HomeMy WebLinkAbout2005-05-20 Planning Commission AgendaNOTICE OF SPECIAL PUBLIC MEETING AND HEARINGS PLANNING COMMISSION COUNTY OF HAWAII NOTICE IS HEREBY GIVEN of the following matters to be considered by the Planning Commission of the County of Hawaii in accordance with the provisions of Chapters 91 and 92, Hawaii Revised Statutes, Section 6 -4.3 of the Charter of the County of Hawaii, and the Planning Commission's Rules of Practice and Procedure. DATE: Friday, May 20, 2005 TIME: 9:00 a.m. PLACE: King Kamehameha's Kona Beach Hotel, Kamakahonu Ballroom, 75 -5660 Palani Road, Kailua -Kona, Hawaii NEW BUSINESS — 9:00 a.m. 1. APPLICANTS: TOOMAN FAMILY TRUST ETAL (SLU 05- 001/REZ 05 -001) a. State Land Use Boundary Amendment from Agricultural to Rural for 5.312 acres of land. b. Change of Zone from Agricultural 5 -acre (A -5a) to Residential and Agricultural 2 -acre (RA -2a) for 5.312 acres of land. The property is located along the south side of Kawaihae Road with access from Kanehoa Street, Kanehoa Estates Subdivision, Ouli, South Kohala, Hawaii, TMK:6 -2 -9:26. 2. APPLICANT: DEBRA DICKENS (SPP 05 -005) Special Permit to allow the re- establishment of a neighborhood store (former Morihara Store) on approximately 10,000 square feet of land situated within the State Land Use Agricultural District. The property is located along the southeast (mauka) side of Highway 11 and across from the Highway 11 — City of Refuge Road junction, Keokea, South Kona, Hawaii, TMK: 8 -4 -15: portion of 10. 3. APPLICANT: HUALALAI ACADEMY, INC. Amendment to condition no. 3 (increase in enrollment from 210 to 360 students) of Special Permit No. 1011, which allowed the development of a private school and related improvements on approximately 14.785 acres of land situated within the State Land Use Agricultural District. The property is the existing site of the Hualalai Academy School situated on the west (makai) side of the Kealakaa Street — Hao Kuni Street intersection, approximately 2,300 feet north of the Kealakehe Elementary and Intermediate School Complex, Honokohau 2nd, North Kona, Hawaii, TMK: 7 -4 -8:64. NEW BUSINESS — 9:30 a.m. 4. APPLICANT: KPC VILLAGES, LLC (REZ 04- 033 /SMA 04 -009) a. Change of Zone from Multiple - Family Residential 1,000 square feet (RM -1) to Resort -Hotel 750 square feet (V -.75) for approximately 51,052 square feet of land. b. Special Management Area Use Permit to allow the development of sixty -seven (67) multiple family residential units and commercial spaces within a 45 -foot high structure, and related improvements. The property is located on the mauka side of Alii Drive across from Huggo's Restaurant and the Royal Kona Resort Hotel complex, Kailua -Kona, Puaa 3'd North Kona, Hawaii, TMK: 7 -5 -9:23. 5. APPLICANT: KPC VILLAGES, LLC (SMA USE PERMT NO. 276) Revocation of Special Management Area Use Permit No. 276, which allowed the development of a 48 -unit condominium project and related improvements. The property is located on the mauka side of Alii Drive across from Huggo's Restaurant and the Royal Kona Resort Hotel complex, Kailua -Kona, Puaa 3'd North Kona, Hawaii, TMK: 7 -5 -9:23. UNFINISHED BUSINESS — 10:00 a.m. 6. INITIATOR: COUNTY COUNCIL (Bill No. 23, Draft 2) Draft Bill amending Chapter 14, Hawaii County Code, by adding a new article to provide enhanced public notice of proposed development. UNFINISHED BUSINESS — 10:30 a.m. 7. APPLICANT: WESLEY AND KELLEY HUGGETT (Formerly ERIC SOTO - SMA 03 -007) Continued hearing on a Special Management Area Use Permit application to allow the construction of a three and one -half story, 45 -foot high, 12 -unit multi- family residential development and related improvements on approximately 15,203 square feet of land. The property is located on the west (makai) side of Alii Drive, adjacent to and north of the Sea Village Condominium complex, Kahului, North Kona, Hawaii, TMK: 7 -5- 19:30. MINUTES April 22, 2005 ADMINISTRATIVE MATTERS Status of appeals filed on Planning Commission decisions — Corporation Counsel Other Commission matters ANNOUNCEMENT ADJOURNMENT The purpose of the public hearings is to afford all interested persons a reasonable opportunity to be heard on the above requests. According to Rule 1 (General Rules) of the Planning Commission, a person desiring to submit oral or written testimony shall indicate her/his name; residence address; and whether the testimony is on her/his behalf or as a representative of an organization or individual. If testimony is being submitted on behalf of an organization, documentation showing membership ratification should accompany the testimony. Written testimony shall be submitted with an original and nine copies prior to testifying. The Commission would appreciate timely submittal to the Planning Department at least one week prior to the hearing date to allow for mailing and thorough Commission review. The Chairperson pursuant to Rule 1 may limit testimony that is irrelevant or unduly repetitious. Maps showing the general location and boundaries of the areas under consideration and/or plans of the proposed developments are on file and open to inspection during office hours at the Planning Department, Aupuni Center, 101 Pauahi Street, Suite 3, Hilo, Hawaii 96720 and at the Planning Department Kona Office, 75 -5706 Kuakini Highway, Suite 109, Kailua -Kona, Hawaii 96740. Pursuant to Rule 4, Contested Case Procedure, of the County of Hawaii Planning Commission Rules of Practice and Procedure, any person seeking to intervene as a party to a contested case hearing on item nos. 2, 3, 4b and 5 above, is required to file a written request which must be received in the office of the Planning Department no later than seven (7) calendar days prior to the Planning Commission's first public meeting on the matter. Such written request shall be in conformity with Rule 4, in a form as provided in Rule 4 Appendix A "Petition for Standing in a Contested Case Hearing." The written petition/request shall be riled with the Planning Commission at Aupuni Center, 101 Pauahi Street, Suite 3, Hilo, Hawaii 96720, and accompanied by a filing fee of $100 payable to the Director of Finance. Any party may retain counsel if that person so desires. Rule 4 may be inspected or purchased ($2.50) at the above -cited location. Rule 4 may also be viewed at the County of Hawaii website (http: / /www.co.hawaii.hi.us). Any disabled person requiring special assistance or person requiring auxiliary aid and/or services to participate in the hearing should contact the Planning Department at 961 -8288 three (3) working days prior to the hearing so that appropriate arrangements can be made.
