CALL TO ORDER APPROVAL OF MINUTES Review and Approval of the July 7, 2022 Windward Planning Commission Minutes. STATEMENTS FROM THE PUBLIC ON AGENDA ITEMS Members of the public may provide public testimony regarding any agenda item now or at the time the agenda item is called to order. NEW BUSINESS: 9:00 a.m. 1. APPLICANT: ERIC J. TROUTMAN (FORMERLY MATSUNO ENTERPRISES, LTD.) (PL-REZ-2022-000027) (AMEND REZ 1004) Application for an amendment to allow a five (5)-year time extension to perform Condition E (Development of the Property), delete Condition C (Final Consolidation Approval), amend Condition H (Remove Requirement of Speed Hump Installation), delete Condition I(Provide Updated TIAR), and amend Condition P (Reference to Amended Ordinance) of Change of Zone Ordinance No. 03 44 which rezoned approximately 6.64 acres of land from Single-Family Residential-10,000 Square Feet (RS-10)to General Commercial-20,000 Square Feet(CG-20). The subject property is located at the southeast corner of the intersection of Kanoelehua Avenue (Highway 11) and Puainako Street, Waiakea Homestead House Lots, South Hilo, Hawaii, TMK: (3) 2- 2-040:014. 2. APPLICANT: LEHUA VILLAGE PARTNERS,LLC (PL-PUD-2022-000001) Application for a Planned Unit Development(PUD) for a 40-lot, single-family residential subdivision on 14.322 acres of land. The PUD would allow various exceptions from Chapter 23 (Subdivision) and Chapter 25 (Zoning) of the Hawaii County Code. The subject properties straddle the east and west sides of Lehua Street, north (makai) of the Hawaii Belt Road and south (mauka) of the Honoka`a Park Complex,portion of Papa`anui & Haina, Hamakua, Hawaii, TMKs: (3) 4-5-024:010 & (3) 4-5-010:136. 4. APPLICANT: KEALOHA LANI LLC (FORMERLY HAWAII ISLAND DISTILLING LLC) (PL-REZ-2022-000023) (AMEND REZ 17-000218) Application for an amendment to Condition E (Timing of Fire Flow Improvements) and Condition I(Timing of Roadway Improvements) of Ordinance No. 17-65 which reclassified 6.505 acres of land from Agricultural-20 acres (A-20a)to General Industrial - 20,000 square feet(MG-20) zoned district. The applicant is requesting these amendments 2 to change the development trigger for these required improvements from prior to issuance of Certificate of Occupancy to prior to Final Subdivision Approval. The subject property is located east of Highway 11 (Volcano Highway), west of Railroad Avenue, and north of Highway 130 (Kea`au-Pahoa Highway), Kea`au, Puna, Hawaii, TMK: (3) 1-6-141:002. 5. APPLCANT: RENEGADE TOWERS LLC (PL-USE-2022-000004) Application for a Use Permit to allow the establishment of a telecommunication facility with a 180-foot-tall monopole tower and related equipment and improvements within a 4,108 square foot portion of a larger 14.622-acre parcel. The subject property is located at 3331 Kaumana Drive, to the south of the Nolemana Street/Kaumana Drive intersection, Kaumana and Ponahawai Homesteads, South Hilo, Hawaii, TMK: (3)2-5-002:023. ADJOURNMENT Submitting Testimony The public may provide written testimony via email at WPCtestimony@hawaiicounty.gov or submit by mail or in person at the Hilo Planning office at 101 Pauahi Street, Suite 3, Hilo, Hawaii 96720 or at the Kona Planning office at West Hawaii Civic Center, 74-5044 Ane Keohokalole Highway, Building E, 2nd Floor, Kailua-Kona, Hawaii 96740 up to two business days prior to the hearing by 4:30 p.m. Pursuant to Hawaii County Planning Commission Rules of Practice and Procedure (PC), Rule 1, General Rules, a person desiring to submit written testimony shall indicate her/his name; address; and whether the testimony is on her/his behalf or as a representative of an organization or individual. If testimony is being submitted on behalf of an organization, documentation showing membership ratification should accompany the testimony. Public testimony can be submitted by mail or email. Those submitting written testimony by mail should provide one copy for distribution. Mailed testimony should be provided at least one week prior to the hearing date to allow for mailing and thorough Commission review. Additionally,pursuant to Rule 1, the Chairperson may limit testimony that is irrelevant or unduly repetitious. Contested Case Procedure: Pursuant to PC Rule 4, Contested Case Procedure, of the County of Hawaii Planning Commission Rules of Practice and Procedure, any person seeking to intervene as a parry to a contested case hearing on Agenda Item Nos. 3 and 5 above is required to file a written request which must be received by the office of the Planning Department no later than seven (7) calendar days prior to the Planning Commission's first public meeting on the matter. Such written request shall conform with the PC Rule 4-6(a), relating to Prehearing 3 Procedure on a form as provided by the Planning Department entitled"Petition for Standing in a Contested Case Hearing." The notarized petition form and a filing fee of$200 shall be submitted online via County of Hawaii Electronic Processing and Information Center(EPIC) at the following website: https://hawaiicounlyhi-energovpub.lylerhost.net/Apps/SelfService#/home. Notice to Lobbyists: If you are a lobbyist, you must register with the Hawaii County Clerk within five days of becoming a lobbyist {Article 15, Section 2-91.3(b), Hawaii County Code}. A lobbyist means "any individual engaged for pay or other consideration who spends more than five hours in any month or $275 in any six-month period for the purpose of attempting to influence legislative or administrative action by communicating or urging others to communicate with public officials." {Article 15, Section 2-91.3(a)(6), Hawaii County Code} Registration forms and expenditure report documents are available at the Office of the County Clerk, 25 Aupuni Street, Room 1402, Hilo, Hawaii 96720.
