Continued hearing on a Special Management Area Use Permit application to allow the construction of a three and one-half story, 45-foot high, 12-unit multi- family residential development and related improvements on approximately 15,203 square feet of land. The property is located on the west (makai) side of Alii Drive, adjacent to and north of the Sea Village Condominium complex, Kahului, North Kona, Hawaii, TMK: 7-5-19:30. UNFINISHED BUSINESS Î 1:00 p.m. APPLICANT: RUTTER/KW KOHANAIKI, LLC (SMA 03-012/ 9. UP 03-002/UP 03-003) a.Continued hearing on the application for a Special Management Ar Permit to allow the development of a 500 homes/home sites project, an 18-hole golf course and golf clubhouse, public coastal park facilities, and related improvements. b.Continued hearing on the application for a Use Permit to allow t development of an 18-hole golf course, golf clubhouse, and related improvements within the Resort-Hotel (V-1.25), Village Commercial (CV-10), Multiple Family Residential (RM-3), Single Family Residential (RS-10), and Open (O) districts. c.Continued hearing on the application for a Use Permit to allow t development of a major recreational facility (portion of an 18-hole golf course and related improvements) with the Limited Industrial (ML-10) district. The property is located between the Kaloko Honokohau National Park and the Ooma property, makai of the Queen Kaahumanu Highway (Highway 19) Kohanaiki, North Kona, Hawaii, TMK: 7-3-9:3 and 16. According to Rule 1 (General Rules) of the Planning Commission, a person desiring to submit oral or written testimony shall indicate her/his name; residence address; and whether the testimony is on her/his behalf or as a representative of an organization or individual. If testimony is being submitted on behalf of an organization, documentation showing membership ratification should accompany the testimony. Written testimony shall be submitted with an original and nine copies prior to testifying. The Commission would appreciate timely submittal to the Planning Department at least one week prior to the hearing d and thorough Commission review. Pursuant to Rule 4, Contested Case Procedure, of the County of HawaiÒi Planning Commission Rules of Practice and Procedure, any person seeking to intervene as a party to a contested case hearing on items 5 and 6 above, is required to file a written request which must be received in the office of the Planning Department no later than seven (7) calendar days prior to the Planning CommissionÓs first public meeting on the matter. Such written request shall be in conformity with Rule 4, in a form as provided in Rule 4 Appendix Standing in a Contested Case Hearing.Ñ The written petition/request shall be filed with the Planning Commission at Aupuni Center, 101 Pauahi Street, Suite 3, Hilo, HawaiÒi 96720, and accompanied by a filing fee of $100 payable t Finance. Any party may retain counsel if that person so desires. Rule 4 may be inspected or purchased ($2.50) at the above-cited location. Any disabled person requiring special assistance or person requiring auxiliary aid and/or services to participate in the hearing should contact the Planning Department at 961-8288 five (5) working days prior to the hearing so that appropriate arrangements can be made.
