A regularly advertised public hearing on the COUNTY COUNCILÓS PROPOSED BILL
NO. 47 (MCX DISTRICT) was called to order at 12:10 a.m. in the County Building,
Councilroom-Room 201, 25 Aupuni Street, Hilo, Hawai`i, with Chairperson Fred
Galdones presiding.

COUNTY COUNCIL INITIATED - Proposed Bill No. 47 amending Chapter 25,
YnmhmfBncd+nesgdG`v`hkhCounty Code 1983 (1995 Edition) as amended, relating to
permitted uses in the Industrial-Commercial Mixed Use (MCX) District. The proposed
bill is to add specific uses to the list of permitted uses.
GALDONES:Commissioners, we are on Agenda Item No. 7, the County
Council initiated proposed Bill No. 47 amending Chapter 25, Zoning Code, of the
G`v`hkhBntmsxBncd0873 (1995 Edition) as amended, relating to permitted uses in the
Industrial-Commercial Mixed Use (MCX) District. The proposed bill is to add specific
uses to the list of permitted uses. Is Susan here?

In your background report we had printed some zoning map showing various areas on
the island that indicate where the Limited Industrial zoning is, the General Industrial,

sgdLBW-Rnvg`sHlckhjdto do is just briefly go over it so you get an idea again of
where the MXC zonings are occurring.
Okay, if we look at the Hilo area, this morning earlier you had heard rezonings for MCX;
and what weÓre finding is that the MCX zonings are occurring in the Waiakea House Lots
area. YouÓll notice that we have an existing MCX zoning. ItÓs kind of hard to see here
but itÓs blue-colored. ItÓs located here where the Waiakea Shopping Plaza is. We have
several MCX zonings along Kanoelehua in this area and also todayÓs MCX in that
vicinity of Kawili Street. So this is an area thatÓs in transition.
Also this is an Industrial General Plan area along Kanoelehua. In the proposed General
Plan Revisions, there is an area that has been expanded to increase the Industrial District
in that area.
If you look in the Keaau area, we had two MCX rezonings. One wa
rezoning, thatÓs next to the Industrial Park. Also, we had one earlier in the vicinity of the
Puna Sugar Mill for MCX for Mr. McCully; and thatÓs shown here in this area.
In the Kailua-Kona area, we have some MCX area right here in blue. This is for
Liliuokalani Trust. ItÓs adjacent to the Kona Industrial area which is MG-1a. We also
have N MCX area next to the Kaloko Industrial Park. This was for TSA; and itÓs an area
located in light blue here.
Basically, youÓll notice that a lot of the MCX area is adjacent to existing industrial
zoning, whether it be MG or ML. So a lot of the industrial uses are very close in
proximity to each other.
When we look at rezonings for MCX, I think we need to be concerned about the adjacent
uses, and when we look at the actual uses that are permitted. Therefore, we have to be a
little careful to see that the uses are appropriate for that area.
In reviewing the CouncilÓs request to add additional uses, youÓll notice that the Planing
Director has recommended to not include all of the uses that they recommended. And this
was in light of the fact of the initial underlined General Plan being Industrial. So there is
some concern about allowing child care, and allowing, you know, adult care facilities,
and things of that sort.
So youÓll see that we have not included all of their request requirements.
So the Planning Director has recommended that the list be limited to the list that we
provided to you with the exception that we have listed, which was the child care, the
adult care, the crop production, and those.

GRAHAM:I just wanted to ask, excuse me, a question as to why this or why
this change even came up. Is this sort of an intellectual exercise on the part of the
Council, they felt like it was appropriate, or was there were anything they were
responding to that brought this about?
GAGORIK:Yeah, I think when you look at the transcripts of the CouncilÓs
Planning Committee, Ms. Leithhead Todd had felt that, I guess it was brought to her
attention there were some uses that were inconsistent in terms o
and felt to try to be more consistent she would include some of the uses from the
Commercial zoning in there, knowing that this doesnÓt make everything perfect. Because
we still know there are some inconsistencies that exists in a lot of the zoning districts.
But, for example, if you look at the list, it allowed bars, but not cabarets. So, you know,
that was added in to be more consistent.
GALDONES:Commissioners, any further, any other questions?
KUBOTA:Just for clarification, what is the difference between a bar and a
cabaret? I mean what defines one and the other?
GAGORIK:I donÓt know because there is no definition. But I would think
maybe cabarets have dancing, I donÓt know.
YUEN:ItÓs not actually defined in the Zoning Code, is it?
GAGORIK:No.
YUEN:Typically, a cabaret has some kind of entertainment. And t
different kind of license for a cabaret, I canÓt, IÓm not an -, in the Liquor Commission
rules. Does anybody know? I donÓt know the difference but I do know there is a
difference between a bar license and a cabaret license and it has to do with entertainment.
KUBOTA:Thank you.
GALDONES:Any further discussion?
SPRINGER:Mr. Chairman?
GALDONES:Commissioner Springer.
SPRINGER:I agree with the recommendations of the Planning Department with
regard to accepting those, I think itÓs four, uses.
KUBOTA:Did you move that?
GALDONES:If thereÓs no further discussion, Commissioner Springer, would
you like to incorporate that into a motion?

SPRINGER:With regard to -.
GAGORIK:Hold on, one second, IÓm sorry. We need to continue the
application because we need to hear it in Kona, too, to be fair.
GALDONES:Okay. So this is for just discussion purposes today, no action?
GAGORIK:Yes. No action. We recommend that we continue the hear
Kona so that we could have adequate public testimony in Kona.
GALDONES:Does that require a motion or itÓs just an administrative procedure.
GAGORIK:A motion.
GALDONES:A motion needs to be, okay. Then the Chair is ready to entertain a
motion to have this discussion continued at the Kona meeting.
SPRINGER:So move.
KUBOTA:Second.
GALDONES:Moved and second, moved by Commissioner Springer and
seconded by Commissioner Kubota that this discussion be continued at the Kona hearing.
Any discussion on the motion? Hearing none, all those in favor of the motion say aye?

GALDONES:Oppose, nay? Okay, motion is carried.
