f)Anyadjustmentthatincreasesordecreasesanysalarybymorethantenpercentshall requireanaffirmativevoteoftwo-thirdsoftheentiremembershipofthesalary commission. 1974, Ord. Forthebenefitofpresentandfuturegenerations, thecountyshallconserveandprotect Hawai‘i’snaturalbeautyandallnaturalandculturalresources, includingbutnotlimitedtoland, water, air, minerals, energysources, wahipana, surfspots, historicsites, andhistoricstructures, andshallpromotethedevelopmentandutilizationoftheseresourcesinamannerconsistentwith theirconservationandinfurtheranceoftheself-sufficiencyofthecounty. Allpublicnaturaland culturalresourcesareheldintrustbythecountyforthebenefitofthepeople. 2010, Prop. 6, sec. 1.) ARTICLEXIV CODEOFETHICS Section14-1.EnactmentandPolicy. a)Thecouncilshalladoptbyordinanceacodeofethicswhichshallprovideasaminimum standardtheprovisionsofthisarticle. Morestringentprovisionsmaybeenacted. b)Electedandappointedofficersandemployeesshalldemonstratethehigheststandardof ethicalconductsothatthepublicmayhavetrustandconfidenceintheintegrityofthe government. 2000, Prop. 15, sec. 1.) Section14-2.Standards. Itshallconstituteaconflictofinterestforemployeesorofficersofthecountyto: a)Solicitoracceptgifts, loans, gratuities, favors, promisesorserviceswiththe understandingthatthesamemayinfluencetheemployeesorofficersintheproper dischargeoftheirofficialduties. b)Usetheirofficialpositiontosecurespecialprivileges, consideration, treatmentor exemptiontothemselvesoranypersonbeyondthatwhichisavailabletoevery otherperson. c)Engageinanybusiness, transactionoractivityorhaveafinancialinterest, direct orindirect, whichmightreasonablytendtobeincompatiblewiththeproper dischargeoftheirofficialdutiesortoimpairtheirindependenceofjudgmentin theperformanceoftheirofficialduties. d)Receiveanycompensationfortheirservicesasanofficeroremployeeofthe countyfromanyothersourceotherthanthecounty, exceptasotherwiseprovided bythischarterorbylaw. e)Appearinbehalfofprivateinterestsforcompensationbeforeanyagencyofthe countyotherthanacourtoflaw, norrepresentprivateinterestsinanyactionor proceedingagainsttheinterestofthecountyinanylitigationtowhichthecounty isaparty. Anofficerservingthecountywithoutcompensation, however, may appearforcompensationinbehalfofprivateinterestsbeforecountyagencies 60 otherthantheoneonwhichtheofficerservesandotherthanthoseagenciesthat havethepowertoreviewtheactionsoftheagencyonwhichtheofficerserves,or toactonthesamesubjectmatterastheagencyonwhichtheofficerserves. f)Acceptaretainer, compensationorelectioncampaigncontributionthatis contingentuponactionbyacountyagency. 1979, Prop. 13; 1990, Prop. 14, sec. 1.) Section14-3.DisclosureofInterest. Itshallbeincumbentuponallemployeesorofficersofthecountyto: a)Makefulldisclosureinwritingtotheappointingauthorityortothecouncilinthe caseofanelectiveofficer, thepossessionoracquisitionofanyinterests, financial orotherwiseasmightreasonablytendtocreateaconflictwiththepublicinterest. Anymemberofthecouncilwhoknowsofapersonalinterest, directorindirect, in anyactionproposedorpendingbeforethecouncilshalldisclosesuchinterest priortothetakingofanyvotethereon. b)Fileacopyofsuchdisclosurewiththecountyclerkwhichshallbecomeamatter ofpublicrecord. 1990, Prop. 14, sec. 1.) Section14-4.ConductofEmployees. Officersandemployeesofthecountywhiledischargingtheirdutiesanddealingwiththe publicshalladheretothefollowingprecepts: a)Allpublicpropertyandequipmentaretobetreatedasapublictrustandarenotto beusedinaproprietarymannerorforpersonalpurposeswithoutproperconsent. b)Nopersoninasupervisorycapacityshallengageinpersonalorbusiness relationshipswithsubordinateswhichmightintimidatesaidsubordinatesinthe dischargeoftheirofficialduties. c)Allpersonsshallbetreatedinacourteous, fairandimpartialmanner. 2010, Prop. 7, sec. 63.) Section14-5.BoardofEthics. Thereshallbeaboardofethicsappointedbythemayorwiththeapprovalofthecouncil. Itshallconsistoffivememberswhoshallberesidentsofthecounty. Eachshallserveforaterm offiveyears. Upontheinitialappointmentofmemberspursuanttothischarter, oneshallbe appointedforatermofoneyear, oneforatermoftwoyears, oneforatermofthreeyears, one foratermoffouryearsandoneforatermoffiveyears. Theboardshallestablishitsrulesof procedure. Withoutlimitationofitsfunctions, theboardshall: a)Interpretthecodeofethicsforbothcountyofficialsandthepublicandonitsown mayinitiateandrenderopinionswithrespectthereto. b)Renderadvisoryopinionstocountyofficersandemployeeswithrespecttothe codeofethicspursuanttowrittenrequestsbyofficersandemployees. c)Receiveandinitiatecomplaintsofviolationsofthecodeofethicsandtransmit suchcomplaintstothecouncilortheappropriateappointingauthority, alongwith anypertinentadvisoryopinionsthereto. d)Holdhearingsorconductinvestigationsconcerning applicationofthecodeof ethicsandmakepublicsuchviolationsofthecodethatcometoitsattention. 61 e)Publishadvisoryopinionswithsuchdeletionsasmaybenecessarytoprevent disclosureofidentityofpersonsinvolvedwheresuchopinionsarerendered pursuanttosubsection (b) above. f)Proposerevisionstothecodeofethicswherenotinconsistentwiththischarter. 2010, Prop. 7, sec. 64.) Section14-6.Penalties. ThefailuretocomplywiththeprovisionsofSections14-2to14-4, inclusive, shall constituteacauseforsuspension, removalfromofficeoremployment, orsuchotherpenaltyas thecouncilmayprescribebyordinance. Nothinghereinshallprecludeanyotherremedy availableagainsttheofficeroremployeeofthecountyasprovidedbylaw. 2010, Prop. 7, sec. 65.) ARTICLEXV CHARTERAMENDMENTORREVISION Section15-1.InitiationofAmendmentsorRevisions. Amendmentsorrevisionsofthischartermaybeinitiatedonlyinthefollowingmanner: a)Byordinanceofthecounciladoptedafterthreereadingsonseparatedaysand passedbytheaffirmativevoteoftwo-thirdsoftheentiremembership. b)Bypetitionpresentedtothecouncil, signedbyqualifiedelectorsequalinnumber toatleasttwentypercentofthetotalballotscastinthelastprecedinggeneral election, settingforththeproposedamendmentsorrevisions. Suchpetitionshall designateandauthorizenotlessthanthreenormorethanfiveofthesigners theretotoapproveanyalterationorchangeintheformorlanguageorany restatementofthetextoftheproposedamendmentsorrevisionswhichmaybe madebythecorporationcounsel. Eachelectorsigningsuchpetitionshallprinttheirname, whichshallbereasonably similartotheirnameasitappearsonthegeneralcountyregisterfortheCountyofHawai‘i, residenceaddress, andaddtheirsignature, monthanddayoftheirbirthdate, andthelastfour digitsoftheirsocialsecuritynumberonsaidpetition. Signaturesmaybeonseparatesheetsbut eachsheetshallhaveappendedtoittheaffidavitofsomepersonthattothebestoftheaffiant’s knowledgeandbeliefthepersonswhosesignaturesappearonthesheetareregisteredelectorsof thecounty, thattheysignedwithknowledgeofthecontentsofthepetitionandthattheir residencesarecorrectlygiven. Uponfilingofsuchpetitionwiththecouncil, thecountyclerkshallexaminethesameto seewhetheritcontainsasufficientnumberofapparentlygenuinesignaturesofregisteredvoters. Theclerkmayquestionthegenuinenessofanysignatureappearingonthepetitionoraffidavit. Iftheclerkfindsthatanysuchsignatureonthepetitionoraffidavitisnotgenuine, theclerkshall disregardsuchsignature. Theclerkshalleliminateanysheetofthepetitionwhichisnot accompaniedbyavalidaffidavit. Theinvalidityofanysheetshallnotaffectthevalidityofthe petitionifasufficientnumberofsignaturesremainaftereliminatingsuchinvalidsheet.
