the
policy portion- there was no change recommended for this area.
SPRINGER:Thank you.
GALDONES:Commissioners, any questions of Mr. Fuke? Commissioner Graham?
GRAHAM:I just- the only thing that kind of tickles my mind a little from past history
is that like 10 or 15 years ago, I remembered there was, when some of the more makai- on the
makai side of the street down there, you know, the high-priced developments were going in,
there was concern by Kohala Ranch folks about water commitments. You know, the water
comes from a private water source up there and I understand that, you know, these folks would
have a commitment for the water. Do you know of any update what the water situation in
general is like in that area?
FUKE:I don’t have any information, I’m sorry.
GRAHAM:Okay.
GALDONES:Any other questions from the Commissioners? Seeing none, is there
anyone here from the public to testify on this subject matter now before the Hawai`i County
Planning Commission? Seeing none, Mr. Fuke any closing statements?
FUKE:None.
GALDONES:Commissioners, it comes with the favorable recommendations from the
Director. What’s the pleasure of the Commissioners?
SPRINGER:Mr. Chair.
GALDONES:Commissioner Springer.
SPRINGER:I move to send a favorable recommendation to the County Council on
Kimi Cook-Walls and Robert Cook Walls (REZ 04-032), application for a change of zone for
7.74 acres from an Agricultural-5 acre to a Family Agricultural 3-acre district for the reasons and
with the conditions as recommended by the Planning Director.
SMITH:Second.
GALDONES:It has been moved by Commissioner Springer, seconded by Commissioner
Smith, that Kimi Cook Walls and Robert Walls change of zone application (REZ 04-032) be
given a favorable recommendation and forwarded to the County Council along with the
background report and the recommendations as stated. Discussion? Seeing none, Jeff.

SPRINGER:Yes.
DARROW:Commissioner Smith?
SMITH:Aye.
DARROW:Commissioner Alameda?
