Subject: Request for Consultation

Request: Amendments to Change of Zone Ordinance No. 09 8 and Special Management
Area Use Permit No. 07-024

At their meeting on April 21, 2022, the Leeward Planning Commission (LPC) deferred action on
the subject applications and requested that the Cultural Resources Commission be provided an
opportunity to review the proposed project to determine its impacts on the overall cultural
landscape and whether those impacts have been adequately minimized or mitigated.
The LPC specifically had questions about the level of consultation with lineal descendants in
planning the overall construction of the project; whether lineal descendant access issues had been
fully considered by the State Historic Preservation Division (SHPD) and resolved in the Burial
Treatment Plan; and whether additional lineal descendant access and open space requirements
should be proposed to mitigate or minimize project impacts on the overall cultural landscape.
The applicant, Hawaii Onel Investors, LLC, proposes to develop a 65-lot, single-family
residential subdivision and related improvements on the subject property. In order to facilitate this
proposed development, they are requesting the following amendments to Change of Zone
Ordinance No. 09 8, which rezoned the 11.05-acre subject property from an Agricultural 5-acres
(A-5a) to a Single-Family Residential-7,500 square feet (RS-7.5) zoned district:
■ A five (5)-year time extension to Condition E (Time to Secure Final Subdivision
Approval); and

■ An amendment Condition K (Drainage Improvements) to allow for the option of bonding
the drainage improvements or the use of other acceptable forms of surety in lieu of the
construction of drainage improvements, prior to the issuance of Final Subdivision
Approval.
In addition, the applicant is requesting a similar five (5)-year time extension to Condition 4
(Time to Secure Final Subdivision Approval) of SMA Use Permit No. 07-024, which was
approved to allow the development of a 65-lot, single-family residential subdivision and
related improvements on the subject property.
Based on the preceding and pursuant to Rule 4-3(b) — Commission Review of Proposed Projects
within the County of Hawaii of the CRC Rules of Practice and Procedure, we are requesting a
consultation with the CRC. To assist the CRC in their review, we are including a link to a folder
containing the application for amendments, and archaeological studies and approvals (e.g.,
Archaeological Inventory Survey, Archaeological Data Recovery Plan, Burial Treatment Plan, and
SHPD approval/acceptance letters). In addition, for context, we will include the Background and
Director's Recommendation Reports that were provided to the LPC. Those documents can be
