Continued hearing, including discussions on the Hearing Officer's proposed Findings of Fact, Conclusions of Law, and Recommendations, and any exceptions and/or oral arguments of the parties, on the application for a Special Management Area (SMA) Use Permit to allow the development of fourteen (14) condominium units within two 3-story buildings and a 2-story building, and related improvements. The property is located along the southwest side of Kaloko Drive across from the Kaloko Drive-Haleamau Street intersection, Kaloko Mauka Subdivision, Kaloko, North Kona, Hawaii, TMK: 7-3-26:11. APPLICANT: BRUCE R. EASLEY (REZ 04-030) 7. Application for a Change of Zone for approximately 20.254 acres from an Agricultural 20-acre (A-20a) to an Agricultural 10-acre (A-10a) district. The property is located along the north side of Kaloko Drive, approximately 2,600 feet southwest of the Kaloko Drive – Kapehe Street intersection, Kaloko Mauka Subdivision, Kaloko, North Kona, Hawaii, TMK: 7-3-27:7. APPLICANT: MATTHEW K. MATHER (REZ 04-031) 8. Application for a Change of Zone for approximately 21.695 acres from an Agricultural 20-acre (A-20a) to an Agricultural 10-acre (A-10a) district. The property is located along the north side of Kaloko Drive, approximately 2,100 fee southeast of the Kaloko Drive-Haleamau Street intersection, Kaloko Mauka Subdivision, Kaloko, North Kona, Hawaii, TMK: 7-3-27:6. NEW BUSINESS – 1:30 p.m. APPLICANT: HALE HANA PARTNERS (SV 04-004) 9. Application for a Sign Variance to allow deviations from the requirements of Chapter 3 (Advertising and Signs), Article 2 (Kailua Village Signs), Division 1, Sections 3-72 (sign and lettering size), 3-73 (number of signs) and 3-74 (sign height) of the Hawaii County Code, as amended. The property is located between the Queen Kaahumanu Highway and Luhia Street and known as the Hale Hana Center, Kailua-Kona, North Kona, Hawaii, TMK: 7-4-15:18. APPLICANT: ISLAND BEAN EXPRESSO, LLC (SV 04-003) 10. Application for a Sign Variance to allow deviations from the requirements of Chapter 3 (Advertising and Signs), Article 2 (Kailua Village Signs), Division 1, Sections 3-74 (sign height) and 3-75 (prohibited signs) of the Hawaii County Code, as amended. The property is located at the southern corner of Kuakini Highway and Hanama Place, Kailua-Kona, North Kona, Hawaii, TMK: 7-5-7:33. (b)Amendment to Section 25-5-152 (b) of Chapter 25 (Zoning Code), Hawaii County Code, by allowing commercial excavation within the General Industrial (MG) district, provided that a Use Permit is obtained from the Planning Commission. According to Rule 1 (General Rules) of the Planning Commission, a person desiring to submit oral or written testimony shall indicate her/his name; residence address; and whether the testimony is on her/his behalf or as a representative of an organization or individual. If testimony is being submitted on behalf of an organization, documentation showing membership ratification should accompany the testimony. Written testimony shall be submitted with an original and nine copies prior to testifying. The Commission would appreciate timely submittal to the Planning Department at least one week prior to the hearing date to allow for mailing and thorough Commission review. The Chairperson pursuant to Rule 1 may limit testimony that is irrelevant or unduly repetitious. Maps showing the general location and boundaries of the areas under consideration and/or plans of the proposed developments are on file and open to inspection during office hours at the Planning Department, Aupuni Center, 101 Pauahi Street, Suite 3, Hilo, Hawai‘i 96720 and at the Planning Department Kona Office, 75-5706 Kuakini Highway, Suite 109, Kailua-Kona, Hawai‘i 96740. Any disabled person requiring special assistance or person requiring auxiliary aid and/or services to participate in the hearing should contact the Planning Department at 961-8288 ten (10) working days prior to the hearing so that appropriate arrangements can be made.
