HomeMy WebLinkAbout2010-11-24 Leeward Planning Commission Agenda NOTICE OF PUBLIC MEETING AND HEARINGS LEEWARD PLANNING COMMISSION COUNTY OF HAWAI‘I NOTICE IS HEREBY GIVEN of the following matters to be considered by the Leeward Planning Commission of the County of Hawai‘i in accordance with the provisions of Chapters 91 and 92, Hawai‘i Revised Statutes, Section 6-4.3 of the Charter of the County of Hawai‘i, and the Commission’s Rules of Practice and Procedure. DATE:Wednesday, November 24, 2010 TIME:9:30 a.m. PLACE:King Kamehameha's Kona Beach Hotel 75-5660 Palani Road, Kailua-Kona, Hawai‘i NEW BUSINESS – 9:30 a.m. APPLICANT: PARKER RANCH (SPP 10-108) 1. Application for a Special Permit to allow for the establishment of light industrial and commercial office uses within existing structures and the use of an existing rodeo/equestrian facility for special events, all of which are situated on a total of approximately 14.897 acres at the Parker Ranch headquarters and rodeo/equestrian facility complex in Waimea. The project site is situated approximately 4,300 feet north of the Waimea-Kohala Airport on the east side of the Mmalahoa Highway, Waikoloa and Pu‘ukapu, South Kohala, TMK: 6-7-001: portion of 25 and 6-7-002: portion of 17. EDWIN DELUZ TRUCKING AND GRAVEL, LLC (SPP 164/LUC 70-85) 2. Amendment to Condition No. 2 of Special Permit No. 164 (LUC Docket SP70-85) to extend the life of the permit from December 11, 2010 to December 11, 2015. Special Permit No. 164 allowed for the continued operation of the Pu‘u Hinai Quarry on approximately 63.648 acres of land situated within the State Land Use Agricultural District. The subject property is situated approximately 4,600 feet south of Waikoloa Road and 1.3 miles southeast of Waikoloa Village, Waikoloa, South Kohala, Hawai‘i, TMK: 6-8-002: portion of 16. CURTIS B. SYLVA (SPP 10-107) 3. Application for a Special Permit to allow for the establishment of an agricultural and veterinary supply store within an existing 5,000 square-foot warehouse and upon an approximately 1.184-acre portion of a 5.043-acre parcel situated within the State Land Use Agricultural District. The property is located off the south side of Highway 19 (Mamalahoa Highway) with access between HPM Building Supply and NAPA Auto Parts, Pu‘ukapu Homesteads, First Series, South Kohala, Hawai‘i, TMK: 6-4-6: portion of 1. 1 NEW BUSINESS – 10:00 a.m. INITIATOR: PLANNING DIRECTOR 4. Revocation of Ordinance No. 09 159 (Kona Country Club, Inc.-REZ 09-98), which rezoned 51.1-acres of land from an Agricultural-5 acres (A-5a) to a Multiple-Family Residential 30,000 square feet (RM-30) zoned district. The area involved is located mauka of the Mmalahoa Highway Bypass, between the Highway and the Kona Country Club mauka golf course, Keauhou Resort, Keauhou, North Kona, Hawai‘i, TMK: 7-8-10:101. APPLICANT: GIDEON SOROKIN (SMA 10-43) 5. Application for a Special Management Area Use Permit to allow for the construction of five (5) three-story, single family residential units on approximately 31,853 square feet of land zoned Hotel-Resort-1,250 square feet of land area per unit (V-1.25). The subject property is situated on the east (mauka) side of Ali‘i Drive, approximately 840 feet south st of its intersection with Lunapule Road in Kailua Village, Kahului 1, North Kona, Hawai‘i, TMK: 7-5-19:07. INITIATOR: PLANNING DIRECTOR 6. Revocation of Special Management Area Use Permit No. 250, which allowed for various construction and reconstruction activities related to the former Saint Michael the Archangel Church that was damaged during the 2006 earthquake and which has since been demolished. The approximately 3.19-acre property is located on the northeast (mauka) side of Ali‘i Drive directly across Hale Halawai Park and Waterfront Row nd shopping complex in Kailua Village, Hienaloli 2, North Kona, Hawai‘i, TMK: 7-5-08:06. NEW BUSINESS – 10:30 a.m. 7.INITIATOR: PLANNING DIRECTOR Amendment to Chapter 25 (Zoning Code), Article 2 and Article 5 of the Hawai‘i County Code, 1983 (2005 Edition, as amended), relating to Use Permits for Schools within the Hotel-Resort (V), General Industrial (MG), Limited Industrial (ML) and Industrial- Commercial Mixed (MCX) zoned Districts. INITIATOR: PLANNING DIRECTOR 8. Amendment to Chapter 25 (Zoning Code), Articles 2, 4 and 5 of the Hawai‘i County Code, 1983 (2005 Edition, as amended), relating to Use Permits and Telecommunication Towers within the Open-zoned District. INITIATOR: COUNTY COUNCIL 9. Amendment to Chapter 25 (Zoning), Article 4, of the Hawai‘i County Code 1983 (2005 Edition, as amended), by adding a new division relating to Tsunami Sirens. MINUTES ADMINISTRATIVE MATTERS 2 ANNOUNCEMENTS ADJOURNMENT The purpose of the public hearings is to afford all interested persons a reasonable opportunity to be heard on the above matters. Pursuant to Rule 4, Contested Case Procedure, of the County of Hawai‘i Planning Commission Rules of Practice and Procedure, any person seeking to intervene as a party to a contested case hearing on Item Nos. 1, 2, 3, 4, 6 and 7 above is required to file a written request which must be received in the office of the Planning Department no later than seven (7) calendar days prior to the Planning Commission’s first public meeting on the matter. Such written request shall be in conformity with Rule 4, in a form as provided by the Planning Department entitled “Petition for Standing in a Contested Case Hearing.” The written petition/request shall be filed with the Planning Commission at Aupuni Center, 101 Pauahi Street, Suite 3, Hilo, Hawai‘i 96720, and accompanied by a filing fee of $200 payable to the Director of Finance. Any party may retain counsel if that person so desires. Rule 4 may be inspected or purchased ($2.50) at the above-cited location. Rule 4 may also be viewed at the County of Hawai‘i website (http://www.co.Hawaii.hi.us). Submitting Testimony: According to Rule 1 (General Rules) of the Planning Commission, a person desiring to submit oral or written testimony shall indicate her/his name; address; and whether the testimony is on her/his behalf or as a representative of an organization or individual. If testimony is being submitted on behalf of an organization, documentation showing membership ratification should accompany the testimony. Written testimony shall be submitted with an original and fifteen copies prior to testifying. The Commission would appreciate timely submittal to the Planning Department at least one week prior to the hearing date to allow for mailing and thorough Commission review. Testimony that is irrelevant or unduly repetitious may be limited by the Chairperson pursuant to Rule 1. Notice to Lobbyists: If you are a lobbyist, you must register with the Hawai‘i County Clerk within five days of becoming a lobbyist {Article 15, Section 2-91.3(b), Hawai‘i County Code}. A lobbyist means “any individual engaged for pay or other consideration who spends more than five hours in any month or $275 in any six-month period for the purpose of attempting to influence legislative or administrative action by communicating or urging others to communicate with public officials.” {Article 15, Section 2-91.3(a)(6), Hawai‘i County Code} Registration forms and expenditure report documents are available at the Office of the County Clerk, 25 Aupuni Street, Hilo, Hawai‘i 96720. Copies of the applications are on file and open to inspection during office hours at the Planning Department, Aupuni Center, 101 Pauahi Street, Suite 3, Hilo, Hawai‘i and at the Kona office of the Planning Department, 75-5706 Kuakini Highway, Suite 109, Kailua-Kona, Hawai‘i. Anyone who requires an auxiliary aid or service, other reasonable modification, or language interpretation to access this meeting please contact the Planning Department at 961- 8288 as soon as possible, but no later than five working days prior to the meeting date, to arrange for accommodations. “Other reasonable modification” refers to communication methods or devices for people with disabilities who are mentally and/or physically challenged. 3 Hawai‘i County is an Equal Opportunity Provider and Employer.
