Graham presiding. PRESENT:ABSENT & EXCUSED: Allen Salavea C. Kimo Alameda Hannah Springer Andrew Iwashita Fred Galdones Chris Yuen, Deputy Planning Director Norman Hayashi, Planning Program Manager Phyllis Fujimoto, Staff Planner JeffDarrow, Staff Planner Ivan Torigoe, Deputy Corporation Counsel And approximately 10 people from the public in attendance. Condition G: Any vehicular security gate shall be located beyond the turnaround meeting with the [approval of] Department of Public Works. Addition:Applicantshallmakeagoodfaitheffortstoobtainlegalaccesstothe County owned portion of Maliu Road from the State of Hawaii and from the owner of the adjoiningroadlot.Thesegoodfaitheffortsshallincludebutnotbelimitedtopaymentoffair market value for any easement and payment of any necessary expenses for new fence lines, surveysorotherreasonablemodifications.AccessshallbefromMaliuRoadunlessthePlanning Director determines that the applicant cannot secure access to Maliu Road despite reasonable goodfaithefforts.IfaccesscannotbeobtainedfromMaliuRoadaccessmaybeallowedfrom Akoni Pule Highway pursuant to condition I. The good faith effort shall continue for a period of not less than 2 years from the effective date of this ordinance. Condition F:The applicant shall provide a 5-foot wide future road widening setback along the entire property frontage of parcel 40, which shall be dedicated to the County on request. Condition I.There shall be no access to Akoni Pule Highway unless applicant is unable to obtain access from Maliu Road. If access is taken from Akoni Pule Highway it shall be limited to a single point and shall meet with the approval of the State Department of Transportation. IWASHITA:I move that a favorable recommendation be forwarded to the County Council for application for a change of zone docket number REZ 05-029 based on the Planning Director€s Recommendations and proposed conditions including the additional corrections and the condition the Director has indicated he will submit to address the access issue.
