NOTICE IS HEREBY GIVEN of matters to be considered by the Planning Commission of the
County of Hawaii in accordance with the provisions of Chapters 91 and 92, Hawaii Revised
Statutes, Section 6-4.3 of the Charter of the County of Hawaii, and the Planning Commissions
Rulesof Practice and Procedure.

APPLICANT: JON MITSUDA (ORD. 96-81)
Request to repeal Ordinance No. 96 81, which reclassified approximately 1.952 acres
from an Agricultural 3-acre (A-3a) to a Single-Family Residential 10,000 square feet
(RS-10) district. The property is located at the west end of Ahe Street, adjacent to the
Hoomalu Street Subdivision, Waiakea, South Hilo, Hawaii, TMK: 2-4-8: 15 (formerly 2-
4-3: portion of 4).

APPLICANT: CELLCO PARTNERSHIP dba VERIZON WIRELESS
(SMA 434/SPP 1214)
Cellco Partnership dba Verizon Wireless, with authorization from the landowner and
Nextel Partners, Inc., has submitted a request to amend Special Management Area (SMA)
Use Permit No. 434 and Special Permit No. 1214 to allow the following:
a.Co-location of eight 8-foot panel antennas on the existing 80-foot
telecommunication pole;
b.Construction of a 312+ square foot equipment shelter and security fencing; and
c.Increasethepermitareafrom600squarefeetto1,475squarefeet.
The area involved is located at the north end of Laupahoehoe Gulch and along the makai
side of State Highway 19, Waipunalei, North Hilo, Hawaii, TMK: 3-6-4: portion of 7.

APPLICANT:DR.ALLANTAKASE(REZ06-000044)
Change of Zone from a Single-Family Residential 10,000 square feet (RS-10) to a
Multiple-Family Residential 1, 000 square feet (RM-1) district. The property is located
on the west side of Kinoole Street, approximately 180 feet south (Puna side) of the

Kinoole Street Olona Street intersection, Waiakea House Lots, 2 Series, Waiakea,
SouthHilo, Hawaii, TMK: 2-2-26:24.

APPLICANT: PAT FAY & MARY ROBLEE (SPP 06-000032)
Special Permit to allow the establishment of a 2-bedroom bed and breakfast within an
existing single family dwelling located on 0.5 acre of land situated within the State Land
Use Agricultural District. The property is located along the west (mauka) side of
Paradise Ala Kai Street, approximately 1 mile from its intersection with Paradise Drive,
Hawaiian Paradise Park Subdivision, Keaau, Puna, Hawaii. TMK: 1-5-59:28.

APPLICANTS: GARVIN & LAURA GOODE, TR (SPP 06-000031)
Special Permit to allow the construction of a 1,584+ square foot (44 feet x 36 feet)
building for the sale of fruits/produce, including the preparation of cold foods
(sandwiches, smoothies, and cold drinks), on 1 acre of land situated within the State Land
Use Agricultural District. The area involved is located at the northwest corner of State
Highway 19 and Kalaoa Camp Road, adjacent to and south of Aukuu Stream, Kalaoa,
South Hilo, Hawaii, TMK: 2-7-8: portion of 130.

INITIATOR: PLANNING DIRECTOR
Amendment to Chapter 25 (Zoning Code), Article 1, Section 25-1-5(b) of the Hawaii
County Code 1983 (2005 Edition, as amended), by amending the definition of family
to read as follows:
Family means an individual or two or more persons related by blood, state-sanctioned
adoption, foster parentage, guardianship or marriage, or a group of not more than five
unrelated persons (excluding servants), occupying a dwelling unit. The term includes
individuals in larger group living situations described as group living facilities and family
child care homes[.] and a group of not more than eight unrelated persons, plus any
program staff, living in a facility licensed by the department of health.

The purpose of the public hearing is to afford all interested persons a reasonable
opportunity to be heard on the above requests.
Submitting Testimony: According to Rule 1 (General Rules) of the Planning
Commission, a person desiring to submit oral or written testimony shall indicate her/his name;
residence address; and whether the testimony is on her/his behalf or as a representative of an
organization or individual. If testimony is being submitted on behalf of an organization,
documentation showing membership ratification should accompany the testimony. Written
testimony shall be submitted with an original and nine copies prior to testifying. The
Commission would appreciate timely submittal to the Planning Department at least one week
prior to the hearing date to allow for mailing and thorough Commission review. Testimony that
is irrelevant or unduly repetitious may be limited by the Chairperson pursuant to Rule 1.
Contested Case Procedure: Pursuant to Rule 4, Contested Case Procedure, of the County
of Hawaii Planning Commission Rules of Practice and Procedure any person seeking to
intervene as a party to a contested case hearing on item nos. 2, 4 and 5 above is required to file a
written request which must be received in the office of the Planning Department no later than
seven (7) calendar days prior to the Planning Commissions first public meeting on the matter.
Such written request shall be in conformity with Rule 4, in a form as provided in Rule 4
Appendix A Petition for Standing in a Contested Case Hearing. The written petition/request
shall be filed with the Planning Commission at Aupuni Center, 101 Pauahi Street, Suite 3, Hilo,
Hawaii 96720, and accompanied by a filing fee of $100 payable to the Director of Finance.
Any party may retain counsel if that person so desires. Rule 4 may be inspected or purchased
($2.50) at the above-cited location. Rule 4 may also be viewed at the County of Hawaii website
(http://www.co.hawaii.hi.us).
Notice to Lobbyists: If you are a lobbyist, you must register with the Hawaii County
Clerkwithinfivedaysofbecomingalobbyist{Article15,Section2-91.3(b),HawaiiCounty
Code}. A lobbyist means any individual engaged for pay or other consideration who spends
more than five hours in any month or $275 in any six-month period for the purpose of attempting
toinfluencelegislativeoradministrativeactionbycommunicatingorurgingothersto
communicatewithpublicofficials.{Article15,Section2-91.3(a)(6),HawaiiCountyCode}
Registration forms and expenditure report documents are available at the Office of the County
Clerk-Council, 25 Aupuni Street, Hilo, Hawaii 96720.
Maps showing the general locations and boundaries of the areas under consideration
and/or plans of the proposed developments are on file and open to inspection during office hours
at the Planning Department, Aupuni Center, 101 Pauahi Street, Suite 3, Hilo, Hawaii 96720.
Any disabled person requiring special assistance or person requiring auxiliary aid and/or
services to participate in the hearing should contact the Planning Department at 961-8288 five
(5) working days prior to the hearing so that appropriate arrangements can be made.
