AGENDA
NOTICE IS HEREBY GIVEN of a meeting to be held by the Kailua Village Design
Commission of the County of Hawaii in accordance with the provision of Section 92-7,
Hawaii Revised Statutes.
NOTE: Pursuant to Act 220, Session Laws of Hawaii 2021,which amended the Sunshine Law
to allow meetings to be remotely conducted online, effective January 1, 2022, Kailua Village
Design Commission meetings will be held online, and the location listed below is also open to
the public to provide testimony. The Kailua Village Design Commission meeting can be viewed
live online or at the location listed below. Minutes of the meeting will be posted on the County
of Hawaii website.

NEW BUSINESS
1. PL-KVD-2022-000017: The applicant, Cotti Foods Corporation, is requesting design review
of a new drive-through restaurant at the Niumalu Marketplace, located at 75-957 Henry
Street. The proposed drive-through restaurant at the corner of Henry Street and the main
entrance into the Niumalu Marketplace is approximately 2,965 square feet and is planned to
be a Wendy's Restaurant. The building materials consist of a metal roof,metal siding with
wood design, and a main accent tower. The exterior colors are a mix of Arizona Tan and
Heritage red with some accent colors. The Niumalu Marketplace was previously reviewed
by the Kailua Village Design Commission and was built in 2020.

2. PL-KVD-2022-000018: The applicant, Walua Partners LLC, is requesting design review of
proposed 18 residential/vacation units in two 2-story buildings and three 1-story buildings at
75-5885 Walua Road. The exterior colors include a combination of gray and tan, and use of
metal roofing, stucco walls with horizontal bevel siding, entry porch, and windows with vinyl
trim. Off-street parking,pool, office with storage, and landscaping are included.

Submitting Testimony A person desiring to submit written testimony shall indicate
her/his name; address; and whether the testimony is on her/his behalf or as a representative of an
organization or individual. If testimony is being submitted on behalf of an organization,
documentation showing membership ratification should accompany the testimony. Written
testimony should be submitted to the Kailua Village Design Commission by email at
planning@hawaiicouniy.gov or by mail or in person at the Planning Department office addresses
in Kona or Hilo listed below under Board Packet, and should be received by 4:30 p.m. two
business days prior to the Commission meeting.
Notice to Lobbyists: If you are a lobbyist, you must register with the Hawaii County
Clerk within five days of becoming a lobbyist {Article 15, Section 2-91.3(b), Hawaii County
Code}. A lobbyist means "any individual engaged for pay or other consideration who spends
more than five hours in any month or$275 in any six-month period for the purpose of attempting
to influence legislative or administrative action by communicating or urging others to
communicate with public officials." {Article 15, Section 2-91.3(a)(6), Hawaii County Code}
Registration forms and expenditure report documents are available at the Office of the County

language interpretation to access this meeting, please contact the Planning Department at
961-8288 as soon as possible, but no later than five working days prior to the meeting date, to
arrange for accommodations. "Other reasonable modification"refers to communication methods
