MINUTES
OCTOBER 6, 2022
The Windward Planning Commission met in regular session at 9:03 a.m., in the County of
Hawaii, Aupuni Center Conference Room, 101 Pauahi Street, Hilo, Hawaii, with Chair Dennis
Lin presiding with a live stream video for the public to observe the meeting.
COMMISSIONERS PRESENT: Dennis Lin, Gilbert Aguinaldo, Lauren Balog, and Louis
Daniele II.
ABSENT AND EXCUSED: John Cross, Wayne De Luz, and Michelle Galimba.
ALSO PRESENT: Malia Kekai, Esq. (Counsel for the Commission), Jean Campbell, Esq.
(Counsel for the Planning Department), Zendo Kern (Planning Director), Jessica Andrews
(Planner), Clinton Mercado (Planner), Tracie-Lee Camero (Zoom Host), Maija Jackson
(Planning Program Manager)and Melissa Dacayanan-Salvador (Windward Planning
Commission Secretary).
And 2 people from the public in attendance.
A quorum was present. Chair Lin called the meeting to order. He described the public
accessibility to this meeting and the protocol for the participants to follow.
Chair Lin called the roll of the Commissioners and also introduced the staff.
APPROVAL OF MINUTES
At 9:04 a.m. the Commission took up the minutes of the September 1, 2022, Windward Planning
Commission meeting. No corrections were offered. It was moved by Commissioner Daniele
and seconded by Commissioner Aguinaldo that the minutes be approved as submitted. A voice
vote was taken, and the motion carried with all in favor, and none opposed.
STATEMENTS FROM THE PUBLIC ON AGENDA ITEMS
Chair Lin explained the procedure in providing public testimony and a reminder to Rule 1-5 of
the Planning Commission's Rules of Practice &Procedure to be courteous and respectful to all
testifiers, staff members and commissioners. Public testimony was not taken at this time.
NEW BUSINESS
1. APPLICANT: MAURICE & JIRANAN THOMAS TRUSTS (PL-SPP-2022-000017)
Application for a Special Permit to legitimize the use of an existing warehouse and office
facility for warehousing, distribution and administrative operations related to retail and

service activities in Orchidland Estates and Volcano Village on 1.045 acres of land in the
State Land Use Agricultural district. The subject property is located at 16-1695 34,'
Avenue, at the southeast corner of its intersection with Orchidland Drive, Orchidland
Estates, Puna, Hawaii, TMK: (3)1-6-009:385.
The Commission took up this item at 9:07 a.m. with 2 members from the public in attendance
and there were no members of the public testified.
It was moved by Commissioner Daniele and seconded by Commissioner Aguinaldo that the
application for Special Permit No. PL-SPP-2022-000017 be approved, based on the Planning
Director's recommendations and the proposed amended conditions by the applicant, which shall
be adopted. A roll call vote was taken, and the motion carried with four ayes (Daniele,
Aguinaldo, Balog, Lin) and no noes.

Chair Lin called for a recess at 9:46 a.m., and the meeting was reconvened at 9:51 a.m.
2. INITIATOR: COUNTY COUNCIL (BILL NO. 194) (PL-CCI-2022-000002)
An Ordinance amending Chapter 25, Article 2, Division 4, of the Hawaii County Code
1983 (2016 Edition, as amended), relating to conditions on change of zone actions. The
purpose of this amendment is to clarify that the Planning Director may not extend the
time allowed to satisfy conditions within a change of zone ordinance unless specifically
authorized by the County Council.
The Commission took up this item at 9:52 a.m. with 2 members from the public in attendance.
At 9:56 a.m. it was moved by Commissioner Aguinaldo and seconded by Commissioner Daniele
that public testimony be closed for this agenda item. There being no discussion on the motion, a
voice vote was taken, and the motion carried by unanimous vote of those present.
It was moved by Commissioner Aguinaldo and seconded by Commissioner Daniele that a
favorable recommendation be forwarded to the County Council on Draft Bill No. 194 based on
the Planning Director's A roll call vote was taken, and the motion carried with four ayes
(Aguinaldo, Daniele, Balog, Lin) and three excused.

PLANNING DIRECTOR'S REPORT
Report on Special Management Area (SMA) determinations, minor permits action issued
by the Planning Director.
At 10:37 a.m. Chair Lin introduced this item. Program Planning Manager, Maija Jackson stated
he Short-Form Assessment Log and the SMA Assessment Log were emailed to the
Commissioners and there were no questions.

AGENDA ITEMS FOR NEXT MEETING
At 10:38 a.m. Chair Lin asked introduced this item. Program Planning Manager, Maija Jackson
stated there will be two items on next month's agenda and mentioned the December agenda has
two items that may be controversial. She also stated a Joint meeting is being planned on Zoom
for the Leeward and Windward Planning Commission to review changes to the Special
Management Area(SMA) rule, Rule 9 for the Act 16 changes which were made by the
legislature in 2019. It is anticipated to provide the rule changes to the Commission in early
November ahead of the December Joint meeting.
ANNOUNCEMENTS
The Windward Planning Commission's next monthly meeting is scheduled for Thursday,
November 3, 2022 at the County of Hawaii County Council Chambers and the public may
provide verbal testimony by interactive video conference via Zoom or at the physical
location.
ADJOURNMENT
There being no further business, it was moved by Commissioner Aguinaldo and seconded by
Commissioner Daniele that the meeting be adjourned. A voice vote was taken, and the motion
carried by unanimous vote of those present. Chair Lin adjourned the meeting at 10:39 a.m.
