DATE: Friday, September 30, 2005 TIME: 9:00 a.m. PLACE: Hapuna Beach Prince Hotel, Hau/Lehua Room - 62100 Kaunaoa Drive, Kohala Coast, Hawaii UNFINISHED BUSINESS – 9:00 a.m. APPLICANT: PARKER SCHOOL BOARD OF DIRECTORS (USE 05- 1. 001) Discussion and action on the Hearing Officer’s report on a Use Permit to allow the establishment of an elementary school on 2.635 acres of land zoned Agricultural 1-acre (A-1a) and situated within the State Land Use Urban district. The property is located along the southeast side of Kapiolani Road, approximately 550 feet east of the Kapiolani Road-Lindsey Road intersection, Waimea, South Kohala, Hawaii, TMK: 6-5-4: portion of 25. UNFINISHED BUSINESS – 10:00 a.m. APPLICANT: PHIL TINGUELY (SMA 05-004) 2. Contested case hearing on the application for a Special Management Area Use Permit to allow the construction of two three-story mixed use buildings, which include eight residential suites, and a two-story commercial office building on a 3-acre property. The property is located between Kuakini Highway and Walua Road, approximately 1,500 feet northwest of the Kuakini Highway and Walua st Road junction, Waiaha 1, North Kona, Hawaii, TMK: 7-5-18:95. UNFINISHED BUSINESS – 10:30 a.m. KAILUA KONA VILLAGE DEVELOPMENT GROUP (SSV 05-001) 3. Continuation of a hearing on the application for a Shoreline Setback Variance to allow the construction of an outdoor seating lanai to the existing restaurant proposed within the 40-foot shoreline setback area. The property is the site of the existing Kona Inn Shopping Village, Kailua Village, Kailua-Kona, Hawaii, TMK: 7-5-7:21. NEW BUSINESS – 11:00 a.m. APPLICANT: EDWIN DELUZ TRUCKING AND GRAVEL, LLC (SPP 4. NO. 164) Request to amend condition number 2 of Special Permit No. 164, which allowed the operation of a quarry on approximately 63,648 acres of land situated within the State Land Use Agricultural District. The property is located approximately 4,600 feet south of Waikoloa Road and 1.3 miles southeast of Waikoloa Village, Waikoloa, South Kohala, Hawaii, TMK: 6-8-2: Portion of 16. APPLICANT: QUEEN LILIUOKALANI TRUST (SMA USE PERMIT NO. 5. 201) Request to amend Special Management Area Use Permit No. 201 by changing the request from a 76-lot Industrial Subdivision to an Industrial-Commercial Mixed Use Subdivision. The request would allow the undeveloped properties to be developed with uses permitted in the Industrial-Commercial Mixed (MCX) district. The area involved is referred to as the “Makalapua Business Center” and is located north of the existing Kona Industrial Subdivision and makai of Queen Kaahumanu Highway, Kailua-Kona, Keahuolu, North Kona, Hawaii, TMK: 7-4- 8: portion of 2 & 70, and 7-4-25:1-4. NEW BUSINESS: 1:30 p.m. APPLICANT: DARRELYN M. GRAVETT (SPP 05-016) 6. Application for a Special Permit to allow a 2-unit bed and breakfast establishment on 1.291 acres of land situated within the State Land Use Agricultural District. The property is located between the Holualoa Art Gallery and the Kona Imin Center on the mauka (east) side of the Old Government Road, Holualoa, North Kona, Hawaii, TMK: 7-6-3:13. APPLICANT: DANIEL IBBETSON (SPP 05-015) 7. Application for a Special Permit to allow a 2-unit bed and breakfast establishment on 0.722 acre of land situated within the State Land Use Agricultural District. The property is located along the west (makai) side of Mamalahoa Highway (Highway 11), approximately 120 feet south of the Kaohe Road-Mamalahoa Highway th intersection, Kaohe 5, South Kona, Hawaii, TMK: 8-7-9:14. APPLICANTS: YOSHIO INABA, ET AL (REZ 05-003) 8. Application for a Change of Zone for 43.88 acres of land from an Agricultural 40- acre (A-40a) to an Agricultural 5-acre (A-5a) district. The property is located on the north side of Mamalahoa Highway, adjacent and west of the Hoonani nd Subdivision, Puukapu Homesteads, 2 Series, Waimea, South Kohala, Hawaii, TMK: 6-4-17:40. MINUTES August 26, 2005 ADMINISTRATIVE MATTERS Status of appeals filed on Planning Commission decisions – Corporation Counsel Other Commission matters ANNOUNCEMENT ADJOURNMENT The purpose of the public hearings is to afford all interested persons a reasonable opportunity to be heard on the above requests. According to Rule 1 (General Rules) of the Planning Commission, a person desiring to submit oral or written testimony shall indicate her/his name; residence address; and whether the testimony is on her/his behalf or as a representative of an organization or individual. If testimony is being submitted on behalf of an organization, documentation showing membership ratification should accompany the testimony. Written testimony shall be submitted with an original and nine copies prior to testifying. The Commission would appreciate timely submittal to the Planning Department at least one week prior to the hearing date to allow for mailing and thorough Commission review. The Chairperson pursuant to Rule 1 may limit testimony that is irrelevant or unduly repetitious. Maps showing the general location and boundaries of the areas under consideration and/or plans of the proposed developments are on file and open to inspection during office hours at the Planning Department, Aupuni Center, 101 Pauahi Street, Suite 3, Hilo, Hawai‘i 96720 and at the Planning Department Kona Office, 75-5706 Kuakini Highway, Suite 109, Kailua-Kona, Hawai‘i 96740. Pursuant to Rule 4, Contested Case Procedure, of the County of Hawaii Planning Commission Rules of Practice and Procedure, any person seeking to intervene as a party to a contested case hearing on item nos. 4, 5, 6 and 7 above, is required to file a written request which must be received in the office of the Planning Department no later than seven (7) calendar days prior to the Planning Commission’s first public meeting on the matter. Such written request shall be in conformity with Rule 4, in a form as provided in Rule 4 Appendix A “Petition for Standing in a Contested Case Hearing.” The written petition/request shall be filed with the Planning Commission at Aupuni Center, 101 Pauahi Street, Suite 3, Hilo, Hawai‘i 96720, and accompanied by a filing fee of $100 payable to the Director of Finance. Any party may retain counsel if that person so desires. Rule 4 may be inspected or purchased ($2.50) at the above-cited location.
