Continued hearing on the revocation of Special Permit No. 05-009 (Melvin Miranda), which allowed the establishment of a contractor’s base yard on approximately one acre of land situated within the State Land Use Agricultural District. The property is located along the north side of the Hawaii Belt Highway (Highway 19) at the 47.5-mile marker, Kapoaula, Hamakua, Hawaii, TMK: 4-7-7: portion of 55. NEW BUSINESS – 9:00 a.m. APPLICANT: MELVIN W. MIRANDA (SPP NO. 05-009) 2. Request to amend Condition No. 2 (time to secure Final Plan approval) of Special Permit No. 05-009, which allowed the establishment of a contractor’s base yard on approximately one acre of land situated within the State Land Use Agricultural District. The property is located along the north side of the Hawaii Belt Highway (Highway 19) at the 47.5-mile marker, Kapoaula, Hamakua, Hawaii, TMK: 4-7-7: portion of 55. APPLICANT: MINIPRO CONSTRUCTION, INC. (SPP NO. 998) 3. Amendment to Condition No. 2 (construction time requirement) of Special Permit No. 998, which allowed the construction of a self-storage facility and related improvements on 1 acre of land situated within the State Land Use Agricultural District. The amendment request also includes increasing the land area to 3 acres and to increase the number of storage units and storage structures. The property is located in the Kona- South Estate Subdivision situated on the south (makai) side of Highway 11, approximately 1 and ¼ miles west of the Ocean View Post Office, Kahuku, Ka’u, Hawaii, TMK: 9-2-150: portion of 51. NEW BUSINESS – 9:30 a.m. APPLICANT: HILO HILLSIDE CORPORATION (REZ 738) 4. Amendment to Condition C (time to secure Final Subdivision Approval) of Change of Zone Ordinance No. 93-36, which rezoned 153.479 acres of land from Agricultural 20- acre (A-20a), Agricultural 10-acre (A-10a) and Agricultural 3-acre (A-3a) to Residential and Agricultural 1-acre (RA-1a) district. The property is located mauka (southwest) of st the Sunrise Estates Subdivision, Increment I, Kukuau 1, South Hilo, Hawaii, TMK: 2-4-8: portions of 14 and 26. APPLICANT: ROBERT & RUBY KOBAYASHI (SPP 1194) 5. Amendment to Condition Nos. 2 (life of permit), 3 (time to finalize building permits) and 10 (time to secure final plan approval) of Special Permit No. 1194, which allowed the establishment of an auto repair shop on approximately 3,500 square feet of land within the State Land Use Agricultural District. The property is located at the northwest corner of the Keaau-Pahoa Road (Highway 130) and Ilima Street intersection, Orchidland Estates Subdivision, Keaau, Puna, Hawaii, TMK: 1-6-9:166. APPLICANT: CLARK REALTY CORPORATION (REZ 06-000053) 6. Amendment to delete Condition G (connection to existing County sewer line) of Ordinance No. 07-40, which rezoned 21,050 square feet of land from a Limited Industrial – 20,000 square feet (ML-20) to an Industrial-Commercial Mixed Use – 20,000 square feet (MCX-20) district. The property is located along the west side of Kanolehua Avenue, approximately 95 feet north of the Kanoelehua Avenue – Hualani Street intersection, Waiakea House Lots, First Series, Waiakea, South Hilo, Hawaii, TMK: 2-2-35:47. NEW BUSINESS – 10:15 a.m. APPLICANT: COUNTY OF HAWAII DEPT. OF PUBLIC WORKS (SPP 05-014) 7. Amendment to Special Permit No. 05-014, which allowed the establishment of a fire station and related uses on 8.189 acres of land situated within the State Land Use Agricultural District. The request is to also allow the construction of a police station and related uses and to increase the affected land area to 9.5 acres. The property involved is the fire station site currently under construction and situated along the northeast side of the Keaau-Pahoa Road (Highway 130), approximately 1,400 feet north of the Highway 130-Pahoa Village Road junction, Keonepoko-Nui and Keonepoko-Iki, Puna, Hawaii, TMK: 1-5-7: portion of 17. APPLICANT: COUNTY OF HAWAII DEPT. OF PUBLIC WORKS 8. (SPP 08-000048) Special Permit to allow the development of a highway maintenance baseyard and related uses on 14.9 acres of land situated within the State Land Use Agricultural District. The property is located approximately one mile east of Paauilo Village along the south (mauka) side of the Hawaii Belt Road (Highway 19) at Koholalele, Hamakua, Hawaii, TMK: 4-2-5: portion of 1. 2 NEW BUSINESS – 10:45 a.m. APPLICANT: HAWAIIAN VANILLA COMPANY, INC. (SPP 08-000049) 9. Special Permit to allow a facility to market agricultural products, host educational tours, conducts culinary presentations, and operate a certified kitchen on 29,925 square feet of land situated in the State Land Use Agricultural District. The property is located along the south side of Paauilo Mauka Road, directly across from the Paauilo Mauka Road and nd Kaapahu Road junction, Paauilo (2 Series) Homesteads, Hamakua, Hawaii, TMK: 4-3-13:27. INITIATOR: PLANNING DIRECTOR 10. Amendment to Planning Commission Rule 9 (Special Management Area) by including requirements to mitigate the adverse impacts of light pollution in coastal areas and artificial lights on the shoreline and ocean waters by prohibiting the positioning of artificial lights in a manner causing direct illumination of the shoreline and ocean waters. This amendment is mandated by Act 224, Sessions Law of Hawaii 2005. MINUTES February 1, 2008 March 6, 2008 ADMINISTRATIVE MATTERS ANNOUNCEMENTS ADJOURNMENT The purpose of the public hearings is to afford all interested persons a reasonable opportunity to be heard on the above matters. Pursuant to Rule 4, Contested Case Procedure, of the County of Hawaii Planning Commission Rules of Practice and Procedure, any person seeking to intervene as a party to a contested case hearing on the items 2, 3, 5, 7, 8, 9 and 11 above is required to file a written request which must be received in the office of the Planning Department no later than seven (7) calendar days prior to the Planning Commission’s first public meeting on the matter. Such written request shall be in conformity with Rule 4, in a form as provided in Rule 4 Appendix A “Petition for Standing in a Contested Case Hearing.” The written petition/request shall be filed with the Planning Commission at Aupuni Center, 101 Pauahi Street, Suite 3, Hilo, Hawaii 96720, and accompanied by a filing fee of $100 payable to the Director of Finance. Any party may retain counsel if that person so desires. Rule 4 may be inspected or purchased ($2.50) at the above-cited location. Rule 4 may also be viewed at the County of Hawaii website (). http://www.co.hawaii.hi.us Submitting Testimony: According to Rule 1 (General Rules) of the Planning Commission, a person desiring to submit oral or written testimony shall indicate her/his name; residence address; and whether the testimony is on her/his behalf or as a representative of an 3 organization or individual. If testimony is being submitted on behalf of an organization, documentation showing membership ratification should accompany the testimony. Written testimony shall be submitted with an original and nine copies prior to testifying. The Commission would appreciate timely submittal to the Planning Department at least one week prior to the hearing date to allow for mailing and thorough Commission review. Testimony that is irrelevant or unduly repetitious may be limited by the Chairperson pursuant to Rule 1. Notice to Lobbyists: If you are a lobbyist, you must register with the Hawaii County Clerk within five days of becoming a lobbyist {Article 15, Section 2-91.3(b), Hawaii County Code}. A lobbyist means “any individual engaged for pay or other consideration who spends more than five hours in any month or $275 in any six-month period for the purpose of attempting to influence legislative or administrative action by communicating or urging others to communicate with public officials.” {Article 15, Section 2-91.3(a)(6), Hawaii County Code} Registration forms and expenditure report documents are available at the Office of the County nd Clerk, 333 Kilauea Avenue, 2 Floor, Hilo, Hawaii 96720. Maps showing the general locations and boundaries of the areas under consideration and/or plans of the proposed developments are on file and open to inspection during office hours at the Planning Department, Aupuni Center, 101 Pauahi Street, Suite 3, Hilo, Hawaii and at the Kona office of the Planning Department, 75-5706 Kuakini Highway, Suite 109, Kailua-Kona, Hawaii. Any disabled person requiring special assistance or person requiring auxiliary aid and/or services to participate in the hearing should contact the Planning Department at 961-8288 five (5) working days prior to the hearing so that appropriate arrangements can be made.
