CALL TO ORDER APPROVAL OF MINUTES Review and Approval of the July 21, 2022 Leeward Planning Commission Minutes. STATEMENTS FROM THE PUBLIC ON AGENDA ITEMS Members of the public may provide public testimony regarding any agenda item now or at the time the agenda item is called to order. NEW BUSINESS — 9:30 a.m. 1. APPLICANT: KULA NEI, LLC (PL-PUD-2022-000002) Application for a Planned Unit Development(PUD) for an 8-lot, agricultural subdivision on 40.421 acres of land. The PUD would allow various exceptions from Chapter 23 (Subdivision) and Chapter 25 (Zoning) of the Hawaii County Code. The subject property is located at the southeast corner of the Kukuna Street/Punawele Street intersection, south of the Kona Acres and O`oma Plantation subdivisions and west(makai) of the Kona Hills Estates subdivision, O`oma 1St-Kohanaiki, North Kona, Hawaii, TMK: (3) 7-3-007:039. 2. PLANNING DIRECTOR'S REPORT Report on Special Management Area(SMA) determinations and minor permits issued by the Planning Director. 2 AGENDA ITEMS FOR NEXT MEETING ANNOUNCEMENTS The Leeward Planning Commission's next monthly meeting is scheduled for Thursday, September 22, 2022 at the West Hawaii Civic Center, Community Center, Building G conference room and the public can testify via Zoom and watch the meeting on YouTube. ADJOURNMENT Submitting Testimony Pursuant to Hawaii County Planning Commission Rules of Practice and Procedure (PC), Rule 1, General Rules, a person desiring to submit written testimony shall indicate her/his name; address; and whether the testimony is on her/his behalf or as a representative of an organization or individual. If testimony is being submitted on behalf of an organization, documentation showing membership ratification should accompany the testimony. Public testimony can be submitted by mail or email. Those submitting written testimony by mail should provide one copy for distribution. Public testimony submitted by mail, should be mailed to the Leeward Planning Commission at the Planning Department office addresses in Hilo and Kona listed below under Board Packet. Mailed testimony should be provided at least one week prior to the hearing date to allow for mailing and thorough Commission review. Public testimony that is submitted by email to LPCtestimony@hawaiicouniy.gov, should be submitted before 4:30 p.m. two (2)business days prior to the Commission meeting. Additionally, pursuant to Rule 1, the Chairperson may limit testimony that is irrelevant or unduly repetitious. Contested Case Procedure: Pursuant to PC Rule 4, Contested Case Procedure, of the County of Hawaii Planning Commission Rules of Practice and Procedure, any person seeking to intervene as a party to a contested case hearing on Agenda Item Nos. 1 and 4 above is required to file a written request which must be received by the office of the Planning Department no later than seven (7) calendar days prior to the Planning Commission's first public meeting on the matter. Such written request shall conform with the PC Rule 4-6(a),relating to Prehearing Procedure on a form as provided by the Planning Department entitled"Petition for Standing in a Contested Case Hearing." The notarized petition form and a filing fee of$200 shall be submitted online via County of Hawaii Electronic Processing and Information Center(EPIC) at the following website: https://hawaiicouniyhi-energovpub.iylerhost.net/Apps/SelfService#/home. Notice to Lobbyists: If you are a lobbyist, you must register with the Hawaii County Clerk within five days of becoming a lobbyist {Article 15, Section 2-91.3(b), Hawaii County Code}.
