Yuen, Planning Director Norman Hayashi, Planning Program Manager Phyllis Fujimoto, Staff Planner Jeff Darrow, Staff Planner Sharon Nomura, East Hawaii Secretary Kiran Emler representing Department of Public Works And approximately APPLICANT: KENNETH VEROSKO (SPP 04-022) Continuation of a Special Permit application to allow the establishment ofa Smoothie stand on a 0.5-acre area situated within the State Land Use Agricultural District. The area involved is a portion of the South Kona Fruit Stand and Nursery located along the east (mauka) side of Mamalahoa Highway (Highway 11) and approximately 1,200 feet south of the Mamalahoa Highway  City of Refuge Road junction, Keokea, South Kona, Hawaii, Tax Map Key: 8-4-15:portion of 4. GALDONES:Commissionersweareonunfinishedbusiness,agendaitem number 1. The applicant is Ken Verosko (SPP 04-022). This is a continuation of a SpecialPermitApplicationtoallowtheestablishmentofaSmoothiestandona0.5acre area situated within the State Land Use Agricultural District. DARROW:Thank you Mr. Chairman. Good Morning Mr. Chairman and membersofthePlanningCommission.IfImaydirectyourattentiontothelocationmap. The area of this application is located within the south Kona district of Hawaii. This whitelinethat€srunninginasouth,north-southdirectionalong-acrossthemiddle EXHIBIT A of the map is the Hawaii Belt Road. The area of this application is identified in blue. That is located on Mamalahoa Highway within South Kona just past Captain Cook and before Hookena Beach. The applicant in this case,Kenneth M. Verosko is requesting a special permit to allow the addition of a smoothie stand to this existing south kona fruit stand business. If I can direct your attention to the site map that was submitted by the applicant. This line here running across the lower portion of the map is Mamalahoa Highway. Again running in a north-south direction. The existing fruit stand business has a paved driveway access that is- that accesses ingress and egress onto Mamalahoa Highway. This area here is where the existing fruit stand business is located and the area in red is where the proposed smoothie stand will be located on the property. The applicant€s have recently submitted a revised site plan. That should have been passed out to all the members of the Commission. It€s basically lowering the size of the smoothie stand from 20 feet by 30 feet to 14 by 14. They will still include a small kitchen within the structure but there will be no bathroom facilities within it. The remainder of the propertywillbemainlyusedforagriculturalpurposeswheretheygrowfruitsand vegetables that are being used for the businesses. We have received several late comments, one from the Department of Water Supply and that was one of the reasons for continuing the last hearing to make sure that they were able to comply with the requirements of Department of Water Supply. The Department of Water Supply has granted them a second meter to meet those requirements. We€ve also received a late comment letter from the Department of Transportation and they bring to our attention that the- although the- there are no restrictions for access on the highway in this area that the applicants need to submit a request and get authorization from DOT for the access. We have not received any letters of opposition or support in regards to this application and the Planning Director is recommending that this application be approved by the Planning Commission. Are there any questions? GALDONES:Commissioners any questions of Mr. Darrow? Commissioner Springer. SPRINGER:Good morning Jeff. Is it on? Jeff, I€m looking at Exhibit E, the correspondence from the Kona Traffic Safety Committee and there concern regarding parking. Is what I see on the site plan that was circulated where parking is indicated- is that consistent with our concern? DARROW:Yes it is, thank you. SPRINGER:You€re welcome. GALDONES:Any further questions of Mr. Darrow? Otherwise, if there are anybody from the public who wish to testify on this subject matter please sign in and inform Sharon that you will be testifying so we can include you on the list. GALDONES:Could you please speak into the mike so that we can have you record- could you please state your name and your residence address? VEROSKO:Kenneth M. Verosko. 84-4770 Mamalahoa Highway, Captain Cook 96704. GALDONES:Thank you Mr. Verosko. Ma€am will you be testifying also? WOMAN:I€m just here supporting. GALDONES:Mr. Verosko have you received the background report and also and recommendation? VEROSKO:Yes. GALDONES:Do you have any comments to them? VEROSKO:As far as the Department of Transportation we will be complying withalloftheirrequestsorwhatever-wehaveoffsiteparkingandwehaveaccess-our own private access in and out off the highway. And- and that should- that should be sufficient as far as what the Department of Transportation is asking. GALDONES:Commissioners are there any questions of Mr. Verosko? Are there anyone from the public- public here to testify on this subject matter before us? If not, Commissioners it comes with a recommendation to have this approved by the Planning Commission. Mr. Emler: EMLER:Chairman Galdones I would like to suggest a revision to one of the conditions regarding the access. GALDONES:Proceed. EMLER:Condition # 4 reads the driveway connection to Mamalahoa Highway shall conform to Chapter 22, Streets and Sidewalks of the Hawaii County Code. The driveway access is this case is within a State Highways, Department of Transportation jurisdiction and so Chapter 22 of Hawaii County Code will not apply. So I would recommend that you change this to- conform to requirements of the State Department of Transportation. DARROW:So noted. GALDONES:Sharon did you get that? NOMURA:Yes. 3 EMLER:I would also recommend because of DOT also asked for drainage issues to be addressed in their letter that condition #5 add them to requirements for drainage. A drainage system, if required, shall be constructed meeting the approval of the Department of Public Works and the Department of Transportation prior to the issuance of the Certificate of Occupancy. DARROW:So noted. GALDONES:Thank you. Mr. Verosko the amendments that€s stated by Mr. Emler to condition #4 whereby it will reflect that you will conform with the State DOT requirements instead of the Hawaii County Code and also to add to #5- condition #5 in the second sentence- add in the Department of Transportation beside the Department of Public Works. Do you have any objection to that or any comments? VITOUSEK:No I agree with that. GALDONES:Commissioners any discussion on the amendments? Hearing none, amotionisinorder.CommissionerFujikawa. FUJIKAWA:Yeah,Imakeamotiontoaccepttheapplication-permit application #SP04-022 with the changes of condition 4 and 5. GALDONES:That€s it. Do I have a second? SMITH:Second. GALDONES:It has been moved by Commissioner Fujikawa and seconded by Commissioner Smith that application from Kenneth M. Verosko, Special Permit Application SPP 04-022, along with the background report and the recommendation and the amendments to condition # 4 and condition #5 as stated by Mr. Emler be approved by the Planning Commission.
